Hiring: required documents

To register a new employee, you need to receive a set of necessary documents from him. They are listed in Article 65 of the Labor Code of the Russian Federation. As a general rule, you need:

  • passport;
  • employment history;
  • pension insurance certificate (SNILS). However, since April 2020, this document has been removed from the list of mandatory ones.

However, the Labor Code says nothing about the need to submit an application for a job. Accordingly, it is not necessary to submit it.

The fact is that the basis for hiring is an employment contract. It is he who consolidates the relationship between employee and employer. It is also considered the basis for issuing an order to enroll a new employee (Article 56 and Part 1 of Article 68 of the Labor Code of the Russian Federation).

Complete list of documents for applying for a job

When applying for a job, a future employee must present:

  • passport or other document that proves identity. For example, a child employee who has not reached 14 years of age can show a birth certificate, and a citizen permanently residing abroad has the right to present a foreign passport;
  • employment history. Only part-time workers or those who are getting a job for the first time are not required to provide it; you must be the last to issue a work book yourself and make the first entries in it;
  • a document that confirms registration in the individual personalized accounting system. This can be either a paper or electronic document. If it is not there, then get a document for the employee;
  • military registration documents. For those liable for military service - a military ID card or a temporary certificate instead, and for conscripts - a registration certificate (clause 18 of the regulations, approved by Government Decree No. 719 of November 27, 2006);
  • document confirming education, qualifications or special knowledge. It is mandatory if such requirements are imposed on the specialist holding the position. For example, a pharmacist needs a valid specialist certificate to work;
  • certificate of presence or absence of criminal record or criminal prosecution. This document is mandatory only when convicts and suspects of crimes cannot be allowed to work. And this is directly established by law. For example, such a condition is established for teachers (Article 331 of the Labor Code).

Sample: job application from a minor

For this category of employees, a number of features are established by law (Article 63 of the Labor Code of the Russian Federation).

Minors over the age of 14 write a document about their intention to enter into an employment relationship on their own; the text of the document is similar to the text written by adult workers.

If employment is arranged with a person under the age of 14, the intention to enter into an employment relationship is written by one of his parents (guardians).

The text is approximately as follows:

“I ask you to draw up an employment contract with my son (daughter) (last name, first name and patronymic of the child, date of birth) to perform (work indicated) in (position or profession indicated) for a monetary remuneration (amount indicated) from such and such a date.

I am familiar with the provisions of the internal labor regulations of the organization, my child’s job responsibilities and working conditions.

I give my consent to the employment of my child (last name, first name and patronymic of the child, date of birth) in (indicate the name of the organization) to perform light labor that does not interfere with education.

Number and signature"

For minors under the age of 15 years, the consent of one of the parents (guardian) and permission from the guardianship and trusteeship authority regarding the placement must be attached. The parent or guardian may also express consent in the application itself.

IMPORTANT! When hiring a minor, you must remember that the working time for persons aged 16 to 18 years, receiving general or secondary vocational education and combining study with work during the academic year, should be no more than 17.5 hours per week. Workers under 16 years of age will not be able to work more than 12 hours a week.

Why do they require an application for admission?

Why write a job application if it is not required by law? The answer to this question is simple. It’s just more convenient with such a statement! After all, you can make official marks on the application: visas of the manager and immediate superior are affixed, as well as marks from the HR department about execution. If it is convenient to work with the application, then the HR department asks for an application from new employees. Writing such a statement will not leave any difficulty.

Is it necessary to require an application?

No, not necessarily.

In any case, the basis for hiring will be an employment contract. It is he who documents the agreement between a specific employee and the organization. It also serves as the basis for the manager’s order to add a new employee to the staff. This follows from Article 56 and Part 1 of Article 68 of the Labor Code of the Russian Federation.

But it’s more convenient with a statement. They often make official notes on it: they put down the resolution of the head of the organization, the visa of the immediate superior, and a mark of execution. Therefore, if for these purposes you ask an employee to write a statement, there is nothing illegal about it. Then file such a statement in the employee’s personal file.

Is this document necessary?

The documents that are required during registration are listed in Article 65 of the Labor Code of the Russian Federation. A job application is not included in this exhaustive list.

Required papers include:

  • passport or other identification document;
  • work record (except for cases of part-time employment or first employment);
  • NILS;
  • for those liable for military service - a military registration document;

For certain positions for which persons with a criminal record or administrative penalties for drug use are not allowed, certificates of no criminal record or such administrative penalties will also be required. When applying for a job for the first time, the employer himself will issue a SNILS and a work book for the new employee.

Why then do you almost always submit an application when applying for a job?

Simply because it is convenient when maintaining personnel document flow. On this paper, notes are made by an employee of the HR department, for example, that the documents from the applicant have been accepted, and the resolution of the head of the organization is also put down - to accept the position or refuse.

This is an interim agreement between the manager and the future employee, which may stipulate some of the nuances of the employment relationship being formalized.

Such, for example, as:

  • the date from which the person begins his duties;
  • the future employee does not have a work book (which means the organization needs to get one);
  • nature of the work - part-time or part-time employment, etc.

This paper can be drawn up or not, in any case, the basic conditions of the employment relationship are prescribed in the employment contract - position, duties and rights, salary, work and rest hours and other important points. It is on the basis of the employment contract, according to Article 68 of the Labor Code of the Russian Federation, that an employment order will be issued.

