Maternity capital can be used to pay for the services of raising a child, servicing his household needs, ensuring personal hygiene, and food. The operating hours of a preschool educational institution (DOW) may be different, and accordingly, the range of services provided varies:

2. The duration of a child’s stay in preschool is up to 5 hours (one meal, a walk of 60 minutes, no sleep break).
3. The duration of a child's stay in a preschool educational institution (preschool educational institution) is more than 5 hours (meals 3-4 times, sleep, walk 60 minutes).

From January 1, 2018, it is allowed to finance preschool education and upbringing, including the maintenance of a child in kindergarten, through the use of maternity capital, without waiting for the child to reach the age of three.

Thanks to the rules developed by the Government of July 14, 2014 No. 648, in addition to paying for college or university studies, it has become a reality that this benefit can also be used for services for the maintenance, supervision and care of children in a preschool educational organization (PEO).

To direct maternity capital for this purpose, you should contact the Pension Fund with an agreement, which must be signed between the certificate holder and the management of the kindergarten. Not only public but also private institutions are allowed to pay for services. At the same time, maternity capital is successfully used to pay for the education of several children at once.

Does maternity capital cancel receiving compensation?

The question of whether parents have the right to established compensation if they pay for kindergarten using maternity capital funds is very relevant.
In most cases, the right to compensation is stated directly in the concluded contract. To avoid possible misunderstandings, citizens should clarify this point in advance, before submitting documents to the Pension Fund. Read also: Maternity capital in 2021

Who exactly has the right to receive a compensation payment is specified in Part 5 of Article 65 of Federal Law No. 273. Part of the funds paid for care and supervision is returned to the parents. Currently, the regulation establishes the following refund percentage:

1. 20 per 1st child.
2. 50 on the 2nd.
3. 70 for the 3rd and subsequent children.

The bottom line is that parents do not directly pay on their own when using maternity capital funds. The money under the certificate is transferred from the federal treasury of Russia, as well as compensation payments.

The transfer of funds from the certificate account to maternity capital is carried out under the following conditions:

• the money will be transferred directly to the kindergarten, parents will not receive it in cash;
• money can be spent simultaneously on the education of several children in a family, not only on the child who is entitled to maternity capital.

1. Choose a kindergarten that is accredited and complies with the conditions of the law on maternity capital.
2. Conclude an agreement for the provision of kindergarten services to the child’s parents.

The contract for the provision of services must indicate the basic terms of payment and operation of the kindergarten, namely:

• a current account to which funds must be transferred at a strictly established time;
• the amount of money that must be paid each month/quarter/year (not the amount of payment per day);
• list of services provided by the preschool educational institution, length of stay of the child;
• parties to the agreement (administration of the preschool educational institution and the owner of the certificate for maternal capital).

• Municipal, paid for from federal or local budget funds.

• Private, requiring payment exclusively from the parents.

Employees of educational organizations are obliged to ensure proper order in preschool institutions in accordance with sanitary and epidemiological standards:

• Providing water supply.

• Passing medical examinations for employees.

The time spent by children in a preschool institution should be organized accordingly:

• If a child has to be in the kindergarten for more than 5 hours, he needs 3 or 4 meals a day, sleep and a walk.

Possibility of paying for kindergarten

The amount of maternity capital in 2021 is 453,026 rubles. It is issued to families in which, since 2007, a second child has been born (adopted), or a third, fourth and subsequent ones, if maternity capital was not registered at the birth or adoption of the second child.

These funds can be spent on purchasing a home, on a child’s education, on a mother’s pension, or on the social adaptation of a disabled child, if there is one in the family.

An application for disposal of maternity capital to pay for kindergarten can be submitted at the Pension Fund office, at the MFC, as well as in the Personal Account on the Pension Fund website or on the government services portal.

The agreement must be concluded with the owner of the maternity capital certificate. There is no need to present a certificate for maternity capital, but the details of the certificate must be indicated in the application.

A certificate of regional maternity capital is issued by the “Department of Social Protection of the Population of the District/City” at the place of residence.

Copies of documents, the accuracy of which is not certified by a notary, are submitted with the presentation of the original.

