For which holidays is it necessary to issue an order?

A vacation order must be created for the following types of vacation without fail:

  • If annual paid leave is taken out, the employee is entitled to 28 days of rest time per year worked at the rate of 2.33 calendar days per month of work.

A working person becomes entitled to annual paid leave only after six months. At the request of the employee, the company administration may decide to arrange this leave in advance, in advance.

An employee of the company must take advantage of the rest period within one and a half years from the date of such right. For some categories of citizens this period may be longer.

To use it, they must provide the appropriate supporting document forms. An order is often used when issued in advance, as a way of notifying the beginning and end of a vacation.

  • According to the law or the employment agreement signed with the employee, when providing him with additional leave, this rest time can be combined with the main one or issued separately. Creating an order to grant leave to the employee in this case is necessary, and if the time of main and additional rest is combined, each period must be separately highlighted in the order.
  • When an employee is given a leave without maintaining the amount of salary, such a period may be allocated to the employee with the permission of the manager of the business entity or by virtue of the law upon provision of the relevant documents. An order in such a situation is required to be created, since it consolidates the management’s decision on this issue. After all, the employee is not paid a salary, but the job assigned to him remains.
  • When granting maternity leave, the employee has the opportunity to receive it at 30 weeks. A pregnant woman can use it, or postpone it until a later period. She formalizes her decision in a statement, and the administration approves it by order of the head.
  • When using the period of care for young children, this rest period is provided for by law for caring for children up to one and a half years old. Since this involves payment of benefits, an order to provide such leave must be issued.

Extraordinary leave

In addition to the annual rest period of twenty-eight days, a number of categories of citizens are given additional days as part of employment.
If leave is not granted in accordance with the schedule, then the following are attached as additional documents:

  1. For pregnancy and childbirth - information from the medical institution where the woman is being observed.
  2. For caring for a child up to one and a half years old - the child’s birth certificate.
  3. Study break - a certificate from a university or other educational institution.
  4. By length of service – information about years worked.
  5. For the purpose of restoring health – medical indications reflecting the need for recovery.
  6. Due to the death of a loved one for whom a funeral is required - a certificate.

For other categories of citizens who also have the right to extraordinary additional leave - documentation confirming this fact. For example, these include military personnel and single mothers. The employer is also required to sign the document.

Extraordinary leave does not cancel the standard one, but acts as an addition. Its distinctive feature is that it is impossible to transfer the assigned days off to the next year. The very idea of ​​such a vacation is aimed at providing the opportunity for additional rest, and if a person has not used the days, it means he does not need it.

Deadlines for drawing up an order

The provisions of regulations in the field of labor law do not set strict deadlines for when the head of the company must issue an order in the T-6 form.

But when setting a time frame, you need to remember that there are deadlines for the payment of vacation pay. They must be transferred to the employee within three days before the start of the vacation, or during the same period from the moment of receipt of his application, endorsed by the manager for registration of the vacation period. Therefore, by these dates, an order for the provision of vacation should already be created, since it is the basis for calculating and accruing vacation pay.

In addition, the manager of the enterprise is obliged to inform the employee about the start of the rest period no later than two weeks before the start of this period.
As one of the methods of such communication, an order from the administration to grant leave can be used. Attention! Therefore, it is advisable that the vacation order be drawn up approximately within these time periods.
Nobody forbids you to formalize it earlier; this remains at the discretion of the company administration. Certain deadlines within which a company needs to draw up a vacation order can be established by internal regulations of the organization itself. In such a situation, they must be adhered to unconditionally.

How to draw up an order for leave

A vacation order can be drawn up in free form or using standardized forms:

  • vacation order form No. T-6 (this vacation order form is used if one employee has a vacation);
  • vacation order form No. T-6a (this vacation order form is used if vacation is issued to several employees).

Important!!! The order is issued 14 days before the start of annual leave. At the same time, the employee must be notified of the upcoming vacation. After familiarization, the employee is required to put a personal signature on the line of the document provided for this purpose.

The order consists of three parts:

  1. Heading (company details are indicated)
  2. Document name
  3. Main part (document content)
  4. Formal part (vising authorized persons who confirm the validity of the document)

On what basis is the order issued?

