The legislative framework
Certification of heads of educational institutions is the responsibility of all candidates for positions in accordance with Part 4 of Art.
51 of the Law on Education dated December 29, 2012 No. 273-FZ. It involves testing knowledge, skills, abilities and assessing the qualifications of the future leader. The school director (university rector, etc.) must have a higher education and meet all the requirements listed in qualification reference books and (or) professional standards. Already existing heads of educational institutions, if they are subordinate to the Ministry of Education and Science, undergo qualification verification at least once during the period of validity of the employment contract. This is determined by Order of the Ministry of Education and Science of Russia dated March 16, 2015 No. 240 (as amended on October 27, 2017).
There is also such a thing as assessment for suitability for the position held. It occurs within a year after the director (rector, etc.) takes office.
Order of conduct
To conduct certification of the heads of municipal-type organizations, it is necessary for all employees subject to it to provide a performance reference no later than 2 weeks in advance. It is prepared by the industry committee of the city administration. This document must contain a comprehensive assessment of the individual, his strengths and weaknesses, individual abilities, the organization's performance for the previous year and the certification sheet itself. If available, the results of the previous inspection are also provided.
The employee must be familiarized with his characteristics no later than 2 weeks before the upcoming certification.
The created commission first listens to the employee being certified, then asks questions that relate to his position. The commission members also review the materials provided to them. The results of their activities may have the following assessments:
- The specialist corresponds to his position.
- The employee corresponds to his position, but subject to the implementation of the recommendations provided by the commission, as well as the improvement of his work with re-take the certification after 1 year.
- The person being certified is not suitable for his position.
In addition, the said commission has the authority to make recommendations on changing wages, encouraging, increasing or canceling salary bonuses, including a person in the reserve for promotion or removal from position.
The commission also makes proposals to improve the skills of employees, improve work activity, and indicates the motives on the basis of which recommendations are made. The assessment of the activities of the leaders of a municipal organization and recommendations are adopted by the members of the commission through an open vote, which is carried out in the absence of the person being certified.
The rules for the certification of managers and specialists state that the procedure will be carried out in the presence of at least 2/3 of the number of commission members who were previously approved by the relevant resolution. Based on the voting results, the person being certified can be recognized as appropriate for the position and vice versa. In case of equality of votes, the decision is made in favor of the person being certified.
An attestation sheet is a document where the results of the inspection, assessment and recommendations for the specialist are recorded. It is drawn up in a single copy and signed by all members of the commission. The characteristics and certification sheet are stored in the employee’s personal file. If labor disputes arise that are related to the past certification, they can be considered in accordance with this current legislation.
Procedure and purpose of certification
Despite the fact that the obligation of heads of educational institutions to undergo inspection is established by Law No. 273-FZ at the federal level, the procedure for conducting it is not fixed by this law.
The general procedure is established by orders of specific ministries and departments. There are only 24 such legal acts.
So, the order, timing and list of tests that the candidate must pass are determined directly by the founder of the educational institution. This could be the government, the Ministry of Education and Science, the Ministry of Culture and so on. At the level of the constituent entities of the Federation, separate orders are also issued. For example, the Order of the Moscow Department of Education. Each department issues its own regulatory act, which sets out all stages of the audit.
The management of educational institutions is certified for specific purposes:
- increase the efficiency of selection of management personnel;
- assess the candidate’s knowledge during admission;
- evaluate the knowledge of the existing director (rector, etc.) and his suitability for the position;
- stimulate professional growth.
The assessment consists of two stages: review of materials and interview. Let's consider the procedure for testing knowledge:
- A certification commission is created, the composition of which is approved by order of the ministry.
- A list of candidates for the position or a list of current heads is being prepared.
- The necessary documents and materials are provided to the commission within the established time frame.
- The current or future director (rector, etc.) is notified 7 days before the event by mail or telephone.
Failure to attend a commission meeting without a valid reason will result in disciplinary liability (for employed persons). In this case, the event is postponed to another date.
How to obtain certification for managers and engineers in labor protection
According to existing standards, certification (or certificate) can be obtained either at home or at a training center (there is a third alternative method).
Now in more detail:
- 1. In your organization. For these purposes, an internal certification commission should be created. Three specialists are trained, an order and a training program are issued, and you can begin. The disadvantages of this method are that it is only suitable for large companies (50 people and above). For small businesses, the second design option is suitable.
