Mechanism for determining the minimum pension amount

It must be noted that social security legislation distinguishes two categories of old-age pensioners:

  1. Continuing to work.
  2. Not working.

This section will focus on the second group; the first will be discussed in a separate chapter below.

Although the legislation does not contain such a term as a minimum pension, in the Leningrad region in 2021 (currently) it is 8,846 rubles. (excluding indexation). This is the indicator established for pensioners in the entire Russian Federation by Law No. 459-FZ dated November 29, 2018, and confirmed by the Leningrad Region Law No. 130-oz dated December 20, 2018.

In practice, it is quite simple to determine what a minimum pension means - this is the lowest threshold of payments from the state that a citizen who has retired due to age receives.

If the earned pension calculated by the Pension Fund is below the subsistence level (ML), then the citizen receives an additional payment from the budget up to the subsistence level.

Pension coverage for residents of St. Petersburg and the Leningrad region in 2020

Providing for disabled citizens in the Russian Federation is carried out in accordance with federal legislation.
Regions are given the right to develop and implement their own measures to support residents. Thus, pensions in St. Petersburg and the Leningrad region are increasing in 2021 due to additional payments of various kinds. Recipients of certain categories are also provided with benefits and preferences.

Minimum and average pension rates in St. Petersburg and the Leningrad region

The amount of accruals for pensioners depends on the type of pension, as well as the applicant’s length of service and the number of pension points. In addition, the amount is affected by the preferential grounds on which additional support is provided.

Federal legislation establishes the following types of pensions:

In 2021, the following indicators were recorded in the Leningrad region:

  • the minimum pension for non-working pensioners is 9,160.0 rubles;
  • average - 15,616.0 rub.

It should be understood that statistical data does not reflect the situation of a particular pensioner. After all, the law provides for a serious increase in the maintenance of people who fall under preferential criteria. For example, disabled children of group I are allocated a social allowance in the amount of 15,434 rubles, single disabled children of group II - 6,849 rubles, and participants of the Great Patriotic War are increased to 32,500.0 rubles.

Hint: according to federal law, a non-working pensioner cannot receive less than the minimum subsistence level (ML) for the corresponding group of the population.

What determines the size of the pension?

The standard of living of the population in the regions of the Russian Federation is different. It is usually characterized by the cost of living indicator. It shows the amount of money needed by a certain group of citizens for normal life.

This parameter is used as follows:

  • accruals for pensioners whose incomes are low can be increased to PM;
  • To receive a bonus, the applicant's initiative (application) is required;
  • calculations take into account other measures of social support;
  • The rule applies only to non-working persons.

Hint: the amount of social benefits for old age and disability is influenced by another indicator -. It is set at 12,000 rubles in the region. (in this case, the tariff rate of a worker (employee) of the 1st category, salary (official salary), the employee’s wage rate should not be less than 9,555 rubles) with an average salary of 41,300.0 rubles.

Additional measures to support pensioners

Local authorities have adopted a social program that provides for additional payments to various groups of beneficiaries. The indicators are shown in the table:

Regional benefits

For some groups of beneficiaries, preferences are provided, paid from the local treasury. They are:

  1. provided:
      90% discount on tickets for suburban railway transport during the “dacha” period (from April 27 to October 31);
  2. monthly monetary compensation for part of the cost of housing and utilities;
  3. free production and repair of dentures;
  4. preferential travel on road transport on adjacent interregional, intermunicipal and municipal regular transport routes;
  5. free provision of medicines.
  6. All pensioners without exception are entitled to:
      exemption from transport tax and property tax on one property;
  • preferential use of public transport;
  • monthly monetary compensation for the cost of paying a contribution for major repairs;
  • a one-time social payment for partial reimbursement of expenses for gasification of residential premises;
  • Disabled persons are provided with:
      social taxi services;
  • monthly monetary compensation for the cost of paying a contribution for major repairs;
  • a one-time social payment for partial reimbursement of expenses for gasification of residential premises;
  • exemption from transport tax and property tax on one property;
  • benefits for transport services;
  • free prescriptions;
  • monthly payment to certain categories of disabled people;
  • compensation of part of the costs for the independent acquisition of additional technical means of rehabilitation.
  • In addition, the Social Code of the Leningrad Region stipulates the right of married couples of pensioners to a lump sum payment on the occasion of the anniversary of their marriage. It is provided to citizens of the Russian Federation who permanently reside in the Leningrad Region and have been married for 50, 60, 70 and 75 years.

