Which employer needs a health center

A medical health center is created as a structural unit of an organization, which, along with the main (statutory) one, is engaged in medical activities.
Premises requirements:
A special room is allocated to accommodate the health center. The requirements for it are established in SP 44.13330.2011 “Administrative and domestic buildings” (approved by order of the Ministry of Regional Development of Russia dated December 27, 2010 No. 782).
The composition and area of the premises of the medical health center are determined in Table 5 of SP 44.13330.2011.
The premises in which medical activities will be carried out must also comply with SanPiN 2.1.3.2630-10 “Sanitary and epidemiological requirements for organizations carrying out medical activities” (approved by Resolution of the Chief State Sanitary Doctor of Russia dated May 18, 2010 No. 58).

Licensing of medical activities of a health center:
To conduct any medical activity, you must have the appropriate license. The health center is no exception. Without a license, only first aid can be provided at a health center. The list of works and services that make up medical activities and the procedure for licensing them is determined by Decree of the Government of the Russian Federation of April 16, 2012 No. 291.
Obtaining a license for medical activities for most organizations is a very troublesome and expensive matter; as a rule, this path is taken by enterprises with a large number of employees (over 300 people) engaged in hazardous working conditions, or by large transport companies.
However, recently, many organizations are choosing to outsource medical services to a licensed medical organization - under a contract.
Indeed, obtaining a license, and especially conducting medical activities, is a troublesome matter and requires special knowledge, is associated with checks, risks, and a shortage of qualified medical personnel. That is why more and more medical institutions are appearing on the market, offering services for organizing the work of a first-aid post or health center on the territory of an enterprise.
IMPORTANT:
- Health centers are required to organize not all enterprises, but only those for which this requirement is established by industry or intersectoral regulatory legal acts.
- The health center performs a wide range of functions, including providing primary health care before the arrival of an emergency medical team, participating in monitoring the timely completion of preliminary and periodic medical examinations by employees, and others.
- The size of the health center premises depends on their type. It does not have to contain all the premises recommended by the order of the Ministry of Health.
- If a license for medical activities has not been obtained, only first aid can be provided at a health center. Or you need to enter into an agreement with a medical organization that will provide medical care to your employees.

Who is required by law to organize a first aid station?
A number of entrepreneurs consider themselves responsible for the health of their employees; some believe that this issue should be of concern to the employees themselves. Meanwhile, the legislation of the Russian Federation mandatory declares this form of health protection in certain organizations:
- The Labor Code of the Russian Federation guarantees that the employer provides employed citizens with:
- absence of danger in working conditions (Part 1 of Article 212 of the Labor Code of the Russian Federation);
- service for employees in accordance with the adopted regulations for sanitary, preventive and health measures (Part 2 of Article 212 of the Labor Code of the Russian Federation).
- Federal Law No. 323-FZ of November 21, 2011 “On the fundamentals of protecting the health of citizens in the Russian Federation” states that such a clause should be an integral part of the health protection system for employees of medium-sized and large companies.
- SNiP 2.09.04-87 “Administrative and domestic buildings” in paragraph 5.27 specifies at which enterprises it is mandatory to place such a point:
- with an average number of staff from 50 to 300 - a first-aid post;
- with more than 300 employees - a paramedic (medical) station.
NOTE! A number of organizations, even those that do not reach the declared number, are required to organize permanent access for employees to medical services due to their industry specifics. For example, transport workers receive a medical clearance before going on a trip and are examined after the end of their shift (Federal Law of December 10, 1995 No. 196-FZ “On Road Safety”).
The law prescribes the organization of their own medical (paramedic-medical) points for enterprises in the following industries :
- oil and gas production in the Far North and equivalent territories, as well as during offshore drilling;
- security services (militarized);
- food production;
- catering services (stationary and in transport);
- transport enterprises;
- a number of services (educational, some household services, etc.).
Can other entrepreneurs organize a medical center?
The law stipulates the absolute need for health centers for large and medium-sized companies. Other entrepreneurs can take care of the health of their employees on their own initiative by hiring medical workers and organizing a workplace for them. It should be remembered that this is impossible without obtaining two important permits:
- licenses for medical activities;
- sanitary and epidemiological conclusion.
IMPORTANT! If you open a medical center without a license, which is discovered during an inspection, the managers will receive a serious fine, and if something serious happens, then a criminal charge.
