It is worth noting that in these two orders there is a clear tendency of the legislator to tighten the requirements in order to weed out drivers who can create emergency situations on the road. For example, if previously a diagnosis such as color vision impairment was allowed (albeit in milder forms), now you will no longer receive a certificate with such a verdict.

The next measure, demonstrating a more attentive approach to the fate of road users, provides for a fine of up to 3,000 rubles for entering incorrect information in a medical certificate. But that’s not all: for a fake medical certificate, liability comes under Article 327 of the Criminal Code of the Russian Federation

This article provides for the following sanctions:

  1. restriction of freedom for up to 2 years;
  2. forced labor for up to 2 years;
  3. or arrest for up to 6 months.

This responsibility applies, as a rule, to medical workers who enter knowingly false information into the certificate form.

A citizen who receives a certificate knows that it is fake, but continues to use it, faces punishment in the form of:

  • correctional labor for up to 2 years;

How is the medical examination carried out to obtain a medical certificate for drivers?

With these documents, you go to any health care institution (and it can be either public or private) that has a license to issue the relevant certificates.

Procedure for undergoing a medical examination:

  1. First you need to see a psychiatrist and a narcologist. As a rule, these specialists are located in separate dispensaries. Accordingly, the first thing you do is go there and receive a certificate stating that you are not registered.
  2. After this, you return to the health care facility to see all other specialists: ophthalmologist, surgeon, neurologist, otolaryngologist.
  3. Once they have made their verdict on whether you are healthy or have appropriate driving restrictions, you go to a GP. He summarizes and fills out his part of the certificate.
  4. After that, you go down to the registry, put a stamp, pay for the services provided to you and go to get your license. It is worth noting that the regulatory legal act does not set a limit on the cost of a certificate for drivers. However, not everyone is happy with this option, since passing specialists often takes a lot of time. Some people prefer another option: for a certain amount, “their people” in healthcare issue a medical certificate without the participation of the candidate for its receipt (in simpler terms, we are talking about buying a fake certificate). It seems simple, but everything has its consequences.

Firstly, without undergoing a proper medical examination, you will not learn about the state of your health, and accordingly, you will not know what diseases you have. When might a medical certificate be needed for a driver's license?

Medical certificate for a driver's license: in what cases is it required?

When passing a technical inspection or concluding a vehicle insurance contract, as well as when replacing a license due to its deterioration, loss or change of last name (first name, other personal data), a certificate does not need to be provided.

The validity of the medical certificate is 2 years. This period does not change depending on age or gender. But if a citizen has certain contraindications for driving a vehicle, then he must undergo a medical examination once a year.

Medical examination: is it really that scary?

A medical examination can be completed at any health care institution that is licensed to issue such certificates. The form of the medical certificate is approved by order of the Ministry of Health and Social Development No. 831n.

The procedure for undergoing a medical examination is as follows:

  • According to the current order No. 831n, information about all issued certificates is entered into a special journal, which must be kept in a health care institution for at least 10 years.

When undergoing a medical examination, it is advisable to wear glasses or contacts, if you wear them. This is due to the fact that the doctor must know about all the special or auxiliary means that you use. Accordingly, he will check his vision with glasses or contacts. The diopters in glasses/lenses should not be less than -8 and more than +8, and the difference between the “eyes” should be no more than 3 diopters.

Regarding the medical examination, another interesting order of the Ministry of Health and Social Development of the Russian Federation No. 320n. It contains a list of diseases for each category of license for which the driver cannot be allowed to drive a vehicle.

When studying this document, a logical question immediately arises: why did the legislator treat some diseases so “severely” by including all their forms as restrictions on driving a vehicle?

It's actually quite simple. This began in 2010, when the legislator systematically, in small but confident steps, tightened legislation that in one way or another related to traffic rules and road safety. For example, let’s take the Code of Administrative Offenses: a lot of innovations have appeared in terms of article sanctions; the minimum fine for violating traffic rules has increased to 500 rubles (previously it was 100 rubles).

Therefore, it turns out that all these documents are interconnected and aimed at solving one global problem: correcting the negative trends that have begun to appear in the field of road safety in the last decade.

Responsibility for issuing false certificates

If traffic police officers do not have the right to check driver’s licenses, then who and how can punish you?

Responsibility for issuing a false medical certificate is provided for in Art. 327 of the Criminal Code. Moreover, this article extends its effect to those who issued this certificate (sanction - restriction of freedom for up to 3 years, or arrest for up to 6 months, or imprisonment for up to 2 years), and to those who, knowing that it is fake, continues to use it.

In addition, a medical worker who entered incorrect information into a certificate may be subject to a fine of 2,000 to 5,000 rubles.

Changes in the procedure for drivers to obtain a medical certificate dated March 26, 2020

Here, drivers and candidates for drivers of mass categories A and B will experience pleasant and useful (for the wallet) changes. The Ministry of Health of the Russian Federation approved Order No. 344n (came into force on March 26, 2020).

According to this order, the procedure for conducting a medical examination of drivers of vehicles (TC) and candidate drivers (TC) has been changed.

Medical examination

Medical examination includes:

  1. Examination by a general practitioner or examination by a general practitioner (family doctor). The general practitioner can refer any candidate to other specialists if he suspects relevant contraindications.

  8. Determination of the presence of psychoactive substances in urine (if a psychiatrist-narcologist identifies symptoms and syndromes of a disease (condition) that is a medical contraindication to driving a vehicle).
  9. Qualitative and quantitative determination of carbohydrate-deficient transferrin (CDT) in blood serum (when a psychiatrist-narcologist identifies symptoms and syndromes of a disease (condition) that is a medical contraindication to the management of a vehicle).

