About the cost of living in the Russian Federation

This Federal Law establishes the legal basis for determining the subsistence level in the Russian Federation and taking it into account when establishing state guarantees for citizens of the Russian Federation to receive minimum cash income and when implementing other measures of social protection of citizens of the Russian Federation.

Article 1. Basic concepts used in this Federal Law

This Federal Law uses the following basic concepts:

subsistence level - the minimum amount of income of a citizen necessary to ensure life; (As amended by Federal Law No. 473-FZ dated December 29, 2020)

median per capita income - the amount of money income in relation to which half of the population as a whole in the Russian Federation has a per capita income value below this value, the other half - above this value and which is calculated annually by the federal executive body that carries out the functions of generating official statistical information on social, economic, demographic, environmental and other social processes in the Russian Federation; (Paragraph introduced - Federal Law dated December 29, 2020 No. 473-FZ)

family - persons related by kinship and (or) property, living together and leading a joint household;

the main socio-demographic groups of the population are the working population, pensioners, children;

The average per capita income of a family (a citizen living alone) is the total amount of income of each family member (a citizen living alone) divided by the number of all family members. (Paragraph introduced - Federal Law of May 27, 2000 No. 75-FZ)

Article 2. Assignment of the subsistence minimum

1. The subsistence minimum for the Russian Federation as a whole is intended for:

assessing the standard of living of the population of the Russian Federation in the development and implementation of social policy and federal social programs;

justification for the minimum wage established at the federal level, as well as for determining the amounts of scholarships, benefits and other social payments established at the federal level; (As amended by Federal Law No. 122-FZ dated August 22, 2004)

formation of the federal budget;

2. The living wage in the constituent entities of the Russian Federation is intended for:

assessing the standard of living of the population of the corresponding constituent entity of the Russian Federation in the development and implementation of regional social programs;

providing the necessary state social assistance and providing social support measures to low-income citizens; (As amended by Federal Law No. 473-FZ dated December 29, 2020)

formation of budgets of the constituent entities of the Russian Federation;

Article 3.

Article 4. The amount of the subsistence minimum, the frequency of its calculation and the procedure for establishing it

1. The cost of living per capita for the Russian Federation as a whole for the next year is established before July 1 of the current year by the Government of the Russian Federation, taking into account the opinion of the Russian Tripartite Commission for the Regulation of Social and Labor Relations, and is calculated based on the median per capita income for the previous year.

The ratio of the cost of living per capita in the Russian Federation as a whole and the median per capita income for the previous year is set at 44.2 percent from 2021.

The ratio specified in paragraph two of this paragraph is reviewed at least once every five years based on the conditions of socio-economic development of the Russian Federation. During the validity period of the established ratio, the cost of living per capita for the Russian Federation as a whole for the next year cannot be set lower than the cost of living per capita for the Russian Federation as a whole, established for the current year.

The calculation of median per capita income is carried out on the basis of a methodology determined by the federal executive body that carries out the functions of generating official statistical information on social, economic, demographic, environmental and other social processes in the Russian Federation.

2. The cost of living for the main socio-demographic groups of the population as a whole in the Russian Federation for the next year, including for determining the size of the federal social supplement to pensions provided for by Federal Law of July 17, 1999 No. 178-FZ “On State Social Assistance” “, is established by the Government of the Russian Federation taking into account the opinion of the Russian Tripartite Commission for the Regulation of Social and Labor Relations based on the value of the subsistence minimum per capita for the Russian Federation as a whole for the same year, simultaneously with the establishment of the value of the subsistence minimum per capita for the Russian Federation as a whole.

The ratio of the cost of living of the working-age population in the Russian Federation as a whole and the cost of living per capita in the whole of the Russian Federation is set at 109 percent, the cost of living of a pensioner in the whole of the Russian Federation and the cost of living per capita in the whole of the Russian Federation - in the amount of 86 percent, the cost of living for children in the Russian Federation as a whole and the cost of living per capita in the Russian Federation as a whole - in the amount of 97 percent.

3. The cost of living per capita in a constituent entity of the Russian Federation for the next year is established by September 15 of the current year by the subject of the Russian Federation, taking into account the coefficient of regional differentiation, which is calculated as the ratio of the cost of living per capita in the Russian Federation as a whole and the cost of living in per capita in the corresponding subject of the Russian Federation in the manner determined by the Government of the Russian Federation.

For 2021, the cost of living per capita and for the main socio-demographic groups of the population in the subject of the Russian Federation is established by the subject of the Russian Federation in an amount not lower than the cost of living per capita and for the main socio-demographic groups of the population in the subject of the Russian Federation for the second quarter 2021.

For 2021 - 2025, a transition period is being established to gradually bring the per capita subsistence level in the constituent entities of the Russian Federation, established for 2021, to the per capita subsistence level in the Russian Federation constituents, calculated taking into account the regional differentiation coefficients provided for in paragraph one of this paragraph .

For 2022 and subsequent years, the cost of living for the main socio-demographic groups of the population in a subject of the Russian Federation is established by the subject of the Russian Federation in the manner determined by the Government of the Russian Federation, simultaneously with the establishment of the cost of living per capita in the subject of the Russian Federation.

The cost of living for a pensioner, established in a constituent entity of the Russian Federation in accordance with paragraphs two and four of this paragraph, is used, among other things, for the purpose of establishing a social supplement to the pension provided for by Federal Law of July 17, 1999 No. 178-FZ “On State Social Assistance” .

State authorities of the constituent entities of the Russian Federation have the right to establish the cost of living per capita and for the main socio-demographic groups of the population differentially, taking into account the socio-economic characteristics and natural and climatic conditions of the areas located in these constituent entities of the Russian Federation.

Article 5.

Article 6. Taking into account the cost of living when providing social support to citizens in the constituent entities of the Russian Federation

(Name as amended by Federal Law dated August 22, 2004 No. 122-FZ)

1. A family (a citizen living alone), whose average per capita income (whose income) is below the subsistence level established in the relevant constituent entity of the Russian Federation, is considered low-income (poor) and has the right to receive social support. 2. The conditions and procedure for providing social support to low-income families (citizens) are established in accordance with the legislation of the Russian Federation and the legislation of the constituent entities of the Russian Federation. (As amended by federal laws dated August 22, 2004 No. 122-FZ, dated December 29, 2020 No. 473-FZ)

3. The procedure for calculating the average per capita income of a family (a citizen living alone) is established by federal law. (Clause introduced - Federal Law dated May 27, 2000 No. 75-FZ)

Article 7. Publication of information on the cost of living

Information on the cost of living per capita and for the main socio-demographic groups of the population in general in the Russian Federation and in the constituent entities of the Russian Federation is subject to annual official publication, as well as posting on the official website of the federal executive body that carries out the functions of generating official statistical information on social, economic, demographic, environmental and other social processes in the Russian Federation, in the information and telecommunications network “Internet”. Article 8. Entry into force of this Federal Law

This Federal Law comes into force on January 1, 1998.
