Help-call for session 2020: who needs it and why
The form of the summons certificate was approved on December 19, 2013 by order of the Ministry of Education and Science of Russia No. 1368. It is issued to students combining work with study at higher educational institutions to ensure the guarantees provided for in Article 173 of the Labor Code.
In accordance with this norm of the Labor Code, bachelors, masters and specialists studying part-time (part-time) have the right to take additional paid leave:
- for 40 days – upon passing the session in the 1st and 2nd courses;
- for 50 days – upon passing the session in subsequent courses.
If a student worker undergoes training in a shortened period, already in the 2nd year he can take a 50-day leave with pay. If an employee faces final certification before receiving a diploma, the maximum vacation time increases to four months.
To take advantage of such preferences, you must study at an educational institution that has state accreditation. The dean's office of the university issues him a certificate of invitation to the session, which he submits to the employer along with an application for study leave.
Full-time students will also need the same certificate if they find time to officially work somewhere. They are also given study leave, but only at their own expense: up to 15 days per academic year for intermediate sessions, and up to 4 months for defending their diploma and passing state exams.
Article 173 of the Labor Code sets out the maximum possible periods for students' educational leaves, depending on the form of study and other circumstances. However, the duration of leave for a particular employee will correspond to the session period specified in the certificate. That is, in reality it may be less than the period specified in the law (but not more!).
Having received a certificate and application from the student-worker, the employer is obliged to provide him with additional study leave. He issues a corresponding order, which indicates the duration of the vacation, as well as whether it is paid or not. The employee is introduced to this document against signature. If an employee studies by correspondence in another city, the employer pays for his travel to and from the place of study once a year.

Leave is granted to an employee for various reasons. This can be not only passing current (session) or entrance (upon admission) exams, but also:
- passing state exams;
- writing a thesis and defending it;
- passing exams as part of the retraining program;
- passing the minimum for obtaining an academic degree, defending a dissertation, etc.
An employee has an unconditional right to grant leave only in cases where the programs and the educational institution itself have successfully passed accreditation; in other cases, leave is granted at the discretion of the manager. In this case, a specific article of the Labor Code is indicated as the basis in the summons certificate - it also determines the payment of vacation (can be provided at the expense of the employee or as a regular paid vacation). According to the developed form, the call certificate must contain:
- date of its compilation and number;
- name of the employing organization (or individual entrepreneur);
- a link to the relevant article of the Labor Code (if we are talking about a university student - Article 173 of the Labor Code);
- in what form the student is studying at the university, in what course;
- what event is planned (interim certification, final certification, etc.);
- in what terms (start and end dates, as well as the number of days are reported);
- name of the higher educational institution;
- information about its accreditation (number, series of certificate, who issued it, for what educational program, etc.);
- Full name of the head of the university, or other authorized employee;
- seal of the educational institution.
Required Documentation
To be granted leave intended for study, a working citizen must provide the management of the company in which he carries out professional activities with several documents:
- an application prepared accordingly;
- a document confirming the fact that the educational institution has successfully passed state accreditation (provided upon request of the employer);
- certificate of invitation to a study session or defense of a final work.
The final paper is issued directly by the university or other institution where the employee is studying. It contains information about the student, the duration and date of the upcoming session, as well as other related information.
Do I need to write if there is a call for help?
A mandatory condition for granting student leave is the submission of a special application by the employee. This rule must be observed even if the student worker has a summons certificate from the educational institution.
The statement acts as confirmation of the citizen’s intention to interrupt professional activities due to training.
The application is the official basis for interruption of work and is required to be completed.
The employer puts a mark on his decision on the application. After this, he issues an appropriate order to provide days off for study.
Submission order
The application can be submitted to the employer in several ways. Among these are the following:
- through an independent visit, in person;
- through the manager's secretary or HR specialist. In this case, the employee who accepted the application must put a mark on it that this action was completed;
- by sending a registered letter;
- through a trusted person. A power of attorney to perform such actions must be certified by a notary.
Each employee has the right to choose for himself how to submit the application and accompanying documentation to the management of the company. When choosing, you must be guided only by your capabilities.
How many days in advance are documents provided?
Labor Law provisions do not determine the exact period within which an employee must inform the manager about upcoming training.
It follows from this that the documentation necessary for exemption from official duties can be transferred to him the day before the expected start date of student leave.
As practice shows, the summons certificate and application usually reach the employer 5 days before the employee starts studying.
This period is considered optimal for both parties to the labor relationship.
In order for the accounting department to fulfill its duties in a timely manner, documents should be submitted at least 3 days before the vacation.

