According to the law, a citizen is released from liability for this crime only if money was actually extorted from him or if he voluntarily reported the incident to law enforcement agencies.

The topic of gifts for teachers is one of the most pressing for parents of schoolchildren. As a mother of a schoolchild, I support gift giving: as a rule, it is not such a significant expense, but it is a good way to express gratitude to the teacher for his hard work. But since I am not only a mother, but also a lawyer, I am used to considering any problem from the point of view of the law.

What can teachers give and receive, and what cannot, and what consequences may arise when receiving unwanted, too expensive or non-gratuitous gifts?

According to the Civil Code of the Russian Federation (clause 1 of Article 575), gifts to employees of educational organizations are unacceptable, with the exception of gifts whose value does not exceed three thousand rubles. That is, you can give gifts up to three thousand. Unless it's a bribe, of course. More on bribes later. What happens in case of violation? Well, most likely nothing.

It is unlikely that any of the parents or colleagues will have the idea to inform “where it should be”, and the teacher himself may not even suspect what value he has become.

But if someone complains to the appropriate authorities, then first of all disciplinary liability will follow, provided for by the internal documents of the educational institution. As a rule, such things are recorded in the Code of Ethics. It may contain a direct prohibition on receiving any gifts in connection with the performance of official duties or certain restrictions.

For example, the Code of Ethics of one of the schools with an artistic bias establishes that a teacher can only receive gifts that are presented voluntarily and do not serve the purpose of bribing the teacher, and are also quite modest. That is, these are things made by the hands of the students themselves or their parents, crafts created by them, flowers, sweets, souvenirs or other inexpensive things.

Can a gift be perceived as a bribe? It can, but under a mandatory condition: it is always gratuitous, and the bribe is given for a specific action (or inaction) in the service or for a general favor in favor of the giver or the persons represented by him. Thus, a connection between the action and the bribe is required. It does not matter what came first: the receipt of the bribe and a certain action or action, and then the bribe.

Here are a few cases from my practice.

A teacher in Togliatti accepted 10,000 rubles from the parents of his students to buy a painting of his choice, for which he was brought to disciplinary action.
But regarding the bribe: a teacher was sentenced to two years probation for delivering chopped firewood to a student’s dacha in exchange for a test (Decision in case No. 1-51 of the Leninogorsk City Court of the Republic of Tatarstan).
Another teacher paid a fine of 45,000 rubles because he gave a physical education test for three chocolates, a bottle of vodka and a bottle of champagne (Decision in case No. 1-796/2015 of the Sovetsky District Court of the city of Krasnoyarsk, Krasnoyarsk Territory).

So, when wanting to say a sincere “thank you” to a teacher, it is very important not to confuse gratitude with a bribe. Gifts should be made consciously.
