A mandatory medical examination includes examination by a neurologist, otolaryngologist, surgeon, ophthalmologist and gynecologist (for women), as well as fluorography and a general analysis of urine and blood. Managers of some enterprises have the right to demand that clinics with which they enter into an agreement to conduct professional examinations add other doctors to the general list, for example, specialists in drug addiction or skin diseases, etc. The list of required analyzes can also be expanded at the request of the enterprise.

For those who get a job in government agencies, it is necessary to undergo examination by only two doctors - a narcologist and a psychiatrist. Physical disabilities are not considered an obstacle to work in government agencies, and therefore are not required to be examined by other medical professionals.

What it is

A medical certificate is a medical document containing brief information about a person’s health status (past diseases, vaccinations, blood pressure, height, weight, level of physical development, etc.).

The need to obtain such a document may be due to various reasons.:

  1. In some professions there must be a guarantee that workers are completely healthy. Examples would be doctors or chefs.
  2. In other cases, certain requirements are imposed to ensure that employees can perform at the required level. Here we can cite drivers as an example.
  3. There is another important reason. There are diseases that are social in nature. Once such diseases included tuberculosis. It is necessary to carry out prevention and diagnosis of such diseases as widely as possible throughout the country. A pre-employment medical examination is one of the opportunities to cover as many of the population as possible with these measures.

A medical certificate may be required both upon entry to work and on a regular basis at certain intervals.

The legislation stipulates that certain categories of citizens must undergo a medical examination and provide the employer with an appropriate medical certificate.

This may be necessary in the following cases:

  1. If citizens who are under 18 years of age are employed.
  2. Those who work in difficult and unhealthy working conditions.
  3. People whose profession is directly related to transport.
  4. Those who work in the catering industry.
  5. This certificate must also be provided to trade organizations.
  6. Employees whose professions relate to the food industry.
  7. Doctors and other workers whose work responsibilities relate to the medical and preventive industry.
  8. Those who work to maintain waterworks.
  9. If a person wants to work in any children's institutions, he is required to undergo a medical examination and provide a certificate.

There are also other cases when a certificate is necessary.

“Legal exemption from military service!”

“Get your military ID and sleep well!”

“We’ve been helping conscripts for 20 years!”

Upon reaching the age of 17, each young man registers with the military and receives a registration certificate after passing a primary medical examination.

Already at this stage you should know how and when you are drafted into the army after a medical examination. This knowledge will allow you to feel more comfortable during the conscription campaign, when the young man turns 18 years old.

Conscripts are those who receive summonses from the military registration and enlistment office during the conscription campaign.

Expert opinion

Only a representative of the commissariat or another authorized person can serve a summons for conscription into the army. The document is handed over personally and signed by the future conscript. After receiving the summons, the conscript is obliged to appear at the military registration and enlistment office at the appointed time to undergo a medical examination and other verification activities.

Before being drafted into the army, a conscript is thoroughly checked for physical and psychological professional fitness for service. As a result of the military medical commission, the young man is assigned a health group: A or B in case of suitability for service; category B with further transfer to the reserve; group D, which gives a deferment from service for health reasons for a period of 6 to 12 months; in category D, the conscript is exempt from further military service.

In addition, a young man may have serious reasons for receiving a deferment from the army. For example, health category “G” assigned during a medical examination or full-time training at institutions of higher or secondary vocational education.

If the conscript does not have any obstacles to the army, then a date and time are set when he is obliged to report to the military registration and enlistment office, collecting the necessary things.

The conscript must appear at the military registration and enlistment office at the specified time and date. Young guys are sent for assignment some time after the medical examination. The waiting period can range from several days or weeks to 2–3 months.

Before being sent to the assembly point at the military commissariat, the registration certificate is taken away, and in return they are issued a military ID, which is the second most important document for any person liable for military service. Next, all conscripts are sent by bus to the distribution point according to the types of troops.

After the recruits arrive at the recruiting station, the following is carried out:

  • registration of a conscript with subsequent issuance of a personal file;
  • checking personal belongings;
  • medical checkup;
  • issuing uniforms and other equipment;
  • passing the military commission recruiting the troops.

After the conversation, the conscripts are grouped in accordance with the order for their assignment to certain types of troops and are sent to military units to undergo training for the army.

