Decree of the Government of the Russian Federation of June 20, 2013 N 519 Moscow “On the certificate of a family member of a deceased (deceased) disabled war veteran, participant in the Great Patriotic War and veteran

Which persons do regulatory legal acts include in this category of veterans?

Veterans of military campaigns (actions) include:
  1. persons who participated in military campaigns in Syria (since September 30, 2015);
  2. crew members of military aircraft of the USSR and the Russian Federation, if they served in the territories of other countries and were wounded, shell-shocked or mutilated;
  3. persons who cleared populated areas of the USSR from unexploded ordnance from the Great Patriotic War (from May 10, 1945 to December 31, 1951);
  4. military personnel who took part in military campaigns on the territory of the Russian Federation or the USSR or were sent to participate in military campaigns on the territories of foreign states;

What tax benefits are due to the category of veterans in question?

The first of these benefits is complete exemption from paying property tax for an individual. But this is not done in relation to all property, but only in relation to one object. This object must be owned by the veteran, but cannot be used for any profit-generating activity (for example, for business).

But there is a nuance here. Federal legislation reserves the right for regions to change this preference not in favor of the veteran. Those. full tax exemption will be replaced by a simple reduction in the tax base or a reduction in the tax rate.

In some regions of the Russian Federation, combat veterans are completely exempt from vehicle taxation. But this requirement is not fixed at the federal level, so the state cannot oblige the regions to provide this benefit. Each subject of the Federation decides this issue based on the state of its budget.

Another benefit is the monthly tax deduction provided on income taxes. The amount not subject to personal income tax is small and amounts to 500 rubles. If a veteran who participated in hostilities received an injury or wounds that made him disabled of any category, then the amount of the tax deduction increases to 3,000 rubles.

To receive a tax deduction, you will need to write a corresponding application to the employer, confirming it with copies of documents (veteran ID, disability certificate, etc.). The employer does not have the right to require the employee to fill out this application annually. This statement is valid for the entire duration of your employment with this employer.

ATTENTION !!! As for paying land tax, many regions of the Russian Federation have also established certain benefits here. For example, in Moscow, combat veterans do not pay this tax at all.

Tax benefits, with the exception of tax deductions, are issued through divisions of the Federal Tax Service. The application can be submitted either in person or through the official tax service portal. All documents certifying the right to benefits are attached to the application.

How are pensions provided to veterans of military campaigns?

The size and procedure for assigning a pension to the category of beneficiaries under consideration differs significantly from the calculation of a pension for an ordinary citizen.

Just like ordinary citizens, combat veterans can receive two types of pensions: insurance and social.

IMPORTANT !!! The insurance pension is due to all persons who have accumulated the insurance period required for the assignment of a pension (at least 8 years). A social pension can be established if the veteran, as a result of participation in hostilities, received an injury or wound that made him disabled.

The pension, taking into account all payments, cannot exceed 85% of the amount of pay that the military veteran received during his service.

If a combat veteran participated in the Great Patriotic War, or was a prisoner in a fascist concentration camp, or lived in Leningrad during its siege, then he is entitled to an increase in the amount of 32% of the accrued pension.

These pensions and bonuses are issued in the same manner as pensions for civilians. Veterans submit an application to the appropriate division of the Russian Pension Fund or fill out the appropriate form on the Pension Fund website, attaching electronic copies of the necessary documents.

Similar events are held by societies of veterans of the Great Patriotic War and other military operations in the regions.

What benefits are assigned to the category of beneficiaries in question in the transport sector?

There is no clear regulation of benefits in the field of transport at the federal level. The legislation refers the establishment of such preferences to the jurisdiction of the constituent entities of the Russian Federation. Depending on the region and its geographical and climatic conditions, different benefits may be provided. The most common benefit is absolutely free travel on city buses, trolleybuses and trams. Taxi service for combat veterans is paid in full. In some regions, for example, in the Rostov region, veterans also enjoy free travel on trains and buses, but only within a given subject of the Russian Federation. Outside the Rostov region, these benefits do not apply.

Benefits are provided upon presentation of a combat veteran ID.

It is possible to receive part of the benefits at the regional level - payment for travel on public transport, except for taxis. Benefits are provided to widows if they have not entered into a new official marriage.

Reasons

Many benefits are provided for in local legislation on the existence of which can be found on the website of the Federal Tax Service of the Russian Federation. All disabled people of groups 1 and 2 and disabled people since childhood are exempt from property tax.

The table below shows the monthly payment amounts for certain categories of federal beneficiaries. The amounts of payments are indicated for those cases where a citizen refused to receive NSS in kind , replacing it with monetary compensation.

Combat veterans are assigned a monthly cash payment (MCA) . This right to UBD is granted in accordance with Art. 23.1 of Law No. 5-FZ of January 12, 1995 “On Veterans”. Every year, the amount of EDV increased from February 1, depending on the rise in prices in the past year (i.e. indexation to the level of inflation).

The list of federal beneficiaries who are entitled to EDV is legally defined:

The increase in the monthly allowance for combat veterans in 2021 will occur from February 1 as a result of indexation by 3.8% . From 01.02.2021 , the amount of EDV will be 3178.36 rubles. , i.e. the increase will be 116.36 rubles. (until February 1, 2021, the EDV for UBD is 3,062.00 ). This amount of benefit will be paid if the veteran refused to receive a set of social services (NSS) in kind and instead chose cash compensation.

In addition to cash payments, UBI spouses can also count on social assistance. So, according to the law, they are entitled to subsidies. Subsidies are often regional in nature. Their size varies depending on the regional budget.
