Features of receiving an invitation to work in different countries

The complexity of paperwork, in particular, an invitation from an employer, will depend on the country in which the Russian applicant has found a job.

Poland

A Polish work invitation or approval (in full “Statement of intention to entrust work to a foreigner”) is necessary to obtain a work visa for a foreigner, valid for six months. This invitation is suitable for Belarusians, Russians, Ukrainians, and Moldovans and is most often used to fill the shortage of seasonal labor in the country.

A Polish national visa valid for one year can be opened if the employer issues a voivodeship invitation.

Such a document is received, as a rule, by those foreigners who have already worked and lived in the country for a certain time. Unlike a regular Job offer, the voivode’s invitation has a territorial reference, a specific place of registration.

Israel

How is an application made?

Can a new employer refuse to hire?

If the employer decides to refuse employment to the invited employee, he can file a complaint with the labor inspectorate or sue him in court. What it is

An invitation in the form of a job offer is a relatively new phenomenon for the Russian labor market, introduced by Western companies.

Literally translated, a job offer means sending an offer to occupy a specific position, indicating a number of conditions for future cooperation - from the amount of remuneration to the additional social package provided.

At the same time, given that the invitation is essentially reminiscent of a translation, many applicants have quite natural questions about how the newfangled trend is consistent with the norms of labor legislation and what functions it performs.

Does it have legal force?

An invitation to work can be called an official document, on the basis of which an employee can resign from his previous place of work and move to a new employer.

However, this is not a transfer, which is stipulated in Part 4 of Article 64 of the Labor Code of the Russian Federation, given that the offer is sent only to the employee, and not to the directorate, and there is no correspondence between the two companies to agree on the transfer of an employee from one state to another.

Thus, these legal relations, despite the obvious signs of labor standards, are not regulated by the Labor Code of the Russian Federation at all.

In this case, the invitation could be called an offer within the framework of Article 435 of the Civil Code of the Russian Federation, taking into account the main features, if not for several inconsistencies:

  • an offer can be written or oral, while a job offer is drawn up only in the form of a business letter;
  • the offer must contain the essential terms of the employment contract, and the invitation includes only a few of them, and even then in a general form.

Also, by virtue of Article 429 of the Civil Code of the Russian Federation, it was possible to draw a parallel with the preliminary agreement, if again not for several distinctive features:

  • affixing signatures of the parties to the job offer is not provided;
  • there are no basic conditions for future cooperation.

Therefore, it is impossible to equate this document to an agreement, as well as to force the planned activities to be carried out subsequently.

However, despite the lack of regulation and signs of legal force, a job offer cannot be called a completely useless and formal document, given that on its basis you can get a job.

Moreover, this can be achieved through the court if the document is drawn up with violations or in a format that automatically recognizes them as a preliminary agreement or an offer.

If the job offer conditions are not met

In practice, this situation is unfortunately possible. Its initiator can be either an employer or an employee. What can be done in this case?

The fact is that a job offer cannot be officially regarded as a document with legal status, the provisions of which are binding. It should be noted that judicial practice regarding disputes arising on this basis between an employer and an employee has not yet been formed in Russia.

The image component thus becomes the main motivating force forcing the parties to comply with the conditions specified in the invitation. Since the job offer model in Russia is most often used by large corporations or international companies, such organizations are interested in maintaining their high status as reliable players in the global market in relation to their personnel policies.

In addition, job offer examples are most often relevant for employees with extensive work experience and an impressive amount of theoretical knowledge. Such people are interested in receiving positive feedback about themselves from employers in order to create an impressive resume. That is why they are also attentive to their reputation and try not to violate the terms of signed agreements.

Main functions and purpose of the document

As a rule, by the time a job offer is sent, the employer and the future employee have undergone several interviews and have an idea of ​​​​the nature of future employment.

However, there may be several applicants, which is why only the candidate who meets all the criteria receives a job offer.

Thus, this letter can be called a kind of notification, which is only informational in nature and invites you to take up a position.

Moreover, in addition to the invitation, this document also has other functions, in particular:

Prices and terms for issuing invitations to work in different countries

The cost and timing of issuing a job offer differ in different countries. Thus, in Poland, starting from January 2020, new requirements for issuing invitations from employers for foreigners have been introduced:

Due to more complicated requirements, purchasing an invitation from a direct employer will cost the applicant 150-200 zlotys; the price from intermediaries will be even higher. The rules for issuing invitations from the voivode remained unchanged.

In order to hire a qualified specialist to work in Canada, the employer will first have to answer why a Canadian citizen was not found for the vacant position.

Then the employer submits an application to the Ministry of Labor with a request to employ the foreigner. Its consideration time is one month, the cost is 1000 Canadian dollars (about 600 euros) for each applicant.

At the same time, even an invitation from an employer from Canada today does not guarantee a work permit for a foreigner. The reason for this is the simplification of the immigration system, focusing on young applicants without much work experience, especially graduates of Canadian universities.

A work invitation to Germany or other EU countries also requires certain efforts from the employer: write and submit a request to issue a work permit to a foreigner, present evidence that none of the local residents are able to perform this type of work, prepare an invitation to work. The period for obtaining all necessary permits can range from several months to six months.

In addition, applicants from the CIS countries who want to find a job abroad should take into account quotas, that is, the number of available places in the country to perform a certain type of work. For example, in America, no more than 66 thousand foreigners can be accepted annually for seasonal work (H-2B visa type).

In what form can it be sent?

An official invitation to work, of course, can be expressed both in writing and orally, but a verbal promise does not guarantee one hundred percent employment and can be violated by the employer himself.

That is why, in order to preserve the prestige of the company, as well as the employee’s confidence in subsequent employment, a job offer is issued only in writing on the institution’s letterhead with the inclusion of some fairly clear conditions that determine the nature of future interaction between the parties.

Content, form and structure

Thus, a job offer is an official letter.

It must be issued only on the company’s letterhead in compliance with a certain structure in the following form:

  • addressing the opponent in a respectful manner, preferably by name and patronymic;
  • notification of a job offer, that is, the text should be drawn up only in the form of an offer, and not a requirement to take a position or begin one’s duties immediately;
  • provision of information about some working conditions, but not all, which will subsequently be included in the employment contract, but only part of them - for example, the amount of wages, some responsibilities, but in general, as well as the terms of the social package;
  • an offer to come to the company to apply for a job on a certain day and discuss other organizational issues;
  • a list of documents that must be carried with you according to the requirements of the law.

At the same time, in this letter it is not advisable to display almost all the conditions of future cooperation, since in case of refusal, the employee may recognize this document as a preliminary agreement and oblige it to be fulfilled within the framework of the law.

Also, you should not include in the letter some organizational details in the form of the date of receipt and signature of the employee who agrees with the above, given that if there are two signatures of the job offer, this document can again be recognized as a preliminary agreement.

How to respond to an employer?

Does Job offer have anything to do with an employment contract?

The main risk of a Job Offer for an employer is that, as already mentioned, an employee who is refused a position may go to court, and the court will consider a harmless invitation to be a concluded employment contract. Consequently, already at the stage of drawing up a letter, factors that will make it resemble a contract should be avoided. These are, firstly, the signatures of both the employer and the employee on the letter, and secondly, the conditions contained in the letter that are mandatory for inclusion in the employment contract (see Article 57 of the Labor Code of the Russian Federation).

In the text of the invitation letter, it is enough to include information that the person has been accepted, the date of starting work, and describe the working conditions that were discussed at the interview stage.
