Health certificate when applying for a job: main recommendations

Description of the document itself

Such certificates are issued in form No. 86. This is an official medical report that states how fit the subject is to perform work duties in a particular area.

Medical certificates are types of official documents that must contain:

Mandatory details of medical certificates

  • stamp in the shape of a triangle or circle from the medical institution at the employee’s place of residence
  • rectangular stamp
  • signatures of doctors in different specialties

For printing, sheets of one of the common formats are used - A5. For filling, not only the front side is used, but also the back side. Not only the physician of the medical institution, but also the chief physician put their signatures.

When filling out, you may only use a black or dark blue pen. The document has twelve columns. They are all required to be filled out, no exceptions. No omissions are allowed.

How much does certificate 086 cost?

To date, this procedure has not been regulated at the federal level, so institutions resolve fee issues on their own.

  1. In public clinics, the document is issued both for money and for free. Some government agencies do not charge a fee for issuing a certificate; in others, the document is paid, but does not exceed 2,500 rubles. This is due to the fact that doctors have long queues and it can take several days to complete a medical examination.
  2. Private clinics can charge up to 15,000 rubles for a service if a full examination is required. But here the procedure goes quickly, and the quality of service is at a high level.

There are companies that offer, for a small fee, to issue a certificate 086 without undergoing a medical examination. You should not cooperate with such companies, since their activities are illegal. The received certificate will be invalid.

For whom undergoing medical examinations is a duty?

For food industry workers

Initial medical examinations are necessary in order to understand how suitable the candidate is for the work assigned to him. Article 69 of the Labor Code of the Russian Federation describes the categories of workers for whom a certificate when hiring has become a mandatory requirement.

For example, this is relevant for those who work in difficult conditions or the transport industry. Medical examinations have become an obligation for employees of public catering organizations, the food industry and trade, in children's institutions, water supply facilities, medical and preventive organizations, and so on.

The main disadvantage of the document is that it does not contain precise indications of the future position and the work that will have to be performed. It is impossible to even describe the harmful production factors that will have to be encountered.

Therefore, the legislation allows the use of document forms developed by other organizations. Including higher-ups. Additional information may be included. And an appointment for more examinations.

How long is a medical certificate valid?

The validity period of the certificate is from 6 months to a year

This document retains legal force for at least six months. There is another medical certificate - in form 001-ГС\у. It remains valid for a whole year.

Sometimes human resources departments simply do not take into account exactly how long the certificate is valid. Until the document expires, the patient can undergo the disease, more than one operation in the surgical department. In this case, only cancellation of the certificate is possible, even if the validity period has not yet expired.

Human resources departments may require a re-examination if a certificate was issued to one organization and presented to the management of another. This is also one of the situations where the expiration date doesn't matter. After all, every company has its own requirements for employees.

Shelf life of the form

A medical certificate confirming that there are no contraindications for playing sports is valid for 6 months from the date of issue. The expiration date is indicated on the form.

The pool document is issued for a certain period depending on the age of the recipient. A certificate of no contraindications for children is valid from 3 months to 1 year, for adults - 3-6 months.

The permit to drive a vehicle or own a weapon is valid for 1 year. If a citizen is found to have mental illness or other medical abnormalities, a certificate of absence of medical contraindications for work will not be issued.

Information about the absence of contraindications for working with state secrets is valid for 1 year from the date of issue. After this time, the employee is required to go through all the doctors again and issue a new document. If the period has expired and the employee did not have time to update and confirm the information, he is suspended from work until he receives a new document. In a situation where an employee changes place of work, but the activity remains related to state secrets, there is no need to re-issue confirmation of the absence of contraindications. If the document has not expired, it is valid regardless of the place of work.

About referrals for a medical examination during employment

Article 213 of the Labor Code of the Russian Federation states that managers are obliged to organize a medical examination. It is the boss who not only issues the referral itself, but also pays the cost.

