What does the law say?

The current legislation determines the procedure for sending employees on business trips.

At the same time, there is no document that would regulate the procedure for processing the transfer of a business trip. In practice, a certain procedure has developed that is used by organizational leaders in such situations.

Thus, the form of the order and the procedure for filling it out must be enshrined in the local regulations of the enterprise.

It is prohibited to make changes to the main order for sending on a business trip.

It is necessary to create a new document that will reflect the main provisions and aspects of the postponement.

Normative base

The sending of employees on business trips is regulated by the Regulations on the specifics of sending employees on business trips.

This regulatory legal act was approved by Decree of the Government of the Russian Federation No. 749 of October 13, 2008.

When is it needed?

An order to reschedule a business trip is required in the following cases:

  • Due to production needs. For example, an employee had to go to another city to conclude a contract with suppliers, and the contractors, in turn, were unable to arrive on time or postponed their arrival.

    Daily allowance is paid for the entire time spent on a business trip and includes:

    • weekends and non-working holidays;

While carrying out the assignment, she fell ill and was in the hospital from July 4-6, which was confirmed by a sick leave certificate.     Solution:

    Days of illness of an employee are not included in the business trip.

    The organization must accrue:

    • daily allowances for the period from June 27 to July 12;
    • sick leave benefits for the period July 4–6;
    • compensation for living expenses (the period from July 4-6 is not taken into account).

    Reasons for extending business trips

    The reasons for the extension are not legally defined.

    When going on a business trip, a start and end date is set.

    • Execution of production orders only at the place of arrival, absence of them during the trip to him.

    An order to extend a business trip does not have a specific, strictly unified form; it is usually issued on the organization’s letterhead.

    The following points must be recorded:

    • Name of the enterprise, date of issue of the order and its number.
    • Full name of the seconded employee, start date of the business trip.
    • Reason for extension of business trip, extension period.
    • The date on which the employee must return to work after a business trip.
    • Responsible persons for: recording working hours, conveying information to the business traveler and monitoring the implementation of the order.

    Features of the procedure

    A business trip is a trip by an employee by order of his superior in order to carry out certain assignments.

    It must meet the following conditions:

    Employees who are only in an employment relationship are sent on a business trip. Otherwise, the tax authorities will not recognize expenses as travel expenses.

    Pregnant women, disabled people, and registered candidates are not allowed to travel.

    If the period has been reduced

    It must be taken into account that the business trip ends at 23.59 and begins at 00.00. If the employee completed the task earlier and wanted to return, then an order is issued and the employee comes to the city of his main place of work.

    If he arrived several days (or 1 day) earlier than the pre-planned date, then the next day he must report to the place of duty. If he does not show up, it is considered a missed day of work.

    The employer has the right to assign a monetary incentive for quickly completed work or not to assign one. He has the right to grant his employee an extraordinary paid day off for this time.

    In the memo, indicate the reason why the business trip extension is required, as well as the period for its extension.

    Based on the memo on the extension of the business trip, an order for extension must subsequently be issued if the head of the organization considers the extension of the business trip appropriate.