Vacations in business entities are provided to employees in accordance with schedules adopted for the year ahead. Therefore, when indicating the basis in the order, you need to make reference to the vacation schedule.

The vacation schedule is developed at the end of the previous year and approved no later than two weeks before the start of the current period. Each employee of the organization must be familiarized with this local act upon signature.

When applying for leave, an employee may or may not make an application for the desired period. This is only necessary in situations where the vacation schedule does not contain exact start and end dates for the vacation.

In addition, the employee may be given leave at a time other than that indicated in the schedule with the permission of the manager. In such a situation, the statement of a company employee plays a significant role, and it is this that is the basis for creating a management order.

The working employee draws up the application independently either on a sheet of paper using a pen or using a computer. The printed application must contain his living signature.

Attention! When leave is granted to preferential categories of citizens, copies of documents confirming the right to these benefits must also be attached to the application.

Storage period for vacation orders

In accordance with paragraph 19 of the List of standard management archival documents. approved by Order of the Ministry of Culture of the Russian Federation dated August 28, 2010 No. 558, the storage period for such documents is 5 years.

And all types of orders related to rest for workers in difficult, harmful and dangerous working conditions, for child care, without maintenance of pay (wages), in accordance with the same paragraph of the List, are stored for 75 years. Thus, the order for administrative leave, a sample of which is posted above, is stored in the archives for at least 75 years.

In order to secure the employee’s departure for the rest period, the personnel officer, by order of management, draws up an order.

As a rule, a standard T-6 form is used for this purpose. But the company has the right to take it as a basis and make its own document.

It is also possible to take a letterhead and issue an order in the form of a free document. But it is necessary to take into account that in this situation the text of the order must contain mandatory details.

Sample order for granting leave

The T-6 vacation order form begins with a space to indicate the name of the company and its OKPO code established by Rosstat. Next, next to the name of the document, written in the middle, its number in order and the date when it was compiled are indicated.

The number and date will be of great importance in subsequent actions, since they will be used to register the form in the order book. These details are also used in the preparation of many accompanying forms.

Next, you need to write down the name of the department, the exact name of the position, the number from the report card, and personal information.

The next step is to record the time period for which the vacation is provided. This is done for the main working day and additional vacation days.

It must be borne in mind that the beginning of the period of work for which the employee is granted leave is calculated from the date of registration for work, and not the beginning of the calendar year. This information is calculated by a human resources specialist using the information he has about previous periods.

Then the body of the order is divided into three sections - A, B and C.

Section A applies when the employee is granted basic leave. Here you need to indicate the start and certification dates of the vacation and its duration.

Section B should be used when one of the types of additional leave is provided. When filling out this section, you must indicate the name of the period provided, its start and end dates, and days of duration.

Section B is a summary of all types of employee leave. Here you need to indicate the total start and end date of the vacation, as well as the total duration of the entire vacation time.

If only one type of leave has been issued (main or additional), then the information in section B duplicates that indicated earlier.

The document must be signed by the head of the company with personal information.

At the bottom of the form there is an empty field in which the employee must personally put a mark on familiarization - full name. and the date of the event.

Forms T-6 and T-6a rules and features of filling out

The most important component of the organization of work is compliance by the management of the enterprise with the norms of the current legislation on the organization of rest for employees. Leave is granted in accordance with the order.

To unify their content and information component, the Ministry of Statistics has approved uniform forms T-6 and T-6a.

The nuances of using “vacation” forms

On January 5, 2004, the State Committee of the Russian Federation on Statistics issued a Resolution, which approved the list, type and rules for filling out unified wage accounting forms. These include two forms on the basis of which an order is drawn up, signed and issued:

  • T-6 – on granting leave to one employee;
  • T-6a – on granting leave to a group of employees.

Based on correctly completed forms, appropriate changes are made to the time sheet of the employee going on vacation.

Until January 1, 2013, the use of the forms approved by the above-mentioned Resolution was mandatory for enterprises (organizations, institutions). After this date, the mandatory use of forms as forms for employee leave orders is canceled.

