What happens if a person resigns from the police?

Dismissal, regardless of the reasons, is a process regulated by legal norms that ensure the protection of human rights. On the last working day, the employer is obliged to:

  • provide the employee with a work book and other required documents;
  • make payments required by law.

Employees of the Ministry of Internal Affairs, namely the Department of Internal Affairs and the police, are a special category of citizens , close in status to military personnel. Their duty is to protect the state and its citizens from criminal attacks, therefore various types of support and social guarantees are provided for them, including upon dismissal and retirement.

What kind of money is paid to those who want to leave the authorities?

Benefits and other monetary payments in connection with dismissal from the internal affairs department are regulated by Federal Law dated July 19, 2011 No. 247-FZ “On social guarantees for internal affairs bodies employees...” (hereinafter referred to as the Law on Social Guarantees for internal affairs bodies employees). The size and types of payments depend on how many years the employee serves in the authorities and on what grounds he resigns.

At your own request until retirement

If an employee has not served enough years to retire, but wants to resign, he is entitled to the following payments:

  1. Salary. In the system of internal affairs bodies, it is called “monetary allowance”, the detailed procedure for its calculation is established by Order of the Ministry of Internal Affairs of Russia dated January 31, 2013 No. 65. This concept includes salary salary, which is divided into salary by position and salary by special rank.   2. Award for conscientious performance of official duties. During service, various additional monthly bonuses and allowances are added to the basic salary, for example, for achievements or dangerous conditions of service. However, upon dismissal without the right to a pension, the employee cannot count on them. The only bonus that is paid in case of resignation of his own free will is for conscientious performance of duties. The size of this bonus is 25% of the salary, and it can be deprived only if there are serious grounds, such as violation of discipline or the commission of an offense.
  3. Compensation for remaining vacation days . Vacation pay is subject to payment for the current year of service if it has not been used. The basis for such compensation is an order from the manager indicating the exact number of days to be taken into account. To calculate compensation, you need to divide the amount of monetary allowance by the average number of days in a month. The result is the average daily earnings, which is then multiplied by the total number of unused vacation days for the entire period of service.
  4. One-time benefit in accordance with clause 7 of Art. 3 of the Law on Social Guarantees for Police Department Employees.
  5. Material aid. In accordance with paragraph 8 of Art. 1 of the Federal Law of June 30, 2002 No. 78-FZ “On monetary allowances for employees of certain federal executive bodies”, employees of internal affairs bodies have the right to financial assistance in the amount of at least two salaries per year. If this opportunity has not yet been used in the current year, the employee has the right to submit a report on payment of financial assistance upon dismissal.
  6. Severance pay. It is paid to internal affairs bodies employees dismissed before retirement for good reasons (clause 10, article 3 of the Law on Social Guarantees for internal affairs bodies employees).

Upon retirement

Employees of departments of the Ministry of Internal Affairs are a preferential category of citizens for whom a special procedure for retirement is provided in accordance with Art. 5 of the Law of the Russian Federation dated February 12, 1993 No. 4468-1 “On pension provision for persons who served in military service.” You can retire if you have served a sufficient number of years, reached a certain age, or become disabled.

To retire you need:

  • having at least 20 years of special experience, which includes service in the structures of the Ministry of Internal Affairs, government or military service, and a number of other periods;
  • having a total work experience of 25 years or more, of which at least 12.5 years have been service in law enforcement agencies.

As for the age limit for service, this age threshold varies for different ranks, but the minimum threshold is 45 years.
For some it will be higher. Upon dismissal with retirement, the following payments are due:

  1. Lifetime pension . Its size depends on the length of service, region, position and rank at the last place of service.
  2. Vacation compensation. Before retirement, an employee can receive payment for all unused vacations during his service:
      for regular annual leave - in full;
  3. and for additional leave (for length of service, for serving in harmful or dangerous conditions, for irregular working days) - at the rate of 1/12 of the leave for each month of work in proportion to the time of service. This calculation formula is established by the Rules on regular and additional leaves (approved by the People's Commissariat of Labor of the USSR dated April 30, 1930 No. 169).
  4. One-time benefit in accordance with the Law on Social Guarantees for police officers.
  5. Bonuses for conscientious performance of official duties and financial assistance are paid on a general basis.

Certain categories of citizens have the right to receive additional pension supplements for length of service:

  • those who lived to be 80 years old;
  • disabled people of group 1;
  • non-working pensioners supporting dependents.

In addition to basic payments, upon dismissal from the police due to disability or injury while performing his duties, the employee is entitled to a one-time allowance in the amount of 2,000,000 rubles (Clause 5, Article 43 of the Federal Law of 07.02.2011 No. 3-FZ “ About the police"). On a negative basis

Employees dismissed for negative reasons receive less severance pay. This refers to employees who are dismissed due to their committing any culpable misconduct. This:

  • and loss of trust;
  • and committing a crime;
  • and submission of false documents;
  • and gross violations of discipline.

