The procedure for conducting mandatory preliminary and periodic medical examinations is determined by the Order of the Ministry of Health and Social Development of the Russian Federation dated April 12, 2011.
No. 302-N “ On approval of lists of harmful and (or) dangerous production factors and work, during the performance of which mandatory preliminary and periodic medical examinations (examinations) are carried out, and the Procedure for conducting mandatory preliminary and periodic medical examinations (examinations) of workers engaged in heavy work work and work with harmful and (or) dangerous working conditions” (hereinafter referred to as the Order). According to Order No. 302-N, workers engaged in trade, incl. non-food products, are required to have personal medical records, are subject to preventive medical examinations upon entry to work and subsequently - once a year (in accordance with Appendix 2, clause 15).
According to Order 302-N, data on medical examinations must be entered into personal medical records (Appendix No. 3, clause 33). During inspections, personal medical records must be located in a place that allows them to be provided upon request during the inspection.
According to Art. 213 of the Labor Code of the Russian Federation and Art. 34 of the Federal Law of March 30, 1999
No. 52-FZ “On the Sanitary and Epidemiological Welfare of the Population”, the responsibility for organizing preliminary and periodic examinations of workers rests with the employer; individual entrepreneurs and legal entities are obliged to provide the conditions necessary for timely medical examinations of workers.

A dispute has reached the Supreme Court of the Russian Federation regarding the legality of bringing an employer to administrative liability for failure to conduct mandatory medical examinations of employees.
The organization was fined by the state labor inspector due to the fact that the regional sales manager, as well as the head of the logistics and pricing department and a specialist from the same department were not sent to undergo a medical examination.
The mandatory medical examinations for these employees was explained by the fact that the employer’s main activity was the wholesale trade of machinery, equipment and accessories. And by virtue of the provisions of the order of the Ministry of Health and Social Development of the Russian Federation dated April 12, 2011
No. 302n, work in public catering organizations, trade, buffets, catering units, including in transport, is included in the list of works during the performance of which mandatory preliminary and periodic medical examinations (examinations) of workers are carried out (Resolution of the Armed Forces of the Russian Federation of December 6, 2020 No. No. 34-AD17-5).
The employer believed that the relevant norm applies only to organizations whose activities are related to the sale of food products. In addition, workers whose medical examinations were not organized were engaged in administrative work and were not directly involved in the sale of products.
The court rejected these arguments, pointing out that the requirement to conduct medical examinations for workers employed in trade organizations applies to all trade workers, regardless of the type of products sold.
Let us note that Rospotrebnadzor has previously repeatedly expressed the opinion that there is no obligation to undergo medical examinations for employees of organizations selling non-food products (information dated July 28, 2020, letter dated June 5, 2013 No. 09-5228-13-16). But specialists from Rostrud and FMBA of Russia hold the opposite point of view.
For seller of non-food products
Those who want to get a job as a salesperson are concerned with the following questions: does a seller of non-food products need a health book, or does a clothing seller need a health book.
Do sellers of manufactured goods need health certificates?
Undoubtedly, the answer to this query is yes. There is a common point of view that employees in non-food sales should not receive it.
But a health certificate is a document that any trade employee is required to draw up, regardless of his job responsibilities and other local work issues.
Obtaining a health certificate is necessary for the sale of perfume products; sales of non-food children's products; work in thrift stores and “second-hand” and so on.

The obligation for sales employees to undergo medical examinations is regulated by a significant number of official documents existing in the Russian Federation. Based on Art. 213 of the Labor Code of the Russian Federation, sales employees must carry out the necessary preliminary (upon acceptance for a position) and systematic medical examinations.
This is necessary in order to preserve the health of citizens and prevent outbreaks and transmission of infections. These requirements guarantee the safety of public health, because it often depends on the condition of employees in the service sector. Obtaining medical books for sellers of industrial goods is much simpler and includes a visit to a therapist and fluorography.
Relevance dates for results
An enterprise employee must undergo a medical examination and enter data into a medical record book once a year . The results are valid (or their validity period is valid) for 12 months , with the exception of the staphylococcus test, which must be taken every 6 months .