- 2. Managers must be sent to a specialized educational institution that is accredited for this type of activity (this is exactly what we cooperate with). A month of training. The program includes the study of Labor Protection of the Russian Federation, Fire Safety, first aid for injuries, and other areas that may be useful during the work process. The disadvantages of this method are the long training time and dependence on the work schedule of the training center. Pros: Great for beginners. For experienced specialists, as well as those who have previously undergone training, the third option is suitable.
- 3. Receive occupational safety certification remotely with our assistance, without interrupting your work. Takes no more than 2-3 working days. Minus - only for workers who have been certified previously and have experience. Plus - quickly, without interruption from work.
In all three options, a certificate and a copy of the protocol (extract) are issued.
What certification will the manager need besides labor protection?
Any enterprise rests on the main three elephants - Labor Safety, Fire Safety, and Electrical Safety (there are a lot more elephants, but the main ones are THESE three).
- 1. Electrical safety. If an organization maintains or installs electrical equipment, or has power tools, a responsible employee from the management (technical and technical staff) must be automatically appointed and issued with an electrical safety certificate of 4th clearance group. If there is no such thing, then the head of the enterprise himself becomes responsible.
- 2. Fire safety. To comply with fire safety, a responsible employee with a fire safety clearance must also be appointed. The employee must also be an engineer with at least 3 years of experience (otherwise the person responsible is the manager himself).
- 3. For work at height, the manager (or person in charge) is required to obtain a height permit with group 3. With it, he will be able to be a responsible person (assigned by order), issue work permits, read instructions, etc.
Here are the main three certifications that any organization will need in the course of performing its work (I added height on my own, it is required when performing high-altitude work).
Documents for certification
Each department or agency establishes its own list of papers that are necessary for the assessment. Typically the list includes documents such as:
- statement of consent to the processing and consideration of personal data;
- statement of consent to the verification and processing of personal data;
- report on the results of the development program for the year;
- an extract from the decision to consider this report;
- certificate of no criminal record;
- any additional documents at the discretion of the manager.
Those candidates or managers who provided documents late or incomplete are not allowed to be assessed.
Sample certification (testimony) for occupational safety managers
The exact sample of certification (or certificate) of labor protection managers is prescribed in Resolution 1/29 in Appendix N2.
Below I have provided a sample certification (certificate) for the head of occupational health and safety (as it was previously called) of one of the training centers with which we cooperate.
The graded crust is made from a cardboard backing with a vinyl (usually red) coating.
On the front of the crust is “Occupational Safety and Health Certificate”.
On page 1, the name of the training center (the license number and the name of the Authority that issued the permit are often given), the certificate number in the register (in the protocol), the name of the manager or specialist, his position, the name of the company.
Page 2 - name of the training program, signature of the chairman of the commission, seal of the organization that issued the certification, date of issue.
Conclusion: certification of managers in occupational health and safety (occupational safety and health) is a document (more precisely, a certificate) certifying the ability of an employee from the management level to conduct business in a way that is safe both for employees and for third parties and the environment.
REGULATORY REGULATION OF THE NEW CERTIFICATION PROCEDURE
Let us recall the chronology of events. At the beginning of 2020, Federal Law No. 271-FZ[1] established the obligation to organize training and certification of workers in the field of:
• industrial safety;
• safety of hydraulic structures;
• in the field of electric power industry.
Almost the entire past year we lived in anticipation of changes, and in November we received a new Procedure for training and certification in industrial safety [2] and an obligation [3] to use the Unified Testing Portal (hereinafter referred to as the UPT).
In the last ten days of December, Rostechnadzor recognized[4] Order No. 37[5] and the governing documents approved by it as no longer in force:
• RD 03-19-2007 “Regulations on the organization of work on the training and certification of specialists of organizations”;
• RD 03-20-2007 “Regulations on the organization of training and testing of knowledge of workers’ organizations.”
As a result, we received a modern, technologically advanced way to confirm employees’ knowledge of industrial safety requirements.

1. General Provisions
1.1. The Regulations on the procedure for conducting certification of managers and candidates for positions of heads of state educational organizations subordinate to the Moscow Department of Education (hereinafter referred to as the Regulations) determine the procedure for conducting mandatory certification of managers and candidates for compliance with the position of head of a state educational organization subordinate to the Moscow Department of Education, implementing educational preschool, primary general, basic general, secondary general, secondary vocational education programs, basic vocational training programs, additional general education programs, additional professional programs (hereinafter referred to as educational organizations).