    Conditions for assigning pension benefits

    Budget funds are provided to citizens according to the criteria laid down in the legislation. They are:

    1. By old age:

    a. assigned when meeting the criteria for length of service and points:

      • after 60 years for women;
    1. after 65 years for men;
    2. at a different age in the presence of preferential grounds;
    3. work experience of at least 15 years (this indicator will be relevant by 2024, in 2021 the minimum experience is 10 years, within 5 years it will increase by 1 year annually);
    4. 30 individual pension coefficients (in 2021, the minimum amount of pension points was 16.2, the required number will increase annually and will reach 30 by 2024)

    b. :

      • women who have celebrated their 65th birthday;
    1. men over 70 years of age;
    2. foreign citizens and stateless persons permanently residing in the territory of the Russian Federation for at least 15 years and who have reached the specified age;
    • state : assigned to citizens affected by radiation or man-made disasters;
    • The state pension for long service is assigned to federal civil servants, military personnel, astronauts and flight test personnel.

    2. For disability:

    • insurance in the presence of disability and at least one day of insurance experience;
    • social in the presence of disability and lack of insurance coverage;
    • state is assigned to military personnel, citizens who suffered as a result of radiation or man-made disasters, participants in the Great Patriotic War, citizens awarded the “Resident of Siege Leningrad” badge, and cosmonauts;

    3. In the event of the loss of a breadwinner, a pension is entitled to:

    • insurance is assigned upon the death of the breadwinner, who was dependent on the applicant for pension provision. The main condition is that the deceased breadwinner has an insurance period (at least one day);
    • social is assigned to children under the age of 18, as well as over this age, studying full-time in educational organizations, until they complete such training, but no longer than until they reach the age of 23, who have lost one or both parents, and children of a deceased single person mothers;

    4. State pension is assigned to disabled family members of fallen (deceased) military personnel; citizens injured as a result of radiation or man-made disasters, astronauts.

    List of documents

    To assign pension benefits, you need to contact the territorial Pension Fund office. In this case, the right must be proven documented. The Pension Fund will require the following basic documents:

    • passport and SNILS;
    • work record book and contracts with employers for periods not included in the main document;
    • A certificate of earnings for 60 consecutive months may be required;
    • additionally, to increase accruals: information about the presence of dependents and their identity documents;
    • children's birth certificates (add points);
    • certificate of service in the armed forces or other paramilitary forces;
    • preferential certificate;
  • additionally to prove eligibility:
      certificate of disability assignment;
  • death certificate of the breadwinner and confirmation of family ties.
  • Hint: documents can be brought to the department a month before eligibility. They will be accepted for consideration, but pension benefits will be assigned from the date the grounds arise.

    Controversial issues

    There is a legal provision that determines that the pension cannot be lower than the subsistence level established by the Government of a particular region. This principle is set out in Art. 12.1 Federal Law-178 “On state social assistance”. But the article does not disclose the PM indicator for what period should be taken into account.

    For the second quarter of 2021, Decree of the Government of the Leningrad Region No. 382 dated August 23, 2019 established the living wage for a pensioner in the amount of 9,160 rubles. The figure for the 3rd quarter of the year is expected only in November. But this level of PM is not used to determine the size of pensions in the current year.

