What changed

First of all, it is worth noting that the law is not against barbecue, as such, it is against incorrect and potentially dangerous lighting of fire, which many citizens commit due to various circumstances. Now, it will no longer be possible to plead your incompetence in this matter, since the Government adopted a new Resolution No. 1479 of September 16, 2021, detailing all the rules and prohibitions on making fires that are relevant for private individuals, which came into effect on January 1, 2021 . According to the regulatory legal act adopted and amended in December of the same year, lighting open fires within civil structures is still strictly prohibited. That is, there can be no talk of any flames on the loggia or on the roof, let alone apartments and entrances to apartment buildings.

You cannot make fires on agricultural lands or reserve lands. That is, in fields, shares and other areas used for agricultural purposes or for grazing livestock.

However, all these taboos existed before, which cannot be said about special regulations for local areas, suburban areas, as well as personal plots belonging to private households, with the exception of some general norms.

Now all these provisions are regulated at the legislative level with detailed instructions for making fires in the courtyard of apartment buildings and on the territory of private households and indicating all safe GOSTs and requirements for equipment (containers) used for cooking.

Fines for burning garbage and making fires 2021

The fines in force for 2021 are established by Article 20.4 of the Code of Administrative Offenses of the Russian Federation: Violation of fire safety requirements

  • From 2 to 3 thousand rubles – for individuals;
  • From 6 to 15 thousand rubles – for officials;
  • From 20 to 30 thousand rubles – for individual entrepreneurs;
  • From 150 to 200 thousand rubles – for legal entities

At the same time, do not forget that under fire conditions the fine figures increase, and additional restrictions may also apply. In addition, if people are injured due to non-compliance with fire safety rules, then fines can turn into criminal liability.

Amounts of fines

The penalties provided for lighting a fire in the wrong place or in the wrong containers have also undergone certain adjustments.

To date, the amount of monetary penalties for such violations corresponds to the following amounts:

  • 3-5 thousand rubles. for open flames on balconies, roofs and other areas of apartment buildings;
  • up to 3 thousand rubles for making fires in the courtyards of multi-storey buildings that do not comply with the rules;
  • up to 3 thousand rubles, although in this case it will be much more difficult to establish and prove the fact of violation - unless only by denunciation of neighbors.

In addition, we should not forget that a fine is a small measure, and if the fire develops into a fire, causing material or physical damage to someone, then responsibility moves to a completely different level - at best, administrative, and at worst - criminal charges.

In this situation, fines also increase, the size of which can be 4-5 thousand rubles.

How to properly make a fire in the country, in the forest and on the river bank so that you don’t get fined?

It is necessary to prepare a place for a fire, according to the rules:

  • Clear the area and dig a hole 0.3 meters deep (or prepare a special site made of non-flammable materials);
  • Prepare a firebreak with a radius of 0.4 meters from the site;
  • There is no grass or vegetation within a radius of 2 meters if you cook food over a fire (barbecue or grill);
  • 5 meters away from a building, country house or other structure (cooking barbecue on the grill);
  • 10 meters from bushes and trees (cooking barbecue on the grill);
  • 25 meters from buildings and 50 meters from trees when burning garbage and making a fire in an iron barrel;
  • There is an open fire pit 50 meters from the building and 100 meters from the trees.

When is it generally forbidden to grill shish kebab over a fire, even at your dacha or on a barbecue? When is a fire prohibited?

  1. If a strict fire regime has been declared in your region.
  2. If the wind speed reaches above 10 meters per second.
  3. If coniferous trees grow on the site.
  4. If a storm warning is issued.
  5. If the site is located on peaty lands.

In addition, you need to constantly monitor the fire. It is advisable to have fire protection equipment nearby: fire extinguisher, sand, water.

Now a little specifics, since general formulations will clearly not be enough to safely barbecue or make a fire for any other purpose. In this case, the rules may differ depending on the areas adjacent to which households the fire is to be lit.

Private

The law does not prohibit the lighting of fires on the territory of personal plots of private households, not only for barbecuing, but also for burning garbage. Another thing is that all this should be done in specially designated places and containers. And if we talk about kebabs, then you need to fry them only on a grill, at a distance of 5 m or more from any (economic or residential) buildings. In addition, within a 2-meter radius from the fire there should not be any flammable substances or materials that could cause ignition and spread of flame on the site and beyond.