1.2. The following are subject to certification:
— heads of state educational organizations (hereinafter referred to as heads);
— candidates for positions of heads of state educational organizations (hereinafter referred to as candidates).
1.3. Certification of candidates and managers is mandatory.
1.3.1. Certification of managers is carried out in order to confirm the compliance of their level of qualifications with the requirements for the position held.
1.3.2. Certification of candidates is carried out in order to establish compliance of their level of qualifications with the requirements necessary to perform the job duties of the head of an educational organization.
1.4. The main objectives of certification are:
— determining the level of knowledge of legislation, regulations, regulations, instructions and other documents regulating activities in the field of education;
— stimulation of targeted, continuous improvement of qualifications, personal professional growth, use of effective, modern management technologies, methods and means;
— increasing the efficiency and quality of management activities;
— identifying prospects for using the potential capabilities of managers and candidates.
1.5. The main principles of certification are transparency, openness, and collegiality.
1.6. Certification of managers and candidates is carried out by a certification commission created by the Moscow Department of Education (hereinafter referred to as the Certification Commission).
2. Procedure for certification of managers
2.1. The next certification of a manager is carried out once every five years based on an application.
2.2. During the inter-certification period, an extraordinary certification of the manager may be carried out:
- by decision of the Moscow Department of Education (hereinafter referred to as the Department) due to low performance indicators of the educational organization, in the presence of justified complaints, based on the results of inspections, as a result of which violations were identified, etc.;
- by personal decision of the head of the educational organization.
Based on the results of the extraordinary certification, a new validity period for the certification results is established. The validity of previously established certification results is terminated.
A manager sent for extraordinary certification submits an application to the Certification Commission no later than five working days after receiving notification of certification. In the application for extraordinary certification, the manager indicates the date of passing the qualification tests, which should not exceed 30 calendar days from the date of receipt of the notification of certification.
2.3. An application from the head of an educational organization for certification (hereinafter referred to as the application) is sent in the form of an electronic document using public information and telecommunication networks, including the Internet, to the organization accompanying the certification procedure in accordance with Section 5 of these Regulations.
Copies of documents are attached to the application for certification: on education (basic and additional), on advanced training, an attestation sheet or an extract from the order on the results of the previous certification (if available).
2.4. The organization accompanying the certification procedure, no later than five working days from the date of receipt of the application, conducts a technical examination of the documents attached to the application.
2.5. The duration of the certification procedure must be no less than one and no more than four months from the date of receipt of the application until the decision is made by the Certification Commission.
At the written request of the manager being certified, if there are good reasons, the certification procedure may be extended, but not more than for one month.
2.6. The manager, no later than 30 calendar days from the date of submission of the application, is obliged to sign up and pass qualification tests in the form of testing using an automated system (hereinafter referred to as testing).
Testing is carried out in five modules:
— invariant part: “State policy in the field of education”, “Legal foundations of management”,
— variable part: “Financial and economic foundations of management”, “Business administration”, “Educational technologies”, “Functional responsibilities in the administrative team 00”, “Ensuring the safety of the educational process”, “Organization of the educational process”, “Use of information systems in management educational organization”, “Organization of financial and economic activities of an educational organization”.
The number of variable modules is not constant.
The choice of the variable part of testing is carried out when submitting an application for certification.
2.7. Testing is considered successfully completed if the overall quality of the test is at least 70% and for each of its modules at least 50%.
During the certification process, the manager has the right to be tested no more than two times. The manager uses both testing attempts within 30 calendar days from the date of submission of the application.
2.8. If the test results are less than 70% of the overall quality of the test and (or) less than 50% in one of its modules, then the certification procedure for this manager is terminated, and the certification commission does not consider his candidacy at the meeting.
2.9. Features of testing:
2.9.1. Heads of educational organizations that took the first 300 places in the ranking of state educational organizations that showed high educational results based on the results of the academic year preceding certification:
— are exempt from testing if the educational organization is ranked from 1st to 20th place;
— are tested in the module “State policy in the field of education”, if the educational organization is in the ranking from 21 to 70 places;
— are tested in the modules “State policy in the field of education” and “Legal foundations of management”, if the educational organization is in the ranking from 71 to 170 places;
— are tested in the modules “State policy in the field of education”, “Legal foundations of management” and in one of the variable modules, if the educational organization is in the ranking from 171 to 300 places.