The referrals should contain more than just information about the company itself. But other information:

  • about harmful and dangerous conditions, if any
  • activity with her family
  • you can’t do without the name of the unit where you plan to send the candidate
    Features of the document
  • What kind of medical examination is undergone? They can be periodic or preliminary
  • name of the medical institution, description of address and code in accordance with OGRN
  • the employer provides a link to the company's ownership form along with a code from OKVED by type of activity

The referral is signed by representatives of employers. With mandatory indication of position and full name. Any referrals for medical examinations of employees are subject to registration at enterprises. Only referrals from employers will be accepted by clinic staff when organizing medical examinations.

Why do you need a medical certificate when applying for a job?

So, according to Art. 69 of the Labor Code of the Russian Federation, a medical certificate when applying for a job must be presented:

  • employed minors;
  • other citizens in the cases provided for by the Labor Code of the Russian Federation:
  1. persons whose work is associated with dangerous and harmful working conditions and those involved in heavy work, as well as those employed in the transport industry;
  2. employees of public catering organizations, trade and food industry, medical institutions, water supply facilities, children's institutions, as well as some other areas;
  • other citizens in cases established by other Federal Laws.

Additional filling requirements

The certificate must include even minor restrictions related to physical activity, if they exist. To obtain a document, you need to visit specialists in different fields:

  • therapist
  • neurologist
  • ophthalmologist
  • ENT
  • surgeon

Sometimes opinions from other doctors are required. Specific requirements are determined by the specifics of the activities of a particular enterprise.

Therapists are needed for more than just making medical opinions. They enter all the necessary data into the document and are responsible for its immediate execution. With the exception of diagnoses from doctors.

About employers' responsibility

Management must not violate the requirements for medical examinations, which are described in the Labor Legislation of the Russian Federation. It is the employer who is responsible if he concludes an Employment Agreement and the certificate is not provided. The weakest punishment is an administrative fine:

Penalties

  • For legal entities – 30-50 thousand rubles. In some situations, authorities suspend activities for several months.
  • Fines of 1-5 thousand rubles are imposed on individual entrepreneurs. Or their activities are suspended for a period of three months.
  • Officials pay 1-5 thousand rubles.

Activities may be suspended for three years or more if similar violations have already been noticed by the employer. At the same time, management has the right to dismiss those employees who refuse to undergo a medical examination. This is a direct violation of the conditions described in the employment contract.

Medical certificate upon hiring 086/у

Such employees are:

  • persons employed in the food industry, public catering, and trade;
  • persons carrying out work at water supply facilities;
  • persons working in children's and medical institutions.

The above persons are examined by doctors upon entering work and at intervals during work (periodically). Employees under the age of 21 undergo annual medical examinations. Examination of workers by certain doctors is necessary to confirm the compliance of the level of health with the intended work, as well as to prevent diseases that arise during the performance of work.

It should be noted that examinations by doctors and examinations by a psychiatrist are included in working hours and are paid for by the employer.

What you need to know about medical documents

The main thing is that organizations and medical institutions themselves use only documents approved by the authorized body. Only such certificates can be amended. This is especially important for record keeping.

In some especially severe cases, the certificates are accompanied by the conclusion of a special medical commission. Such a body is created in every medical institution, regardless of its organizational and legal form. Without this, it is impossible to improve the system on the basis of which medical care is provided.

Commissions are created by the head of the medical institution. It consists of a chairman along with one or two deputies, members of the commission and a secretary. Commissions can only be headed by employees with higher medical education. The secretary of the organization determines the employee who can perform his functions in the commission.

The decision of the commission is drawn up only in the form of a protocol, separately from the certificate. After which the information is entered into the primary medical documents. The commission holds meetings, which can be scheduled or unscheduled.

The head of the medical institution is responsible for the work of the commission and for everything related to its activities.

The commission’s conclusion is on the certificates if it is really difficult to determine a person’s suitability for performing a particular job. Uniform forms of referrals from employers and certificates themselves have not yet been established at the legislative level. The main thing is to pay attention to whether the document is filled out correctly. Doctors also write their conclusions on the back of the certificate; they must also be read carefully.
