Regulations on the procedure for conducting self-examination

The procedure for conducting self-examination was changed back in 2020 - the reporting period was changed and a new deadline for submitting the document was approved (Order of the Ministry of Education and Science dated December 14, 2017 No. 1218). But self-survey reports show that not all schools are complying with the new rules yet. Thus, the reporting period is often taken to be an academic year rather than a calendar year. For example, “Report on self-examination of MBOU School No. 1 for 2016–2017” instead of “Report on self-examination of MBOU School No. 1 for 2020.” Due to this error, the information in the report and data on the school's performance are distorted. To avoid such errors, report changes to the team that is preparing the report. The easiest way to do this is to consolidate the changes in a local act.

Some experts believe that it is unnecessary to prescribe the procedure for self-examination in a local act. After all, it is approved by the Ministry of Education and Science (clause 3, part 2, article 29 of the Federal Law of December 29, 2012 No. 273-FZ). The director is asked to reflect organizational issues, including the deadline and reporting period, in the order. But it is inappropriate to annually consolidate information in the order that does not change. Therefore, it is better to include them once in the local act on the procedure for conducting self-examination.

What needs to be changed in the local act

Now the reporting period for self-examination is the previous calendar year, and not the academic year (clause 7 of the Procedure approved by Order of the Ministry of Education and Science dated June 14, 2013 No. 462). This means that in 2019 it is necessary to analyze the school’s activities for 2020. In the self-examination report, schools must include data for two half-years of different academic years: from January 1 to August 31, 2020 - this is the second half of the 2017/18 academic year, and from September 1 to December 31, 2020 - this is the first half of the 2018/19 academic year of the year. The table on school performance indicators must be completed as of December 31, 2020.

Now the report must be submitted to the founder and posted on the school website no later than April 20. Previously, this had to be done by September 1. If there is no report on April 20, the director will violate the rights of citizens to receive reliable information about the school and its activities (Part 2 of Article 5.57 of the Administrative Code).

    School Admission Rules

    Now, in order to enroll a child in school, you need to accept an application from the parents to choose the language of instruction and the native language for study. The Ministry of Education added this new requirement to the Procedure for Admission to School and the Procedure for Transferring Students. Thus, the documents were brought into compliance with the latest edition of Article 14 of the Federal Law of December 29, 2012 No. 273-FZ.

    What needs to be changed in the local act

    In the local act of the school, for example, the Admission Rules, stipulate that parents are obliged to choose languages ​​for teaching and learning as their native language. They must choose them from the list offered by the school. The list may include any language from among the peoples of Russia, including Russian. To exercise the right, parents must submit a written application addressed to the director (clause 10.1 of the Procedure for admission to school, clause 10.1 of the Procedure for transferring students, part 6 of article 14 of the Federal Law of December 29, 2012 No. 273-FZ).

    Sample wording for the section “Organization of admission to training”

    It should contain a list of documents that are placed at the stand or on the website before the start of the reception. This list must be supplemented with a statement about the choice of language. It is also necessary to add a clause that secures the right of parents to choose the form and language of instruction and elective courses before graduating from school.

    Sample wording for the section “Admission to basic general education programs”

    It only needs to be supplemented with one wording. It stipulates that you can choose the language of instruction and your native language only upon application. The application form is approved by the director.

    Examples of orders on the introduction of local regulations

    The forms and types of orders for the introduction of LNA depend on their purpose. Types of local regulations include:

    • staffing table (Article 57 of the Labor Code of the Russian Federation);
    • shift schedule (Article 103 of the Labor Code of the Russian Federation);
    • division of the working day (Article 105 of the Labor Code of the Russian Federation);
    • documents defining the procedure for processing personal data, job descriptions of employees of the organization (Articles 86, 87, 88 of the Labor Code of the Russian Federation);
    • regulations on internal structures and divisions;
    • rules and instructions on labor protection (Article 212 of the Labor Code of the Russian Federation);
    • regulations on remuneration, types and amounts of incentives, bonuses of an incentive and compensatory nature (Article 135 of the Labor Code of the Russian Federation);
    • internal regulations of the enterprise (Articles 56, 189, 190 of the Labor Code of the Russian Federation);
    • charters and regulations on discipline (Article 189 of the Labor Code of the Russian Federation);
    • vacation schedule (Article 123 of the Labor Code of the Russian Federation).