And we are not necessarily talking about fuels and lubricants - a fire becomes possible even if there are dry branches, sawdust, old clothes and other rubbish lying near the barbecue.

A fire intended for burning garbage does not require a barbecue. But this does not mean at all that you can start a fire and arrange an ashes right on the open ground.

In such cases, there are two safe options:

  • A pit with a depth of at least 30 cm and a diameter of no more than 1 m. In this case, the recess should be located at a minimum distance of 50 m from the nearest building and 100 m from a coniferous forest (at least 30 m from single specimens of young trees or deciduous tracts).
  • A container that is completely covered at the top with a metal sheet.

As you can see, the rules are quite feasible, so there is no reason to break them - there is a container with a tight seal - great, no - that means we dig a hole, maintaining the required distance.

Apartment

After the adoption of the government decree, their own requirements are also provided for the courtyards of multi-storey buildings. And starting from this year, barbecuing in such areas is allowed only in specially designated areas, if any.

In the country

The rules, recommendations and restrictions on making fires for summer residents are not much different from those provisions and norms that are relevant for owners of private houses. That is, you need to grill shish kebab on a grill, maintaining a safe distance from buildings, vegetation, household garbage and other flammable things, while you can burn garbage only in special containers or in pre-dug holes with the obligatory observance of the distance indicated above. In addition, summer residents should take additional safety measures by having a working fire extinguisher or access to water at their disposal. If the latter is not available, you must have several fully filled 10-liter buckets ready.

FIRE IN THE GARDEN

Theoretically, it can be bred. But only in a specially equipped place. This should be a hole at least 0.3 meters deep and no more than a meter in diameter.

In addition, the following distances must be maintained:

- at least 50 meters to the nearest building,

-100 meters - from a coniferous forest or separately growing coniferous trees and young trees,

- 30 meters - from deciduous forest or separately growing groups of deciduous trees,

- within a radius of 10 meters, everything that could potentially catch fire should be removed - dry grass, branches, etc.

Someone must be near the fire and have “primary fire extinguishing equipment” with them. This is a fire extinguisher or at least a bucket of water.

As you might guess, finding a place on six to ten acres that would be 50 meters from the house and at the same time 30 meters from all the birch trees is almost impossible. Well, if only this area is completely empty - and there is a clean field around, without any dry grass or dead wood. What to do? Fire safety regulations suggest using a special metal container.

How to make a fire in nature and in the forest correctly, and how to avoid getting a fine

Green areas are especially important. It is important to remember that it is not allowed to light a fire under the crowns of coniferous trees, and indeed in the immediate vicinity of forest plantations (100 m from coniferous trees and 30 m from deciduous forests).

This also includes open areas with peat soil. In addition, it is prohibited to start a fire in windy weather - up to 5 m/s without a container and up to 10 m/s using one. Returning to the issue of the possibility of making fires in green areas, it is worth noting that certain exceptions may be provided for forested areas in which places specially equipped for these purposes are provided. Gazebos, platforms, barbecues - there are still options for safely barbecuing in the green zone.

Another thing is that in this case additional safety requirements regarding frying containers and proper fire extinguishing must be met.

In the first case, you should use only intact containers without burnouts and through mechanical damage through which flammable materials can fall out. In the second, it is not allowed to leave a smoldering hearth unattended. The latter must either be filled with water or covered with sand/earth until the flame is completely extinguished. And only after that you can leave the place of rest.

It is allowed to halve the distance to buildings and forests if you make a fire in special containers made of non-combustible material. For example, in a barrel or smokehouse. For lovers of barbecue and everything else, the law provides one more clause. That's what it says. If you make a fire in “special fireproof containers” to cook food, then the distance to buildings is allowed to be reduced to 5 meters. You can clear the area of ​​dry grass and trees within a radius of 2 meters.

It is imperative to have primary fire extinguishing equipment with you. It is advisable to buy a fire extinguisher, but sand will also work. You must have your mobile phone with you. The most important thing is to be extremely careful.

During the entire burning process, until the fire is completely extinguished, the combustion source should be monitored.

Do not allow it to spread beyond your location. After you have finished burning the fire, you need to cover it with earth or fill it with water. Be sure to make sure that smoldering and burning have completely stopped.

According to the document, a fire can be lit on the site. But for an open fire it is necessary to arrange a special place:

If you light a fire in a metal (non-flammable) container, then all distances can be halved and not create a mineralized strip. But you need to have a metal sheet with which, if something happens, you can completely cover the container.