If a student is studying at two higher educational institutions at the same time, there is no point in taking certificates from both universities. He will be able to use the right to study leave only in relation to one of them of his choice.
The summons certificate also has a detachable part, which the student employee presents to the employer upon returning from study leave to confirm that he actually studied. It indicates the student’s data, the name of the university and the period of study. All this is confirmed by the signature of an authorized person and the seal of the educational institution.

- First education - the education that an employee receives should be his first (at this level).
If these conditions are not met, the employer can still grant the employee study leave, but only if this is provided for in the employment contract.

Key points when making an application
Today, an application for study leave does not have a unified template, so employees of enterprises and organizations have the right to write it in any form or according to the company’s internal template. In this case, it is necessary to follow the norms of office work in terms of the structure of the document, and also take into account the rules of the Russian language.
Despite the fact that the application can be written in free form, there is a number of information that must be indicated in it:
- name of the enterprise where the employee works;
- Full name of the director of the enterprise (or other employee authorized to act on behalf of the director);
- date of document preparation;
- You should also indicate the type of leave (in this case, educational), with or without salary;
- vacation period (start and end dates) - based on the call certificate;
- name of the educational institution where the employee is studying.
In the future, based on this application and the attached summons certificate, the head of the enterprise must issue an appropriate order to grant leave, and the personnel officer must enter all the necessary information into the employee’s personal card.
How to fill out a call certificate
The certificate for study leave must contain the following:
- details of the certificate – number and date of issue;
- name of the employer (if the employer is an individual, then his full name) to whom the certificate is submitted;
- an indication of the Labor Code norm giving the employee the right to additional access (see table above);
- form of education – correspondence, full-time or part-time (you must highlight the one you need);
- the course in which the employee is studying;
- in connection with which a certificate is issued, for example, an intermediate certification (session) (from the proposed options, underline what is needed). It is not indicated if the employee is undergoing training of highly qualified personnel;
- the period that an employee needs to undergo, for example, certification (dates and number of days are indicated);
- name of the educational institution;
- information about state accreditation (details of the relevant certificate, the name of the body that issued it, the training program and direction that have passed state accreditation). This information is not indicated if the training program does not have state accreditation, and also if the employee passes entrance exams, is a student of training courses, or is undergoing training of highly qualified personnel;
- FULL NAME. and the signature of the head of the educational institution or other authorized person;
- seal of the institution.
The listed information is indicated in the main part of the certificate, however, this document also has a second part, the so-called spine, which serves to confirm that the employee actually participated in activities related to training during the vacation period. Its completion is also certified by the signature of the head of the educational institution and the seal.
How to write an application for student leave?
Features of drawing up an application for school weekends depend on several factors. One of these is the preservation or lack of earnings during the vacation period.

An employer is required to provide paid study leave to a student employee if certain conditions are met:
- the citizen has a single place of work;
- the institution where the employee is studying has state accreditation;
- the employee is receiving education for the first time;
- form of education - part-time;
- The citizen's academic performance is at a satisfactory level.

- cap - name of the recipient, position of the manager;
- date of preparation, number and title of the application;

The employer's responsibilities do not include payment of student leave for employees who:
- full-time students;
- are studying at a non-state institution;
- take exams for admission to a university;
- They are not getting their first education.

Requirements according to the Labor Code and the order of the Ministry of Education and Science
The Labor Code includes only a reference norm regarding the summons certificate.
This law states that approval of its form falls under the responsibility of the authorized body at the federal level of the executive power system, which is entrusted with establishing the policy of the Russian Federation in the field of education. The form for the summons certificate was determined by the Ministry of Education and Science , which issued the corresponding order number 1368 in 2013. It is required that the document be issued by an educational organization for a specific student (and not for their group). It must contain the following information:
- date of registration;
- full designation of the organization in which the employee works and where the document is sent;
- number of the article of the Labor Code, on the basis of which the employee has the right to receive a call to the session;
- the employee’s surname, as well as his name and patronymic, which are put in the dative case (to whom?);
- form of study (full-time, part-time or part-time) and the serial number of the course for which the session is taken (or in which the diploma is defended);
- the time of the vacation provided, you need to write the date of its beginning and its end, as well as indicate its total duration;
- designation of the educational organization;
- details of the certificate issued to the educational organization certifying its accreditation;
- name of the authority from which this certificate was received

For the certificate to be considered valid, it must be signed by the head of the institution or a person authorized by him. In particular, if an employee is studying at a university, the rector must sign, unless he has granted this right to another employee. This detail must be sealed.
The bottom part of the certificate is detachable. With its help, it is verified that the employee passed the session during such and such a period of time. After completing this process, the head of the educational institution fills out all the required fields, after which this counterfoil is provided to the employer .