    When drawing up orders of local regulations, you can use the provisions of GOST R 6.30-2003, adopted by the Decree of the State Standard of the Russian Federation 3.03.2003 art. No. 65. According to this provision, for the preparation of documents, except for letters, a form is used that contains the following information:

    • form and name of the organization in accordance with the constituent documents, including full and abbreviated name;
    • name of the type of document after the name of the organization (order, regulation, instruction);
    • date of registration (approval) and document number;
    • place of document preparation;
    • composition of the document - general provisions, main part and final provisions;
    • approval visa, if any;
    • a note about attachments at the end of the document;
    • details with the name of the position, signature and its transcript of the manager.

    Conclusion

    Approve the local act by order, protocol, resolution or other document. If you decide to put the act into effect by order of the manager, then draw it up in any form. In the order, indicate the date of entry into force of the local act and the details of the approved document.

    Get ready to change the Catering Regulations

    We approved the Methodological Recommendations on Baby Nutrition (MP 2.4.5.0131–18. 2.4.5, approved by the Chief Sanitary Doctor on August 10, 2018). The document was developed on the basis of current SanPiN and technical regulations of the Customs Union. It can be used as a supplement to sanitary standards and regulations. For example, the guidelines establish rules for monitoring nutrition in schools. It must be carried out daily and a report must be compiled at least once per academic quarter.

    Methodological recommendations were developed in accordance with the current SanPiN, but at the same time Rospotrebnadzor prepared new Sanitary and Epidemiological requirements for the organization of children's nutrition. The document was published on the federal portal of draft regulatory legal acts. There is a high probability that the new Sanitary Regulations and Regulations will be adopted before the new academic year. To avoid editing local acts twice, wait until the new document is accepted.

    Get ready to change the Anti-Corruption Regulations

    The government approved the Program for Anti-Corruption Education of Students for 2020 (Government Order No. 98-r dated January 29, 2019). However, it is too early to change your school situation. After all, the new Program does not contain specific instructions for schools. So far, only the Ministry of Education has been tasked with developing the Concept of Anti-Corruption Education.

    Before this time, conduct an audit of the school’s local anti-corruption acts. To do this, create a commission of at least three employees. Instruct them to study the updated Methodological Recommendations for the development and implementation of measures by organizations to prevent and combat corruption. This document is posted on the Ministry of Labor website.

    However, excessive quoting of Methodological Recommendations or other regulations should be avoided. Instead, we need to analyze the corruption risks in the school. Determine the circle of employees who may face corruption risks and conflicts of interest, for example, accepting a bribe, using their official position for personal gain. Then we need to identify measures that will help reduce such risks, and see whether the school regulations contain an indication of such risks and preventive measures.

    How to change a local act

    Make changes in the same order in which you adopted the local act. Most often this is done with an approval stamp or an order approving a local act. The director adopts and changes local acts. However, he has the right to transfer this authority to another person - a deputy, the head of a structural unit. The main thing is to obtain his consent and formalize the transfer of authority.

    When a collegial body adopts local acts, it does so within the limits of its powers and only in cases that are enshrined in the charter. And the head of a structural unit must act within the limits of authority on the basis of the power of attorney issued to him by the director.

    If a new local act is adopted to replace the old one, include in the approval order a clause stating that the old document has lost force. Please provide the details of the local act you are canceling in full. At the same time, check that changes and new local acts do not worsen the situation of students and workers in comparison with legislation, collective agreements, agreements (part 4 of article 30 of the Federal Law of December 29, 2012 No. 273-FZ, part 4 of article 8 of the Labor Code ).