In order for the Pension Fund to approve the allocation of money for a child’s preschool education, you need to prepare documents. To do this, parents must enter into an agreement with the administration of the preschool organization. The main issue in the contract will be the issue of funds that will be used for the maintenance and education of children. An additional agreement with the following information is attached to the document:

• Date and place of signing.
• Name of institution, address, full name. manager, license availability, contact numbers, bank details.
• Personal data of the parent with whom the contract is concluded.

After the administration agrees to pay for the kindergarten with maternity capital funds, the owner of the certificate applies to the Pension Fund with an application for disposal of this benefit or part of it. The application form is issued by the territorial body of the Pension Fund of the Russian Federation at the place of registration or actual residence. The following list is attached to the application:

• Identification.

• Insurance pension certificate (SNILS) of the certificate holder.

• Transfer of a child to another kindergarten. It is required to write an application to terminate the transfer of parental capital to the educational organization specified in the agreement.
• Upon the death of a child. In this case, a request is sent to refuse to transfer funds, indicating the reason.

The remainder after the amounts paid for child support are returned to the Pension Fund budget. This should be indicated in an additional agreement between parents and the head of the kindergarten.

The use of a certificate for settlements with preschool organizations expands the possibilities of parents for guaranteed payment for services for the maintenance and education of children. Additional advantages:

• Queues at municipal preschool institutions are being significantly reduced.
• There is a possibility that the parent will return from maternity leave as soon as possible.

Despite the fact that paying for such services using allocated funds is convenient and profitable, there are a number of features and limitations. It is prohibited to cash out funds from the certificate. Such an action has been declared illegal. Payment for kindergarten should be made exclusively by transferring funds from one account to another.

According to the legislation of the Russian Federation, parental capital can be used to settle payments with any educational institution that has the appropriate license. A private kindergarten is obliged to make a clear distinction between maintenance and training services. In addition, accreditation of educational programs must be obtained. If it is not there, the institution will only be allowed to work on the maintenance, care and supervision of the child.

As for the provision of paid educational services by private entrepreneurs based on certificate funds, this issue is under discussion. The activities of such persons must be carried out with the required permits and legal status.

Individual entrepreneurship must comply with the following rules:

• You can carry out educational activities if you have a state registration document.
• To attract third-party teachers and transfer teaching responsibilities to them, an appropriate license is required.

In practice, individual entrepreneurs do not seek to obtain a license to conduct educational activities, since by law they are not required to have one. Therefore, many individual entrepreneurs are denied the right to provide educational services using parental capital.

Parents have the right to receive compensation for paying for preschool institutions from the local budget. This is established by current legislation. The state thus supports young families and provides them with additional financial assistance. The amount of compensation is usually fixed in regional acts. Traditionally, payments make up a certain percentage of earnings, not lower than the following parameters:

1. for the first child – from 20%;
2. for the second child – from 50%;
3. on the third and subsequent ones – up to 70%.

In these cases, parents do not receive monetary compensation. Its size is immediately calculated minus compensation.

The amount of fees charged to parents is determined by the founder of the preschool educational institution. This is traditionally the municipality. The maximum amount is established by the financial instructions of the constituent entities of the Russian Federation in whose territory this entity is located.

In accordance with Art. 65 of Law No. 273 of December 29, 2012 establishes sources of funds for preschool institutions.

• Care, maintenance and supervision of children is provided for a parental fee.
• The educational process is paid for by the regional budget.
• The maintenance of the institutions' property is entrusted to the local financial institution.

The founder has the right to reduce the size of the mother payment or not take it at all from a certain group of people. For example, the fee is not charged for children from the following categories:

• Left without parental care.
• Are disabled.
• Suffering from tuberculosis intoxication.

From the moment of submitting the application until the actual transfer of money from funds. capital can take quite a long time, about 2 months. Therefore, you should agree with the head of the kindergarten in advance to avoid delays.

Funds are transferred not in full, but in parts. This is done based on the payment schedule established in the original agreement. The application indicates for what period the payment is made, for example, for 6 months or for a year.

In case of termination of the agreement ahead of schedule, the balance of the amounts paid will be returned. Money is not returned if children are temporarily absent from kindergarten due to illness.
