Medical examinations of employees in accordance with Article 213 of the Labor Code of the Russian Federation


Whom to refer

The list of workers who need to be sent for preliminary and periodic medical examinations has remained virtually unchanged. Only two changes have been made:

  • eliminated the need to refer all women who are required to undergo medical examinations to an annual examination by an obstetrician-gynecologist. Women now see an obstetrician-gynecologist only as part of a physical examination, rather than strictly once a year;
  • made a technical amendment to paragraph 23 of Appendix No. 3 to Order No. 302n. The position of a flight attendant, who must be sent for a medical examination, was replaced by the position of an aircraft on-board conductor.

Frequency of medical examination

What documents must the employee submit to the medical commission?

According to the new rules, an obligation was introduced for the employee to submit to the medical commission SNILS or a document that confirms registration in the individual (personalized) accounting system, in electronic or paper form.

In addition, the employee has the right to submit to the medical commission an extract from the medical record with the results of the medical examination. If the employee underwent medical examination less than a year ago, the medical organization can take these results into account during the medical examination.

At the same time, the employee no longer needs to submit a health passport to the medical commission. If previously the medical commission issued a health passport to the employee, and then the employee presented it to the commission at each medical examination, now the health passport has lost its meaning.

This is what the final list of documents looks like that an employee must submit to the medical commission in order to undergo a medical examination:

  • direction;
  • SNILS or a document that confirms registration in the individual (personalized) accounting system, in electronic or paper form;
  • passport;
  • the decision of the medical commission, which conducted a mandatory psychiatric examination, for individual employees.

When and who to refer to the occupational pathology center

Changes to Order No. 302n significantly change the rules for sending workers to the occupational pathology center. These rules, unlike other changes, will take effect not from the beginning of 2020, but from July 1, 2020.

According to the new rules, it was clarified that workers who have five years of work experience in hazardous working conditions (subclasses 3.1–3.4, class 4) must be sent to the occupational pathology center for the first periodic examination, and then once every five years.

Example:

When to refer an employee who works in hazardous working conditions to the occupational pathology center

Lineman Ivanov began working in hazardous working conditions in 2015. In 2020, his work experience in hazardous conditions was 5 years. He is due to undergo another periodic examination in 2021. Since this is the first periodic medical examination for Ivanov after his work experience in hazardous working conditions was 5 years, he must be sent to the occupational pathology center as part of this medical examination. Next time he should be sent to the occupational pathology center no earlier than 2026.

Workers with persistent consequences of industrial accidents need to be referred to the occupational pathology center simply once every five years.

Workers who have received conclusions on a preliminary diagnosis of an occupational disease must be sent to occupational pathology centers within one month from the moment of suspicion of a connection between the disease and the profession.

If an employee undergoes a periodic medical examination at an occupational pathology center, then the employee will need to present to the medical specialists an extract from his medical record with the conclusions of medical specialists, the results of laboratory and other tests, conclusions based on the results of a preliminary or periodic examination for previous years of work in harmful and dangerous working conditions .

Attention:

during the year of examination at the occupational pathology center, the employee does not need to be sent for a periodic medical examination to another medical organization.

In addition, according to the new rules, employees with five years or more of work experience will be allowed to undergo periodic medical examinations in mobile medical teams of specialist doctors at occupational pathology centers, including using mobile medical complexes.

Is it possible:

  • in the regions of the Far North and equivalent areas;
  • in the absence of an occupational pathology center in the locality in which the production facility is located.

Before a medical examination in a mobile medical team, workers will need to undergo diagnostic tests at medical organizations.

The procedure for conducting medical examinations of enterprise employees

Responsibility for ensuring that staff undergo annual scheduled medical examinations rests with the employer. The medical center with which the organization has an agreement forms a medical commission. A complete list of doctors is available in Order No. 302n. The procedure for conducting a medical examination is established by law.

The company's management selects a medical institution and signs an agreement with it. The terms of medical examination are selected and agreed upon after drawing up the contract.

Important! The clinic must have a license to perform diagnostic examinations of workers.

How to arrange a medical examination in an organization

The employer makes two lists:

  • contingent - a list of employees and positions;
  • name - list of personnel.

The first document is sent to the territorial Rospotrebnadzor within 10 days. The second is submitted to the medical center 2 months before the date of examination.

The executing party (medical center) that accepted the list of names must develop a calendar plan within 10 days from the date of receipt and 14 days before the medical examination. It indicates by day which specialists to see and which tests to take. The employer approves the plan with his signature and seal.

The employer draws up an order on the need for a medical examination and the order of its priority. Employees become familiar with the text of the document 10 days before the medical examination. The order reflects:

  • grounds for periodic medical examination are Art. 213, 266 and 212 TK;
  • the need to approve the list of employees and the inspection schedule;
  • medical institution where personnel are sent;
  • documents that citizens need to have in their hands;
  • obligation to maintain earnings (based on Article 139 of the Labor Code);
  • mandatory provision of a medical report;
  • a way for the heads of the employee department to familiarize themselves with the order.

The legislation of the Russian Federation does not establish a unified form of referral. The company draws it up randomly and hands it to the employee.

Having a referral for a medical examination from the employer, a passport, company representatives come to the medical center with which the company has an agreement. During the period when diagnostic measures are carried out, employees retain their average salary.

Medical examination costs

The employing company compensates 100% of the personnel costs for undergoing the inspection. During the period of the survey, employees retain their average earnings. At the end of the event, employees must hand over the medical book to the employer.

Depending on the region, management pays the medical center 1,500-5,000 rubles, but most companies give a discount. The state compensates part of the funds through the Social Insurance Fund.

The employer also pays for a medical examination upon hiring. If an employee independently paid for the services of specialists, he is entitled to a refund. To do this, you will need to write an application and attach payment receipts.
