Employment contract for micro-enterprises: regulatory framework, creation algorithm and structure

Insured persons are informed about the status of their individual personal account using the SZI-6 form.

We would like to remind you that the composition of information on the state of the ILS in the SZI-6 form was approved by Resolution of the Pension Fund Board of June 15, 2016 No. 491p.

You can obtain information on the SZI-6 form as follows:

- by contacting the territorial office of the Pension Fund or MFC in person. In this case, you must have an identity document and SNILS with you.

- using the “Personal Account of the Insured Person” posted on the official website of the Pension Fund of Russia

- via postal service. In this case, the applicant sends a corresponding application, to which is attached a copy of the applicant’s identity document and SNILS.

The Pension Fund of the Russian Federation keeps records of the pension rights of citizens to the ILS, which, among other things, displays information about the periods of work experience before registration in the individual (personalized) accounting system. This information for the specified periods was submitted to the Pension Fund by employers in 2003-2004. Information about periods of labor activity before registration in the OPS system was included in the ILS based on the information available in the work book.

If you think that your personal information system does not contain information about the periods of work before registration in the persuet accounting system, you can come to the Pension Fund of the Russian Federation with a passport, SNILS, as well as documents confirming the periods of work, the capital branch of the fund reports.

In addition, the ILS displays personal accounting information (about salary, amounts of insurance contributions and length of service) after registration in the OPS system. This information has been submitted by policyholders to the Pension Fund of the Russian Federation, starting from 1997, only for persons registered in the compulsory insurance system.

Information is included in the ILS only when the policyholder calculates and pays contributions to compulsory health insurance; periods for which insurance premiums are not paid are not included in the length of service and are not entered into personal accounts. Responsibility for providing reliable information rests with the policyholder in accordance with the provisions of Federal Law No. 27-FZ dated April 1, 1996.

According to Art. 18 of this law, disputes between policyholders and insured persons on issues of transfer accounting are resolved by the court.

Accounting and reporting for ETC in “1C: Salary and Personnel Management 8” (rev. 3)

“1C: Salary and Personnel Management 8” edition 3 supports the interaction of the employer with the Pension Fund of the Russian Federation and with employees in order to record information about the employee’s work activity in electronic form (ETK).

In the program, reports SZV-TD and STD-R are generated in accordance with the current legislation of the Russian Federation.

Organization of labor activity records

To automatically fill out information about the work activities of employees using the STD-R and SZV-TD forms, a new accounting of information about the work activities of employees has been implemented in the 1C: Salary and Personnel Management 8 program, edition 3.

In recording the labor activity of employees, unified data is collected on personnel events that were previously included in the work book. Accounting for labor activity in the program is aimed at:

  • to ensure automatic filling and multiple refilling (if necessary) of SZV-TD and STD-R documents;
  • automated filling of documents about event cancellations;
  • providing the opportunity to register “historical” data without re-posting old documents;
  • ensuring the possibility of recording events about labor activity that are not recorded in personnel documents (for example, renaming an organization).

To reflect personnel documents Hiring, Personnel transfer, Dismissal, the Reflect in work book flag is provided in the accounting of labor activity (Fig. 2).

Rice. 2. Reflection of personnel documents in the accounting of labor activities

When the Reflect in work book flag is selected, the Labor function and Document name fields are available. The Labor function field is filled in for a position or staffing position, if provided for in the organization. In the Name of document to be filled out field in the report, you can save the exact name of the document (for example, “Order”, “Notification”).

The set flag Reflect in the work book ensures registration of work activities in accounting. Thus, a document about the most recent event (Hiring or Personnel transfer) that occurred with an employee before 01/01/2020, marked with this flag, will be registered in the labor activity record and will automatically be reflected in the SZV-TD report.

The name of the unit indicated in the SZV-TD, STD-R must exactly correspond to the text reflected in the work book. Therefore, the Full Name field has been added to the Division directory, which is used to generate records of labor activity.

Where in “1C: Salaries and Personnel Management 8” (rev. 3) indicate the full name of the department to correctly fill out the report to the Pension Fund of the Russian Federation in the SZV-TD form

Document “Registration of labor activity”

For detailed registration of changes in the parameters of personnel events and “historical records”, the document Registration of Labor Activities has been added to the program in the Electronic Labor Books journal. This document records all personnel data, with the exception of temporary transfers, as of 01/01/2020 and is supplemented by clicking the Data until 2020 button (Fig. 3) with information about the supporting documents, if they are in the program information base.

Rice. 3. Addition of "historical records"

The results of automatic and manual addition are used along with data on labor activity recorded directly in personnel documents. The personnel event “Renaming the organization” is registered with the same document using the Renaming button (Fig. 4).

Rice. 4. Renaming the organization

As a result of keeping records of labor activity, initial and canceling SZV-TD reports, as well as STD-R forms, are generated automatically in the program.

Features of auto-completion of the SZV-TD report

The document Information on the work activities of employees, SZV-TD, is generated in the Personnel - Electronic work books menu using the Create button, and is intended for sending as a report to the Pension Fund (Fig. 5).

Rice. 5. Report to the Pension Fund of Russia in the form SZV-TD

When autofilling the SZV-TD document, it became possible to manage lines for renaming an organization and other personnel events. If necessary, the document can be refilled multiple times.

How to register correctly?

There are certain conditions, the fulfillment of which allows you to correctly draw up a TD.

Documentation

The following documents are required:

  • Passport.
  • Work record book (except for the case of part-time work or the initial drawing up of the TD).
  • SNILS.
  • TIN.
  • Military ID (for the category of persons liable for military service).
  • Documents indicating the acquisition of certain skills that are taken into account for employment.

It happens that due to the future employee’s ignorance of the required documents, employers may request extra certificates and other papers that are not specified in the legislation: for example, information about marital status, religion, nationality.

In what form is it approved?

What are the general rules for concluding contracts? For how long and approximately in what form is an employment contract concluded and when is it considered concluded, how to fill it out and formalize it correctly, what is presented? What is the conclusion procedure? Federal Law N90-FZ of June 30, 2006 states that TD is drawn up exclusively in writing. 2 sample contracts are drawn up: 1 is given to the employee, and the other is kept by the employer. The document held by the employer is confirmed by the signature of the future employee.

Deadlines

Article 58 of the Labor Code of the Russian Federation states that there are 2 forms of concluding a document, or employment contract:

  1. Urgent TD: issued for a duration of no more than 5 years.
  2. An employment contract concluded for an indefinite period.

If the TD is not in writing?

In what cases is an employment contract considered not concluded? If the document is not drawn up in writing, it may be considered concluded when the employee begins work on behalf of the employer or representative of the organization. Subsequently, the TD still needs to be concluded in handwritten form.

Who endorses the document with the employee?

On the part of the company, the employer leaves his signature. If he is not at his workplace, the document may be signed by an employee authorized by the manager.

It does not matter in principle who should sign first. The main thing is that both parties leave it in the TD. Most often, it is the employee who, when concluding a contract, presents the documents and is the first to sign, and the HR department sends a copy to the employer. The company seal in the TD is not provided for by the Labor Code of the Russian Federation , so its absence cannot legally make this document invalid.