Types of benefits

Help can be received by both current employees of the Internal Affairs and those who have already gone on vacation. The list of benefits, including the conditions and procedure for their provision, is enshrined in Chapter. 8 tbsp. 46 of the Police Act. Among the benefits provided to current employees are:

  • tax relief;
  • free pass;
  • housing benefits;
  • labor concessions;
  • compensation and additional payments to employees and family members;
  • placement of the child in a preschool institution, school or children's camp at the place of residence;
  • receiving free medical care.

Taxation

Employees are entitled to the following tax breaks:

  • exemption from personal income tax;
  • discount on payment of transport, land property tax (applies to 1 object and vehicle).

The amount of discounts is determined by local regulations, so their size may vary in different regions of the Russian Federation.

Medical benefits for family members

In Art. 45 Federal Law N states that employees of the Ministry of Internal Affairs are entitled to free medical services, including:

  • provision of medical care;
  • receiving medications;
  • production and installation of dentures and other medical products.

Attention! Medical benefits are provided upon presentation of a certificate and a doctor’s report.

An employee and his family are entitled to vouchers to a sanatorium if he has 20 years of service or has injuries or disfigurements. The discount is 25-50%.

Entitlement to vacation and related benefits

Another benefit is compensation of 100% of the cost of travel for an employee and non-working family members on all public modes of transport during vacation.
Support is provided if the holiday is spent on the territory of the Russian Federation. Plus, luggage transportation weighing up to 30 kg is compensated. If a family gets to their vacation spot by car, then compensation is calculated based on travel along the shortest route. The refund request must be submitted no later than 3 days before the planned departure date.

On a note! VD employees working in the Far North, Siberian Federal District, Ural Federal District and Far Eastern Federal District can count on compensation for travel costs to and from their vacation destination after its completion.

Housing benefits

Persons who do not have their own housing at the place of service can obtain premises for temporary use by concluding a lease or social lease agreement. Payment for rented living space will be compensated by the authorities.

Labor activity

Police pay directly depends on:

  • ranks;
  • length of service;
  • service merit.

Starting from the 2nd year of work, a salary supplement is accrued. Its size is set as a percentage of the salary. Another basis for the bonus is the presence of a qualifying title of at least 3rd class.

Honorary employees receive a 10% increase in salary. Persons working with state secrets have the right to receive an increase of 65% of the salary.

All incentive salary increases and bonuses are paid at the discretion of management.

The salary also increases when serving under special conditions - for example, when working in the Far North and equivalent territories, or participating in particularly dangerous activities.

Cash payments

Law enforcement officers are entitled to a one-time social payment (USB), which they are allowed to spend to purchase their own housing. Employees who:

  • have worked in domestic internal affairs bodies for more than 10 years;
  • do not have their own housing, or own living space that is recognized as unsafe or does not meet the space requirements for each family member;
  • live with a family member suffering from a serious illness;
  • retired and registered as needing improved housing conditions.

If a police officer is killed on duty, the payment is provided to any family member in the next 12 months.

The size of the one-time payment is calculated based on family composition:

  • A police officer living alone is entitled to a living space of 33 square meters. m.;
  • for families of 2 people - from 42 sq. m.;
  • for families of 3 or more people, the area should be at least 18 square meters. m. for each member.

The second factor influencing the value of the URU is the correction factor. It ranges from 1.05 to 1.5 and is set based on accumulated experience in law enforcement agencies.

Persons who have retired and served in the Ministry of Internal Affairs for more than 20 years receive a one-time payment of 7 salaries. If the length of service is less than 20 years, a benefit is calculated in the amount of 2 salaries.

Transport

Transport benefits include:

  • free travel on air and water transport, plus unpaid trips on railway transport during service (to take advantage of this benefit, you must present a certificate to employees of the Ministry of Internal Affairs);
  • the right to unpaid travel on public transport within the city and outside it (with the exception of trips in a private taxi);
  • free transportation of detained persons.

Important! During work trains, representatives of law enforcement agencies have the right to get a place in hotels out of turn upon presentation of a travel document and identification.

Travel on personal transport during service is also reimbursed, but only if the employee performs official duties on it.

Obtaining a mortgage for police officers

Representatives of internal affairs authorities are provided with mortgages on more favorable terms - the repayment period will be increased and the interest rate will be reduced.
The exact lending conditions are set by banks as part of local programs. The right to receive a loan is confirmed by special certificates. To do this, the applicant must serve at least 10 years.

In addition to this, the employee has the right, after reaching 50 years of age, to receive a subsidy, which can be used to cover the first half of the debt.