Important points when writing a job application

Federal laws define cases when an application for employment must be submitted: when applying for employment in the civil service (clause 2 of Article 16 of the Federal Law of April 27, 2004 N 79-FZ); for municipal service (clause 3 of Article 16 of the Federal Law of March 2, 2007 N 25-FZ)

In other cases, the employee may refuse to write such a paper, since this is his right, not his obligation. However, it is difficult to find grounds for such a refusal, because signing the document does not take much time. Many companies have created templates where all you have to do is enter information, date and sign.

Structurally the paper looks like this:

  • header in the upper right corner:
  • to whom (name of the manager’s position, name of the organization, full name of the manager),
  • from whom (full name of the employee, sometimes - address). the word “Statement” in the center of the page; main text requesting acceptance for the position;

You can write the text entirely by hand, or substitute the necessary information into the template, or type it on a computer, print it out and sign it yourself - any option is allowed. When applying for a job with an individual entrepreneur, and not with an organization, the type of document changes slightly.

In the upper right corner, instead of the inscription “General Director (Director)” they write “Individual Entrepreneur”.

When completing the transfer procedure, indicate from which organization and from which position the transfer is taking place (this information will be required by the personnel employee to make an entry in the work book). When applying for part-time employment, indicate its type - internal or external.

Application form for admission 2020

There is no universal form or template for a job application. The application is written exclusively in free form. That is, there is simply no “correct” statement of acceptance. Moreover, there is no example application for 2020 admission, since the form and structure of the application is in no way tied to any date or year.

The structure of the statement is, in principle, always universal:

  • in the upper right part: name of the employer, full name of the manager and from whom the application is being submitted (full name);
  • in the middle of the sheet is the word “Statement”.
  • the main part is a request for employment for a certain position;
  • at the end - date and signature.

Writing rules

There are no legal requirements for a job application example. Commercial organizations have the right to develop the form themselves or invite new employees to write it in any form. The main thing is that this document contains information:

  • name of the employing organization;
  • last name, first name, patronymic of the future employee;
  • the name of the position for which he is employed;
  • the date from which he plans to begin his duties;
  • date of writing and personal signature.

Address the appeal to the head of the organization or institution. If desired, the job application form contains other information; this is not prohibited. For example, information that the candidate for employment is familiar with the requirements for labor regulations and undertakes to comply with them.

IMPORTANT!

For state and municipal institutions there is an established sample application for employment. The form is approved as part of the instructions for office work by a departmental order.

The completed form is endorsed by the head of the organization or institution to whom it was addressed. There are no requirements for a visa, so each institution follows its own instructions on document flow. The main thing is that the visa must contain the date and personal signature of the manager. And the text itself is allowed to be entered by facsimile.

Usually the document does not contain anything extra, except a request to be accepted for the position. All conditions and responsibilities are specified in the employment contract. It is not prohibited to specify the position, salary and familiarization with the work schedule, but this information is duplicated in the employment contract, so the application is succinct.

In the state or municipal service, the approved form looks different. As an example, we provide a form for admission to the civil service in statistical bodies. It was approved by Rosstat Order No. 456 dated June 30, 2014 (as amended on May 23, 2017). Similar forms are provided for other departments.

Application for part-time employment

When working part-time, the employee, in his free time from his main job, performs other work under a separate employment contract (Part 1 of Article 282 of the Labor Code of the Russian Federation). Part-time work can be done both at the place of your main job (internal part-time job) and in other organizations (external part-time job) (Part 3 of Article 282 of the Labor Code of the Russian Federation).

An application for a part-time job is, in principle, exactly the same. You just need to note in it that you are getting a part-time job. Specify the type of part-time job and this will be quite enough.

Legal regulation

The employment relationship with the employer begins with the signing of an employment contract and in most cases the application is not mandatory. But there are regulations according to which it will still be required when applying for a job. This applies to persons applying for public or municipal service positions. The requirement is regulated by the following documents:

  • Federal Law 79-FZ “On Civil Service” (Article 26);
  • Federal Law 25-FZ “On Municipal Service” (Article 16).

The Labor Code, when listing the required documents for those who are employed in ordinary organizations, does not mention an application. It turns out that their personnel departments can only ask to present it, but not demand it.

When should you write a statement?

The Labor Code of the Russian Federation does not contain specific provisions on when and how a person at the registration stage has the right to write an application for employment. Often this document is transferred along with other mandatory papers to the HR department of the enterprise.

A potential employee has the right to either print out an existing form on the Internet or write his application by hand.

This procedure can be done at home, but it’s better to do it directly in the HR department or in the employer’s office, where you can clarify the items entered on paper, find out about your position, salary, deadlines for signing and clauses of the contract. It is worth considering that the additional conditions specified in the application must be duplicated in the employment contract.

Where should the application be kept?

It goes through the process of registration in a special journal of incoming letters, and then is filed along with the rest of the documents submitted to the personnel department, and after that the manager must put a mark on it. Such paper is kept in the archive for 75 years from the date of filing. A written resolution on the application is the final point in applying for a job to an employee.

Important! An application for employment with a manager’s order to register an employee is considered an additional element of guaranteeing rights and obligations on a bilateral basis.