    A separate act is often adopted for this purpose. Thus, for 2021, the pension PM was established in the amount of 8,726 rubles by regional law No. 91-oz “On establishing the cost of living for a pensioner in the Leningrad region in order to establish a social supplement to pensions for 2021” (adopted by the Legislative Assembly of the Leningrad Region on December 25, 2017). However, for 2021, the authorities of the Leningrad region did not approve a similar act.

    Indexation rules from 2021

    It must be taken into account that in determining the size of the pension, in addition to laws, by-laws are important, as well as executive acts of the President of the Russian Federation.

    Pensions in the Leningrad region from January 1, 2021 for non-working pensioners, as well as for all citizens of the corresponding age, were indexed by 7.05%. This happened by decision of the Government of the Russian Federation on the basis of Federal Law-350 “On amendments to certain legislative acts of the Russian Federation on the appointment and payment of pensions,” which established the following:

    • the rule of Federal Law No. 400 “On Insurance Pensions” on increasing the content annually by the inflation rate established by Rosstat has been suspended from February 1 of each year;
    • a rule has been introduced according to which indexation is carried out from January 1 of each year (it is valid until 2024).

    Pensions were adjusted on an undeclared basis throughout Russia, but a dispute arose regarding the inclusion of additional payments up to the subsistence level. V. Putin separately explained in his message to the Federal Assembly that first an additional payment is made, and then indexation.

    The algorithm for calculating the social supplement to pension looks like this:

    1. First, the amount of social supplement to the pension is calculated based on the size of the pension and the monthly cash payment (MCV) without taking into account their indexation.
    2. Next, the resulting additional payment is added to the pension and the daily allowance, taking into account the indexation of the current year.

    Living wage in St. Petersburg from January 1, 2021

    • Established by government agencies;
    • Its value will be calculated as a certain percentage of the federal one;
    • This year, its value cannot be lower than its regional value for the second quarter of last year;
    • The implementation of this innovation should be practically carried out in the period until 2025.

    Minimum pension from January 1, 2021

    • And if a pensioner receives a pension less than the minimum established in the region, he is assigned a social supplement.
    • The size of this payment is equal to the difference between the pensioner’s monthly income and the PMS established in the region.

    Social subsidies are a measure of state support for low-income pensioners. The goal of the authorities is to prevent the income of older people from being lower than the level of normal human existence in constantly changing living conditions.

    The government assures the effectiveness of this calculation method. For implementation, similar experiences of countries with stable social policies were analyzed. At the same time, it is noted that the transition to this accrual system will take a long period. The Ministry of Labor plans to implement it by the end of 2025. This is due to the growth of subsidies for the increase in the amount of more than 120 billion and complex technical and organizational processes.

    What is considered the minimum pension in Russia?

    Pension for working pensioners

    The minimum pension in the Leningrad region in 2021 for pensioners who continue to work has not been determined, however, as in other regions. The amount of support for such pensioners is in no way tied to the level of pension in the region and is determined by Pension Fund employees on the basis of legislation, based on insurance points, etc.

    This pension must also be adjusted. But, in accordance with Federal Law No. 385 of December 29, 2015, the rule on annual indexation was suspended. This rule was introduced in 2021 and has not yet been canceled.

    The size of pensions for working elderly citizens is also being revised, but subject to the deduction of insurance contributions by their employers. By decision of the Pension Fund, such persons received a pension increase in August, but not in the same amount (the maximum was 261 rubles 72 kopecks). Indexation took place throughout the country without application.

    Minimum old-age pension in the Leningrad region for 2020

    Strictly speaking, Russian legislation does not contain such a concept as a minimum guaranteed pension. However, in practice, a minimum old-age pension still exists, and it is determined indirectly through other provisions of the law.

    When agitating Russians for raising the retirement age, officials very often said that the pensions of current pensioners, thanks to this measure, would increase significantly in 2021. In general, pensioners will receive 12 thousand rubles more per year, which means the increase per month will immediately amount to a thousand rubles.