2.9.2. A manager undergoing extraordinary certification by decision of the Department is tested in all modules in accordance with clause 2.6. of this Regulation.
2.9.3. A manager undergoing extraordinary certification on his own initiative is tested in accordance with clause 2.9.1.
2.10. To conduct certification of a manager, an attestation certificate is generated in the form of an electronic document, which includes:
— information obtained from information and analytical systems of the Moscow Department of Education; test results;
— information provided by the manager; proposals from the Department and the chairman of the interdistrict board of directors on the period for which the manager can be certified.
The form of the certification certificate is established by the organization accompanying the certification procedure, in agreement with the Department.
The manager must familiarize himself with the certification certificate no later than five working days before the meeting of the Certification Commission.
2.11. The head is personally present at the meeting of the Certification Commission. If it is impossible to attend a meeting, the manager must notify the executive secretary of this no later than two working days before the appointed date.
Before the interview, the manager is obliged to orally inform the members of the commission about the presence or absence of additional information regarding the procedure for conducting his certification.
2.12. The certification commission reviews the certification certificate, conducts an interview with the director, hears from the chairman of the relevant interdistrict board of directors, the adviser to the inspection department of administrative districts of the Department of State Supervision and Control in Education of the Moscow Department of Education and makes one of the following decisions:
— corresponds to the position of the head of the educational organization;
— corresponds to the position of the head of the educational organization, taking into account the recommendations;
- does not correspond to the position held by the head of an educational organization.
2.13. The manager is certified for a period of up to 5 years. If, during the certification of a manager, the Certification Commission makes recommendations, the validity period of the certification results is two years.
3. Procedure for certification of candidates
3.1. Certification of a candidate is carried out on the basis of an application for certification (hereinafter referred to as the application), which is sent in the form of an electronic document using public information and telecommunication networks, including using the Internet, to the organization accompanying the certification procedure in accordance with section 5 of these Regulations.
The following documents are attached to the application for certification:
— candidate questionnaire;
— a copy of the work book and (or) other document confirming labor activity;
— copies of documents on education and advanced training; a copy of the certification sheet or extract from the order based on the results of the previous certification (if available).
3.2. The organization accompanying the certification procedure, no later than ten working days from the date of receipt of the application, conducts a technical examination of the documents attached to the application.
3.3. A candidate may be denied the certification procedure if:
— grounds that prevent you from engaging in teaching activities, and restrictions on engaging in work activities in the field of education,
— termination of the employment contract under Article 81, paragraphs 3,5,8,9-11; under Article 278 clause 2 of the Labor Code of the Russian Federation - within two years from the date of termination.
- lack of special training provided for by the requirements of the EKS, and lack of work experience in teaching positions.
3.4. The certification commission has the right to admit to certification candidates who do not have special training provided for by the requirements of the EKS and (or) professional standard, but who have sufficient practical experience in teaching activities in the education system of the city of Moscow and professional competence. In this case, candidates must submit a review from the employer containing an assessment of their professional activities, taking into account its effectiveness and significance for the development of the educational organization.
3.5. The candidate, within 30 days from the date of submission of the application, is required to register in the electronic system accompanying the certification procedure for managers and sign up for testing.
Testing is carried out in accordance with clause 2.6 of these Regulations.
During certification, the candidate has the right to be tested no more than twice during one academic year.
The test result is considered positive if the overall quality of the test is at least 70% and for each of its modules at least 50%.
If the test results are less than 70% of the overall quality of the test and (or) less than 50% in one of its modules, then the certification procedure for this candidate is terminated, and the Certification Commission does not consider his candidacy at the meeting.
3.6. To carry out certification of a candidate, an attestation certificate is generated in the form of an electronic document, which includes:
— information obtained from documents provided by the candidate;
- test results.
The form of the certification certificate is established by the organization accompanying the certification procedure, in agreement with the Department.
The candidate must familiarize himself with the certification certificate no later than three working days before the meeting of the Attestation Commission.
3.6. The candidate is personally present at the meeting of the Attestation Commission. If a candidate is not present at the meeting, his candidacy will not be considered.
3.7. The certification commission reviews the certification certificate, conducts an interview with the candidate and makes one of the following decisions:
— corresponds to the position of the head of an educational organization;
— corresponds to the position of the head of an educational organization, taking into account the recommendations;
does not correspond to the position of the head of an educational organization.