For persons working as drivers

“When conducting a medical examination of persons working as drivers of vehicles (vehicles), the witness presents to the medical specialists specified in paragraph 6 of this Procedure a medical report issued based on the results of a mandatory periodic medical examination, containing information on the results of examinations by medical specialists, laboratory and instrumental studies provided for by Order of the Ministry of Health and Social Development of the Russian Federation dated April 12, 2011 N 302n “On approval of lists of harmful and (or) hazardous production factors and work, during the performance of which mandatory preliminary and periodic medical examinations (examinations) are carried out” and the procedure for conducting mandatory preliminary and periodic medical examinations (examinations) of workers engaged in heavy work and work with harmful and (or) dangerous working conditions.”

According to Order No. 344n, the number of specialists required to undergo examination is being reduced, and this list differs for different categories of rights. Now, to obtain a medical certificate for categories A, A1, B, BE, B1, M, you need to go through 4 mandatory doctors. Other inspections and examinations are carried out only if necessary. To obtain a certificate for categories C, CE, C1, C1E, D, DE, D1, D1E, Tm, Tb, you need to undergo 6 doctors and 1 examination (electroencephalography). Other examinations are optional.

There is no liability for refusal to undergo additional checks, but in case of refusal, the refusers will not receive a medical certificate.

Medical certificate, changes in validity period (expiration date)

From March 26, 2020, a medical certificate is issued for a period of 1 year from the date of issue (that is, it is valid for 12 months).

Composition of the medical commission

To obtain a certificate from the traffic police, the medical examination involves the following specialists:

  • ophthalmologist,
  • psychiatrist,
  • narcologist,
  • therapist.

Additional laboratory tests (for example, blood and urine for the content of narcotic substances and psychotropic drugs) are prescribed by a narcologist or psychiatrist at his own discretion. Truck and public transport drivers additionally need to undergo an examination by an otolaryngologist (ENT).

Changes in the medical certificate according to the form

From July 1, 2020, Order of the Ministry of Health of the Russian Federation No. 344n in Russia, a new form (003-В/у) of a medical certificate for drivers is being introduced (a medical report on the presence or absence of medical contraindications, indications or restrictions for driving a vehicle in drivers and candidate drivers).

A certificate in form No. 003-В/у is required for drivers and candidates in cases where:

  • you need to pass exams at the traffic police to obtain a driver’s license for the first time;
  • you need to pass exams at the traffic police to upgrade the category of your driver's license;
  • You need to change your driver's license due to its expiration.

Validity of a medical certificate for a driver and its features

The certificate is valid for one calendar year, starting from the date of its issue. In the new medical certificate form, the period is not indicated on the form and does not in any way affect the validity of the driver's license, which is 10 years.

The document is more compact in content compared to the old-style certificate. The fields filled in by medical specialists conducting a medical examination of the patient have been removed from it. Now doctors enter all these records into the patient’s medical record, which is entered upon his arrival for examination at a medical institution, and the certificate is issued by the general practitioner after receiving the conclusions of all the medical specialists indicated in the referral and the procedures based on their results.

It should be borne in mind that examinations by doctors - specialists in psychiatry and narcology will be valid only if they are carried out at the place of registration of the person. Usually these are state dispensaries in which personal records are kept of all citizens of the region who underwent inpatient or outpatient treatment in these institutions.

The presence of a registration mark in the passport or a separate certificate of temporary registration is an indispensable condition for undergoing examination at the dispensary. For this purpose, a column about the place of registration of the patient is included in the certificate. Examinations by doctors of other specialties can be carried out at any convenient medical institution in Russia.

The new sample medical certificate forms are documents of strict accounting and reporting and are protected from forgery by using special paper with a colored individual background.

On March 31, 2014, the Law of December 28, 2013 No. 437-FZ “On Amendments to the Federal Law “On Road Traffic Safety” and the Code of the Russian Federation on Administrative Offenses on Medical Provision of Road Safety” comes into force. Until this moment, a driver’s medical certificate in form 083/U-89 was issued on the basis of the Federal Law, which has been in force since November 2010.

Who should undergo a medical examination

The list of employees required to undergo medical training is determined by law, depending on their profession, type of work and age:

  • persons who are exposed to harmful production factors or perform work reflected in the List (appendix to Project No. 302N);
  • workers in the transport industry, necessarily drivers;
  • personnel working underground;
  • food industry and catering employees;

Validity period of the driver's medical certificate

The certificate in form 083/U-89 is limited in validity. Motorists are issued for a period of up to 3 years, women over 50 years old and men over 55 – for a period of 2 years.

Professional drivers are required to undergo a medical examination every two years, and if the driver is under 21 years old - every year.

In other words, the validity period of the certificate is not equal to the validity period of the rights, it is much shorter. The real consequences of an expired medical certificate may be cases of restoration of rights in the event of deprivation or loss.

Theoretically, an expired medical certificate for drivers is an administrative offense, and this may become a reason for appropriate punishment.

Of course, this situation is rare, but you should not rely on chance: a week before the certificate expires, it is better to go through the procedure for obtaining a new one.

Administrative liability under the new law of December 28, 2013 No. 437-FZ, which comes into force after March 31, 2014.

The law defines an administrative fine for illegal examination:

  • doctors of medical commissions can be fined from 1000 to 1500 rubles;
  • officials - from 2000 to 3000 rubles;
  • legal entities – from 30,000 to 50,000 rubles.
