The Regulations on the issuance of workwear (hereinafter referred to as the Regulations) is an internal regulatory document in accordance with which PPE is issued at the enterprise.

The employer has the right to establish in the Regulations the number of kits issued not only strictly in accordance with the requirements of the law, but also in a larger amount. Additionally, the standard periods of its use can be reduced, and the use of more expensive and wear-resistant models can be established. All this depends only on the financial capabilities of the company.

For greater security, it is better to approve and agree on all conditions with the employees’ trade union committee, if such a body exists at the enterprise.

The presence of this document in the company where the workwear is to be issued is a mandatory requirement. Since it will contain all the necessary data regarding the rules and conditions for its provision, all employees during employment should be familiar with it.

According to Article 209 of the Labor Code of the Russian Federation, special clothing, shoes and personal protective equipment are means for individual use by citizens to protect against adverse production factors and pollution. Currently, the order of the Ministry of Labor dated 09.12 is in force.

2014 No. 997n, which approved the “Standard standards for the free issuance of special clothing, special footwear and other personal protective equipment to employees of cross-cutting professions and positions of all types of economic activities, engaged in work with harmful and (or) dangerous working conditions, as well as in work performed under special temperature conditions or those associated with pollution.”

It is this document that defines the procedure for fulfilling the obligation of employers to provide employees with special clothing and footwear, as well as personal protective equipment.

Such requirements are enshrined in Article 221 of the Labor Code of the Russian Federation in relation to all workers of certain professions engaged in work with hazardous working conditions, as well as in dirty work. The list of professions for which general standards for issuing PPE 2019 apply currently contains 195 specialties.

Regulations on the standards for issuing protective clothing and personal protective equipment

The requirements for providing workers with protective equipment and special clothing are enshrined in Articles 212, 221, 229.2 and 330.5 of the Labor Code of the Russian Federation (LC RF). Employers are required to issue them free of charge in accordance with established standards.

At the same time, the organization itself has the right, on the basis of an internal local act, for example an order, to reduce the interval for using PPE or increase the norms for their issuance. Employers are strictly prohibited from reducing standards.

In addition, workwear can be issued based on the results of a special assessment of working conditions (SOUT).

In addition to the norms of the Labor Code of the Russian Federation, standard norms for the issuance of workwear 2019 by profession for all sectors of the economy are enshrined in such regulatory legal acts as:

In addition, standard instructions on labor protection, as well as standards and deadlines for issuing special clothing and personal protective equipment for various sectors of the economy are regulated by separate legal acts.

In Russia, there is now a huge number of documents at the federal, regional, and industry levels, so when determining the standards for issuing free clothing and personal protective equipment, organizations must focus on all regulatory documents that are suitable for their type of activity. Paragraph 9 of the Intersectoral Rules states that every employer is obliged to inform employees about what clothes, shoes and personal protective equipment it is obliged to issue to them. This usually happens at the time of the employment contract. Moreover, it is provided for both a separate familiarization, against signature, with the standard norms of issuance corresponding to the profession, and the inclusion of these norms directly in the employment contract.

Requirements for clothing and protective equipment

Any personal protective equipment or clothing and shoes must have a certificate or declaration of conformity with TR CU 019/2011 “On the safety of personal protective equipment.” All standards are set in pieces, pairs and sets on an annual basis.

The service life of ordinary and insulated special clothing and footwear, taking into account climatic zones and zones, in Russia is established by Order of the Ministry of Labor No. 997n.

Although one employee has the right to receive one standard of protection every year, Order No. 997n provides for the possibility of simultaneously issuing him a double standard. That is, instead of two sets of suits and shoes for a year, an employee can receive four suits for two years at once.

Officials believe that this issuance procedure allows the employer to save money and the employee to correctly distribute things, which will allow them to wear out more slowly.

Standard standards for the free issuance of special clothing - 2019 for some specialties

For each profession that requires clothing from the employer, and there are 195 of them in the document, individual standards and completeness are provided. For example, a mechanic needs to be given for a year:

  • rubber boots with protective toe caps - 1 pair;
  • gloves with polymer coating - 12 pairs;
  • suit for protection against general industrial pollution and mechanical impacts - 1 pc.;
  • safety glasses - until worn out;
  • personal protective equipment for respiratory organs, filtering or insulating - until worn out.

It is noteworthy that there are standards even for those professions whose work cannot be called dangerous. Thus, a librarian is entitled to one suit to protect against general industrial pollution and mechanical impacts, which the employer can replace with a robe.

It should be remembered that all established standards for the issuance of workwear and PPE are also influenced by various additional factors.

For example, if workers work outdoors in the summer or spring, they should be provided with protection from blood-sucking insects, including suits and repellents.

When working in winter, the organization must provide warm clothes and shoes, and when working in high-noise conditions, earplugs. When working at height, special safety devices and helmets are required. All these requirements can be found in the appendices to order No. 997n.

Responsibility for failure to issue PPE and workwear

If the management of the organization has not provided the employee with free protective equipment, he has the right to refuse to perform work. In addition, the norms of the Code of Administrative Offenses of the Russian Federation provide for liability for violation of labor protection requirements in the form of a fine in the amount of:

  • for officials and individual entrepreneurs - from 20 to 30 thousand rubles for each employee;
  • for organizations - from 130 to 150 thousand rubles for each employee not provided with PPE.

For a repeated violation, the organization can be fined up to 200 thousand rubles, and its work can be suspended for up to 90 days.