The training stage lasts no more than 2 months, after which the recruits are sworn in.

Expert opinion

Grigoriev Pavel Kirillovich

Head of the department for conscription of citizens for military service of the Russian Federation

An oath is a soldier's solemn oath of allegiance to his homeland. It is from this point that the main period of military service begins after the training stage.

Important! Before taking the oath, the recruit is exempt: from performing combat missions, even during periods of general mobilization and armed conflicts; disciplinary punishment in the form of arrest; carrying weapons and driving military equipment.

After taking the oath in the army, a weapon is assigned to the soldier. He is considered a full-fledged defender of the homeland, has the right to take part in solving training and real combat missions under the orders of the commanding officer. After taking the oath, you can only be discharged from the army for health reasons or demobilized after completing military service.

Expert opinion

Validity period of the medical certificate

Certificate 086/у is valid for 6 months. Certificate 001-ГС/у is valid for 12 months.

In some cases, the validity period of the certificate may not be taken into account by human resources departments. For example, during the validity period of the certificate, a person could get sick or undergo surgery - and then his certificate will be canceled, even if six months have not yet passed from the time it was issued.

If a certificate was issued for employment in one organization, but is presented to another (for example, the candidate was unable or did not want to get a job in the first organization), then many personnel departments require a re-examination, that is, obtaining a new document. In this case, the validity period of the certificate also does not matter (even if it was issued yesterday), since different organizations have different working conditions and their own requirements.

The procedure and timing of medical examinations for representatives of various professions

All employees who, by the nature of their professional activities, are required to have a personal medical record must undergo periodic medical examinations.

The timing of medical examinations for employees of different enterprises and institutions varies. The volume and frequency of medical examinations is regulated by order of the USSR Ministry of Health dated No. 555

Who pays and reimburses the cost of a medical examination and medical certificate?

Who pays and reimburses the cost of a medical examination and medical book
If a medical examination is required at the legislative level, payment for the employee’s participation in such events falls on the employer. It doesn’t matter what type of inspection it is: preliminary, regular. There are several options for such payment, for example, entering into an agreement with a medical center or the employee paying for medical services on his own and then providing the employer with a check.

During the examination, a medical record is issued for each citizen. This is a mandatory document that records the results of the examination and the conclusions of specialists. Forms of personal medical records belong to papers that are protected against counterfeiting by Level B. These forms are not available for sale and cannot be freely purchased. The books are issued by the territorial division of the SES based on applications received from enterprises.

If an employee is required to undergo medical examination, then issuing a medical record is the responsibility of the employer. Like a work record, a medical record book must be kept at the enterprise where the person works. It is issued to a citizen only for the period of inspection. To control the safety of this document, a special journal is created.

Frequency of passage and sample documents

Such rules are usually established for specific professions. The enterprise is responsible for regular medical examinations .

For office workers, for example, this frequency is once every 2 years . For other professions the rules may be different.

The certificate must indicate the reason for its preparation , as well as the institution for which it was prepared.

Filling is done with a dark blue or black ballpoint or ink pen.

In addition to the round seal of the therapist, there should be two more: a triangular mark indicating that the citizen has undergone a fluorographic examination and the official seal of the medical institution.

Questions and answers

When applying for a job, the employee did not provide receipts for payment of the medical examination.
After 4 months the employee was fired. After 3 months after his dismissal, he came and wrote an application for payment of a medical commission. Are we obligated to pay? Expert:

Elena!

Workers engaged in work with harmful and (or) dangerous working conditions (including underground work), as well as in work related to traffic, undergo mandatory preliminary medical examinations to determine the suitability of these workers to perform the assigned work and prevent professional diseases. In accordance with medical recommendations, these employees undergo extraordinary medical examinations.

In accordance with paragraph 7 of Article 213 of the Labor Code of the Russian Federation, medical examinations and psychiatric examinations are carried out at the expense of the employer.

But in order to pay for the preliminary medical examination, the employee had to write a corresponding application and attach all original receipts. For some reason, the employee did not contact the employer during the entire period of work, therefore the employer had no reason to pay for a medical examination.