Compensation for repairs and decoration of residential premises is not due.

Relocation compensation

Since the employee can be transferred to another place for service, he is entitled to reimbursement of part of the costs when moving:

  • compensation for the cost of transporting items weighing up to 20 tons;
  • a “lift” payment accrued to cover the initial costs after the move, in the amount of the employee’s full salary plus ¼ of this amount for each of the moving family members;
  • reimbursement of travel expenses for the entire family to a new place of residence;
  • daily allowance payment.

Payment for kindergarten

Previously existing assistance in paying for kindergarten has been discontinued.
Currently, law enforcement officers are not provided with any special discounts on fees for visiting preschool educational institutions. But they retain the right to receive compensation on a general basis. Its size depends on the number of children:

  • 20% - for 1 child;
  • 50% - for 2 children;
  • 70% - for 3 and subsequent.

Benefits for wives

If the husband died while on duty, the widow has the right to take advantage of medical benefits and receive a voucher for sanatorium treatment with a discount of up to 50%. Benefits are provided until the woman remarries.

Widows with children receive an additional payment for each child. Its size is 1,597 rubles. The money is paid until children reach 18 years of age, or up to 23 years of age if they are studying full-time.

Payments for incapacitated persons are provided indefinitely.

Features for workers with disabilities

If an employee is injured or injured while on duty, he has the right to receive housing at state expense.

For the injury received, a payment in the amount of 2,000,000 rubles is awarded. After retirement, a disabled person receives an increase in the amount of benefits.

In the event of the death of a representative of the VD, relatives and family members of the deceased may claim the property. But housing can only be obtained if the right to benefits existed before the establishment of disability or the death of the employee.

How much salary is paid: features of a lump sum benefit

As already mentioned, the Law on Social Guarantees for Department of Internal Affairs employees provides for a one-time payment upon dismissal to all employees of the department, regardless of the reasons for leaving. The amount of this benefit is affected by the total length of service in the internal affairs bodies:

  • if he is less than 20 years old , two salaries are paid, fixed on the day of dismissal;
  • if more than 20 years , 7 salaries are paid.

For those employees who were awarded state awards or honorary titles during their service, the lump sum benefit is increased by one salary.

A one-time benefit is not paid if there is a fact that the dismissed employee has violated official discipline, subordination, loss of trust, or committed a misdemeanor or offence.

What is severance pay for police officers when calculating?

Paragraph 10 of Article 3 of the Law on Social Guarantees for Police Department employees establishes severance pay for employees who have worked in the authorities for less than 20 years and were dismissed without the right to a pension for one of the following reasons:

  • reaching the maximum possible age for service;
  • poor health, illness;
  • job reduction;
  • expiration of the employee's tenure;
  • violation of the terms of the contract by the employee's manager;
  • refusal to transfer to another position or the impossibility of such a transfer;
  • discovery of the fact that an employee is related to his/her manager, the employee’s refusal to transfer to another position in order to eliminate this circumstance.

Severance pay is paid once a month for 1 year from the date of dismissal of the employee. Its size corresponds to the salary of a dismissed person with a special rank.

Benefits for police officers in the field of preschool education

  1. children of a police officer;
  2. children of a police officer who died as a result of injury or other damage to health received in connection with the performance of official duties;
  3. children of a police officer who died as a result of an illness acquired while serving in the police;
  4. children of a citizen of the Russian Federation who was dismissed from police service due to injury or other damage to health received in connection with the performance of official duties and which excluded the possibility of further service in the police;
  5. children of a citizen of the Russian Federation who died within one year after dismissal from police service as a result of injury or other damage to health received in connection with the performance of official duties, or as a result of an illness received during the period of service in the police, which excluded the possibility of further service in the police ;
  6. children who are (were) dependent on a police officer, a citizen of the Russian Federation, specified in paragraphs 1 - 5 of this part.

Benefits for police officers upon admission to a preschool educational institution

6. Places in general education and preschool educational institutions at the place of residence and in summer health camps, regardless of the form of ownership, are provided on a priority basis:

In Moscow, as in other regions, mothers raising children on their own (single parents) receive the right to a place in kindergarten. However, it should be taken into account that this category of persons belongs to the second priority beneficiaries.

Benefits for kindergarten are guaranteed to disabled children from large, poor families and many others. Additional opportunities are associated with both an advantage in the queue for admission and compensation for fees for services (up to 100%).