3.8. The candidate's certification results are valid for two years.
In the case of certification of civil servants transferred to work in the structure of the Department of Education of the city of Moscow from the position of head of an educational organization, certification is allowed for a period of 5 years.
3.9. Uncertified candidates have the right to re-submit documents for certification no earlier than one year after the decision of the Certification Commission.
4. Operating procedure of the Certification Commission
4.1. The personal composition of the Certification Commissions and their number are approved by order of the Moscow Department of Education.
The commission includes representatives of the Moscow Department of Education, the chairman or deputy chairman of the Moscow city organization of the trade union of workers of public education and science of the Russian Federation, organizations subordinate to the Moscow Department of Education, representatives of higher professional education, public figures, as well as chairmen of interdistrict boards of directors of educational organizations .
4.2. The Certification Commission includes: Chairman; deputy chairmen; executive Secretary; members of the Attestation Commission.
4.3. Chairman:
— carries out general management of the activities of the Certification Commission;
— presides over meetings of the Certification Commission; forms decisions of the Attestation Commission; exercises general control over the implementation of decisions made by the Certification Commission.
4.4. The Deputy Chairman, in the absence of the Chairman and on his instructions, presides over meetings of the Certification Commission and acts as Chairman.
4.5. Executive Secretary:
— ensures the processing of applications for certification and other documents provided by those being certified;
— provides organizational preparation for meetings of the Certification Commission;
- informs the members of the Certification Commission and the managers and candidates being certified (hereinafter referred to as the certified ones) about the place, date and time of the meeting;
— forms the agenda of meetings, summarizes certification certificates and submits them to the Attestation Commission;
— keeps minutes of meetings of the Certification Commission; prepares draft orders based on certification results;
— prepares extracts from orders for each certified person for transmission to the employer or certified persons.
4.6. Members of the Attestation Commission personally participate in meetings of the Attestation Commission.
4.7. The chairman of the interdistrict board of directors of educational organizations is invited to a meeting of the Certification Commission and participates in voting only when considering issues of certification of heads of educational organizations located on the territory of the council.
4.8. Meetings of the Certification Commission are held at least once every two months.
4.9. A meeting of the Attestation Commission is considered valid if at least 2/3 (two thirds) of its members are present.
4.10. The decision of the Attestation Commission is made by a simple majority of votes of the entire composition of the Attestation Commission present at the meeting.
When undergoing certification, the certified manager, who is a member of the Certification Commission, does not participate in voting on his candidacy.
4.11. The decision of the Attestation Commission is documented in a protocol, which is signed by the chairman, deputy chairmen, executive secretary and members of the Attestation Commission who took part in the voting.
4.12. The decision of the Certification Commission on the certification results is approved by order of the Moscow Department of Education.
4.13. An extract from the order based on the results of the manager’s certification is kept in the manager’s personal file.
An extract from the order based on the candidate’s certification results is handed over to the candidate himself against signature. When drawing up an employment contract with a certified candidate, an extract from the order is stored in his personal file.
4.14. Disputes regarding certification of managers and candidates are considered in the manner established by the legislation of the Russian Federation
5. Organizational, methodological, information and technical support for certification
5.1. Organizational, methodological, information and technical support for the certification procedure is provided by the State Autonomous Educational Institution of Higher Professional Education in Moscow “Moscow Institute of Open Education” (hereinafter referred to as the Moscow Institute of Open Education).
5.2. Moscow Institute of Open Education:
— accepts and registers applications for certification from managers and candidates in the form of electronic documents using public information and telecommunication networks, including using the Internet;
— organizes the reception of documents and materials necessary for the work of the Certification Commission;
— develops application forms for certification, certification certificates, candidate questionnaires and coordinates them with the Certification Commission;
— conducts technical examination of documents submitted for certification;
— creates testing schedules, brings them to the attention of those being certified through the website of the Moscow Institute of Open Education;
— ensures testing;
— organizes information, analytical, organizational and technical support for the work of the Certification Commission;
— develops questions and tasks for testing with the involvement of specialists (if necessary);
— develops methodological recommendations for organizing the certification procedure;
— provides psychological support to those being certified (if necessary);
— ensures the development and operation of an electronic resource for supporting the certification of candidates and managers;
— maintains a database and archive of managers and candidates who have passed the certification procedure;
— presents reporting documentation based on the results of the certification.