In this case, the employer has the right not to pay for the preliminary medical examination, since 3 months have already passed since the dismissal

The employee, during this period, had to send a letter to the employer demanding payment for a preliminary medical examination, and in case of refusal, file a claim in the district court at the location of the defendant (employer).

How much time is given to an employee to undergo an annual medical examination? Is it necessary to return to work after the medical examination?

Expert:

The labor legislation of the Russian Federation does not provide a time frame (deadlines) for undergoing an annual medical examination.

The employer has the right to establish in a local regulatory act the employee’s obligation to return to work. By virtue of Part 1 of Art. 8 of the Labor Code of the Russian Federation, the management of an organization (employer) has the right to adopt local regulations within the limits of its powers.

Employers, with the exception of employers - individuals who are not individual entrepreneurs, adopt local regulations containing labor law norms (hereinafter referred to as local regulations), within their competence in accordance with labor legislation and other regulatory legal acts containing labor law norms , collective agreements, agreements.

Does an employer have the right to demand an employee’s health passport or a copy of it?

Sincerely, Irina.

Expert:

One health passport is maintained for each employee. During the examination, the health passport is stored in the medical organization. At the end of the examination, a health passport is issued to the employee.

If an employee loses a health passport, the medical organization, upon the employee’s application, issues him a duplicate health passport.

The results of further periodic medical examinations of the employee are recorded in the employee’s medical record and health passport .

Thus, a health passport is a document intended for the purpose of preserving the history of an employee’s medical examinations.

According to clause 9 of the Procedure for conducting mandatory preliminary (upon entry to work) and periodic medical examinations (examinations) of workers engaged in heavy work and work with harmful and (or) dangerous working conditions, upon entry to work, the employer sends employee for a preliminary medical examination at a medical organization licensed to conduct medical examinations (preliminary and periodic).
To undergo medical examination, the employee, among other documents, must submit a health passport to the medical organization.
Thus, when applying for a job, if you were given a referral to undergo a medical examination, then you must present it.

Please tell me the validity period of the medical certificate. The certificate was issued in 2020 for a driver of category B - a passenger car. I found answers on the Internet, they are dated 2010, 2014. terms where 3 years where 2. (If possible, then with reference to regulations so that later you can appeal something to our officials)

Expert:

Ivan. It is not clear for what purpose you underwent medical examination. inspection. If you work as a driver and have undergone a periodic medical examination, then its frequency is once every 2 years (i.e. the certificate is valid for 2 years from the date of issue). This is stated in paragraph 27 of Appendix No. 2 to Order of the Ministry of Health and Social Development of Russia dated April 12, 2011 N 302n “On approval of lists of harmful and (or) hazardous production factors and work, during the performance of which mandatory preliminary and periodic medical examinations (examinations) are carried out, and The procedure for conducting mandatory preliminary and periodic medical examinations.”

There is an exception: according to clause 17 of the Inspection Procedure, employees under the age of 21 undergo periodic inspections annually.

I got married, changed my last name and decided to change my license, collected all the documents, went to the traffic police and then they told me that my certificate (date of issue November 2012) is not valid, they say it is expired according to the new Federal Law of December 28, 2013 N 437-FZ 2 years.

When I passed the medical examination in 2012, my certificate was valid for 3 years, that is, it is valid until November 2020, because... I am an amateur driver, not a professional.

I re-read 437-FZ and there, in paragraph 1 of Article 23, the deadline is indicated exclusively for professional drivers:

mandatory preliminary, periodic (at least once every two years), pre-trip and post-trip medical examinations;

and then in paragraph 3 of section 23 there is a transcript:

3. Mandatory preliminary medical examinations are carried out for persons hired as vehicle drivers.

Mandatory periodic medical examinations are carried out during the entire time a person works as a driver of a vehicle.

Mandatory pre-trip medical examinations are carried out during the entire time a person works as a driver of a vehicle, with the exception of drivers driving vehicles traveling on calls from emergency services.

Mandatory post-trip medical examinations are carried out during the entire time a person works as a driver of a vehicle, if such work involves the transportation of passengers or dangerous goods.

As far as I understand, the validity period of certificates for amateur drivers is not specified. Am I right? I want to go to the traffic police and defend my point of view.

Expert:

You only need to defend that the law does not have retroactive force and only applies to medical certificates that were issued after this law came into force. The traffic police are deceiving you.