Regional features

  1. Children of Judges;
  2. Children of citizens exposed to radiation as a result of the disaster at the Chernobyl nuclear power plant;
  3. Children of citizens exposed to radiation;
  4. Children of deceased (missing) and other persons participating in counter-terrorism operations in the North Caucasus region;
  5. Children of the dead (missing), etc. on the territory of the Republic of Dagestan;
  6. Children of citizens discharged from military service and members of their families (within 1 month from the date of application).
  • Compensation for the cost of transporting 20 tons of things;
  • Payment of “lift” (a police officer’s salary plus another quarter of this amount per moving family member);
  • Compensation for travel expenses for all family members;
  • Payment of daily allowances for the period of time spent traveling to the destination.

How to calculate the amount of funds?

Basic values ​​that are taken to calculate payments upon dismissal from the Ministry of Internal Affairs:

  • salary according to position;
  • salary according to rank.

  • monetary support;
  • one-time benefit;
  • material assistance;
  • severance pay.
  1. For standard positions, the standard salary scale is established by regulations of the Government of the Russian Federation.
  2. For non-standard ones - by acts of other federal executive authorities (for example, order of the State Courier Service of the Russian Federation dated November 29, 2011 No. 388).

Government Decree No. 878 dated November 3, 2011 established the monthly salaries of police officers for standard positions and special ranks.

What compensation is given?

In addition to the above-mentioned compensations, there is a procedure for compensating with money the items of clothing that a police officer is entitled to (regulated by order of the Ministry of Internal Affairs of Russia dated January 10, 2013 No. 8). This means:

  • uniforms that should have been provided to the employee, but were not issued;
  • or a situation where, due to the nature of his or her job, the employee could not wear a uniform.

The amount of compensation payment depends on the following factors:

  • the number of units of uniform assigned to the employee;
  • the period during which it was not issued.

2. The annual wage fund for civilian personnel of the institution is formed based on the amount of funds allocated for payments:

2.3. Monthly bonuses for continuous service (length of service), based on the actual amount of this payment in the institution.

4. Heads of institutions, if necessary, have the right to redistribute funds from the corresponding wage funds for civilian personnel between the payments provided for in paragraphs 2 and 3 of this Procedure, in agreement with the superior manager of budget funds, taking into account the unconditional provision of compensation payments established in accordance with the legislation of the Russian Federation.

5. The wage fund for civilian personnel is subject to recalculation in the following cases:

— increase (indexation) of salaries;

— changes in staff (staffing schedules, lists);

— significant changes in wage conditions.

Deadlines for receiving funds

A month before the proposed dismissal, the employee submits a report addressed to the head of his department, who, in turn, draws up a letter to the resigning employee. The submission, among other data, indicates all guarantees and payments due to the employee.

On the day of dismissal in accordance with Part 8 of Art. 89 of the Federal Law of November 30, 2011 No. 342-FZ “On service in the internal affairs bodies of the Russian Federation...” the employee is paid all amounts of money that do not cause disputes. When employees with the right to retire are dismissed, the accounting department makes records of the amounts paid in the cash certificate. If the dismissed person does not agree with the amount of the amounts paid, he can challenge them in court.

Payment of monthly benefits is made at the end of each month through the cash desk at the employee’s last place of duty, by bank transfer using bank details or by postal transfer.

A conversation is held with each employee who has submitted a report on dismissal from the Ministry of Internal Affairs, during which the issues of social guarantees, payments and compensations due to him are explained to him. During this conversation, you should clarify all questions about payments that are due upon dismissal for one reason or another.

What documents confirm the benefit for priority enrollment?

It is necessary to provide all documents (originals) confirming the category to which you belong when you were placed on the waiting list for kindergarten or when your position changed (that is, as soon as you began to belong to one of the categories). If this is not done, the application will be considered in order of priority.

What documents confirm the privilege for priority enrollment in kindergarten?

First, you need to get on the waiting list for kindergarten; this is done either immediately after the birth of the child or in the very near future. This is usually done by parents immediately after receiving the child’s birth certificate. To place a child on the waiting list for kindergarten, the following documents are required: a copy of the birth certificate (the original must also be taken with you for verification), an application to the commission for the formation of kindergartens (at the MDOU), the applicant’s passport (copy and original for verification), documents confirming the benefit (if there is a benefit).

You will also need documents confirming the benefit: a copy of a disability certificate, a copy of the certificate of a participant in the liquidation of the consequences of the Chernobyl nuclear power plant accident, a copy of the birth certificate of each child or a certificate from the military registration and enlistment office confirming conscription service.

  1. Child's birth certificate.
  2. Parent's passport.
  3. Certificate of family income for the last three months preceding the month of application.
  4. A document confirming the status of an incomplete family - a certificate from the registry office in Form 2, if information about the father in the birth certificate is indicated according to the mother, a death certificate of a parent, a court order on deprivation of parental rights or recognition of the second parent as dead or missing.

How to get benefits for kindergarten

Local authorities can add to the list of benefits and admit to kindergarten without a waiting list, for example, orphans or children without parental care, and children of orphans or those without parental care.