Changing the information content of the forms, as well as using the T-6a form to issue an order for one employee, is not an error or violation. The only condition is compliance with the rules of personnel records management:

  • storage of orders for personnel for 3-5 years;
  • entering data on vacations granted into a personal card of form T-2 or T-2GS(MS).

To draw up and approve an order, three documents are required:

  • application from an individual with whom an employment contract has been concluded;
  • approved vacation schedule for the company’s employees for the current year;
  • time sheet. Based on the resolution of the manager, an order is drawn up and approved.

Order deadline

The legislation of the Russian Federation does not contain an exact reference to the period during which this procedure must be carried out. HR and accounting employees should focus on a time period of 3 days before the employee’s vacation begins.

This is the time during which holiday pay must be paid. Accounting staff will need another 1-2 days to calculate the amount required for payment.

Thus, the order should be issued no later than 5 days before the start of the vacation.

The employee should be notified two weeks in advance that he must write a leave application. Thus, the order subsequently issued constitutes a written warning.

It is mandatory to familiarize the employee with its contents, against signature.

Thus, the management of the enterprise has the right to determine independently the deadline for issuing an order to send one or more employees on vacation.

Procedure and sample filling

In order to document sending one employee on vacation, it is enough to issue an order in the T-6 form. The following data is entered into the document:

  • name and OKPO code of the enterprise;
  • name of the structural unit to which the employee is assigned;
  • job title.

To indicate technical data, the order form is divided into three parts:

  1. A – paid basic leave;
  2. B – additional leave;
  3. B – the sum of days in the current calendar year.

Each section indicates the start and end dates of the vacation.

A special feature of T-6 is that in the current calendar year, such an order can only send an employee on vacation two times in a row. If there is at least one working day between two holidays, another order should be issued. This is done to ensure that line “B” reflects accurate information.

If several employees have submitted applications to the head of the enterprise, the order can be issued using the unified form T-6a. The process of filling out the details is carried out in the same way as when filling out T-6. Columns 5 to 11 should contain technical information about the vacations that are provided to employees in the current calendar year.

There is one fundamental difference between the forms: in the second, the vacation is not divided into periods, that is, its start and end dates are entered only once.

Similar to the T-6 form, only two vacations can be reflected in the collective order form.

If the main continuous leave is taken by an employee for different periods, its details may be indicated in the order, issued according to the unified form T-6a, more than once.

This type of document can be used if several employees are going on vacation at once. It is based on a table in which the periods and duration of the upcoming rest are noted.

First, the name of the company is indicated on the form, and the company code assigned in accordance with OKPO is also indicated on the right.

After this, next to the title of the document its serial number and date of preparation are indicated. Subsequently, under these details, the order is recorded in the order book for the enterprise.

After this, you need to fill out a table with data. It should have one line for each employee. In this case, correcting data or skipping lines is not allowed.

The table must be filled out according to the following scheme:

  • Column 1 - full personal data of the employee (full name);
  • 2 — Its number according to the timesheet is indicated;
  • 3 - The name of the unit (name of the department) in which he performs the work is indicated;
  • 4 - The designation of the position is entered according to the staffing table;
  • 5 - The column is intended to indicate the number of days of rest when granting annual leave. In fact, it acts as an analogue of section “A” from the T-6 order form. If the employee is granted another type of leave, the column must contain a dash.
  • 6 - This column is necessary to indicate the number of days for additional leave (study, maternity leave, without pay, etc.). This column is analogous to section “B” from order T-6. If this type of leave is not currently provided to the employee, then a dash is written here.
  • 7 and 8 - are intended to indicate the start and end dates of the vacation period. For the main labor leave, the working year is recorded here, for some types of leave without pay - the calendar year, etc.
  • 9 - is intended to indicate the total number of days of rest. This number is obtained by adding the number of days provided from columns 5 and 6.
  • 10 and 11 - Here you must enter the start and end dates of your vacation;
  • 12 - serves to mark the employee’s familiarization with this order.

After the document is fully drawn up, the director must sign it by putting a personal signature and deciphering it.
