The procedure for issuing certificates of incapacity for work was approved by Order of the Ministry of Health and Social Development of Russia dated June 29, 2011 N 624n (hereinafter referred to as the Procedure).

The issuance and extension of a certificate of incapacity for work is carried out by a medical worker after examining the citizen and recording data on his state of health in the medical record of an outpatient (inpatient) patient, justifying the need for temporary release from work (clause 5 of the Procedure).

When a citizen is discharged after inpatient treatment, a certificate of incapacity for work is issued on the day of discharge from the hospital for the entire period of inpatient treatment. If temporary incapacity for work continues, the certificate of incapacity for work can be extended up to 10 calendar days (clause 19 of the Procedure).

If the period of temporary incapacity for work exceeds 15 calendar days, the issue of further treatment and the issuance of a certificate of incapacity for work is carried out by a medical commission (clause 13 of the Procedure).

The continuation of the temporary disability certificate issued to the initial certificate relates to one insured event (Letter of the Federal Social Insurance Fund of the Russian Federation dated August 18, 2004 N 02-18/11-5676).

According to clause 60 of the Procedure, in the column “Position of a doctor” of the table “Exemption from work”, the position of the doctor is indicated, and in cases considered by the medical commission, the chairman of the medical commission. In the column “Doctor’s signature” the signature of the attending physician and the chairman of the medical commission is placed upon each extension of the certificate of incapacity for work by decision of the medical commission.

Thus, if the sick leave is a continuation of the first certificate of incapacity for work, this case will be considered one insured event of temporary disability. Since the second sick leave was issued on the 16th calendar day, the decision on further treatment and the issuance of a certificate of incapacity for work is carried out by a medical commission; accordingly, this sick leave must bear the signature of the chairman of the medical commission.

If a medical organization makes a mistake when filling out a certificate of incapacity for work, then the document is considered damaged and a duplicate is issued to replace the damaged one (clause 56 of the Procedure).

Accepted certificates of incapacity for work that contain errors may lead to a refusal to reimburse or to the Social Insurance Fund of the Russian Federation accepting expenses as offset against the payment of the organization's insurance premiums (clause 18 of the Regulations on the Social Insurance Fund of the Russian Federation, approved by Decree of the Government of the Russian Federation of February 12, 1994 N 101, Subclause 3, Clause 1, Article 11 of the Federal Law of July 16, 1999 N 165-FZ “On the Fundamentals of Compulsory Social Insurance”).

Thus, in the case under consideration, the sick leave certificate, which does not have the signature of the chairman of the medical commission, is considered to have been filled out with an error and is considered damaged.
