Certification and qualifications

Periodic certification, regardless of the profession or the specifics of the organization’s activities, is of two types:

Example: in reference book No. 37, for the position of “engineer” there are four qualification positions:

Qualification categories of individual professions

For representatives of certain professions, obtaining a qualification category without certification is impossible. These are government officials, teachers, doctors, prosecutors and a number of others.

Legal basis for issuing an order

The amount of an employee's salary directly depends on his level of qualifications. According to Art. 143 of the Labor Code of the Russian Federation, the degree of training and skills of an employee is equated to a certain qualification category, in accordance with which the amount of remuneration is established.   • what tariff scale does it fall under;
  • what tariff rates and coefficients are taken into account when calculating salaries.

Types of categories for workers must be assigned in accordance with the Unified Tariff and Qualification Reference Book (ECTS) approved by the Government of the Russian Federation.

There are several ECTS issues that establish the qualifications of workers in various fields (metallurgy, construction, mining). Some of the issues were developed back in 1984 and are still in effect.

Enterprises must organize a procedure for assigning qualification categories to specialists. To do this, the employer must:

  • create a special commission, which includes representatives of all work shops, as well as personnel, accounting and legal services;

  • approve the form of acts adopted based on the results of the commission’s work.

A worker who has sufficient knowledge and masters skills at a good level can be allowed to take part in the tests. Examinations are carried out on the basis of the employee’s application and his nomination to the category, signed by the head of the structural unit.

As a rule, the exam itself consists of theoretical and practical parts. The questions asked of the worker when passing the test must correspond to the list of skills provided for by the ECTS.

Based on the results of consideration of the employee’s application, characteristics from the workshop manager and the results of the exam, the qualification commission makes one of the following decisions:

  • on assigning a rank to a worker;
  • about refusal to assign a rank.

The decision is drawn up in the form of a protocol, which the employee must also be familiar with. If, by its decision, the commission comes to the conclusion that it refuses to award the worker the appropriate qualifications, the employee not only remains at the same salary, he may be fired for being unsuitable for the position held. Based on the positive conclusion of the commission, the employer issues an order to assign a qualification category to the worker.

The order must contain:

  • employer's business name;
  • date, place of document preparation;
  • full name (for example, “order to assign a rank”), serial number;
  • an indication of the legal basis for issuing the order (laws, regulations, local acts, regulations of the organization, protocols of the commission, etc.);
  • full information about the assigned rank;
  • Full name, position of the employee to whom the rank is assigned;
  • requirement to make appropriate changes to the staffing table and employment contract;
  • Full name, positions of employees responsible for making changes;

The document is submitted for signature to the head of the organization or his deputy, if he has the appropriate authority.

The officials responsible for its implementation and the workers to whom the rank is assigned must be familiarized with the order against signature. If an order is issued in relation to several employees, it is advisable to put signatures on familiarization in a separate register or familiarization sheet, which will be an integral appendix to the order.

After signing, the order must be submitted to:

  • to the HR department to make changes to the employment contract and staffing table;

Qualification directories of professions approved by the Government of the Russian Federation have been mandatory only since 2002. Until 2002, wage rates for each category were set by the employer independently. Therefore, some organizations still apply their own requirements for the level of skill of a worker of one class or another, which is contrary to current legislation.

Typical errors that precede the issuance of an order also include the following cases:
