Nevertheless, there is a certain structure for an application for leave, and the legislation of the Russian Federation quite clearly defines the procedure for submitting it.

In the Labor Code of the Russian Federation, the provision of leave to all hired employees is recorded as a mandatory requirement.

Based on the application, an order is issued to provide paid vacation days. These days are recorded in the working time sheet in the form of an alphabetic or digital code:

  • “G” (“23”) to indicate the day of the act of donation;

The Labor Code of the Russian Federation does not regulate the rules for visa applications for leave, since this issue does not relate to the sphere of labor relations.

The execution of a manager’s resolution under an application for leave falls within the scope of office work standards, is carried out on a voluntary basis and is not of a regulatory nature.

Commentary on Article 134 of the Civil Procedure Code

The commented article establishes the grounds for refusing to accept a statement of claim.

According to Part 1 of the commented article, the judge refuses to accept the statement of claim in the following cases:

- if the application is not subject to consideration and resolution in civil proceedings, since the application is considered and resolved in another judicial procedure; the application was submitted in defense of the rights, freedoms or legitimate interests of another person by a state body, local government body, organization or citizen who are not granted such a right by the Code of Civil Procedure of the Russian Federation or other federal laws; in an application submitted on one’s own behalf, acts are contested that do not affect the rights, freedoms or legitimate interests of the applicant;

- if there is a court decision that has entered into legal force on a dispute between the same parties, on the same subject and on the same grounds, or a court ruling to terminate the proceedings in connection with the acceptance of the plaintiff’s refusal of the claim or the approval of a settlement agreement between the parties;

- if there is a decision of the arbitration tribunal that has become binding on the parties and was adopted in a dispute between the same parties, on the same subject and on the same grounds, with the exception of cases where the court refused to issue a writ of execution to enforce the arbitration tribunal’s decision.

The judge issues a reasoned ruling regarding the refusal to accept the statement of claim, which must be served or sent to the applicant within five days from the date of receipt of the statement in court, along with the statement and all documents attached to it (Part 2 of the commented article).

In accordance with Part 3 of the commented article, a refusal to accept a statement of claim prevents the applicant from re-filing a claim in court against the same defendant, on the same subject and on the same grounds. A private complaint may be filed against the judge’s decision to refuse to accept the application.

If you are submitting an application for transfer to another position

Next, in the middle of the line (with a lowercase or capital letter) is the word statement: if with a lowercase letter, then a period is placed after the “statement”; if with a capital letter, then the period is not placed. Next on the red line is the text of the statement. After the text on the right side there is a signature and date (the date can also be placed on the left side).

If this application is drawn up, the employee must indicate to which position he is asking to be transferred, and the date is indicated. Based on this application, the manager can express his opinion in the form of a visa on the application, or a memo can be written.

Classification

In practice, there are different types of statements. The most general classification involves the division into oral statements and appeals presented on paper or electronic media. In the latter case, the appeal may be:

  • business;
  • sent by a citizen to an organization;
  • addressed by the employee to the employer.

As a rule, the interested party submits a written application. In this case, the subject has confirmation of the fact that he spoke out on a particular issue. However, in practice, in some cases, an oral statement will be valid. For example, in court, a participant in a dispute can express his attitude to the issue, and his words will be recorded in the minutes of the meeting. In most cases, a person needs to formalize his opinion, request, proposal on a tangible medium. For example, an application to the registry office is submitted on paper.

Possible options

All statements (text) are written in free form, which sets out the reason. This text provides for the use of official business vocabulary. Possible reasons for writing a statement:

  • Administrative leave;
  • Academic leave;
  • Maternity leave;
  • Time off;
  • Vacation at your own expense;
  • For child care;
  • Vacation followed by dismissal;
  • Another vacation;
  • To be dismissed;
  • Transfer to another position;
  • Recruitment.

A “statement” is written before the text; it can be written in three versions:

  1. First: This is when all capital letters “STATEMENT” are used in writing, after which there is no period. More often, this writing is used with ready-made stencil forms, or if typed on a computer.
  2. Second: It is possible to write “Statement” with the first capital letter; this method of writing is most often used when writing by hand. There is no period after this spelling.
  3. Third: It is also possible to write “statement” in small letters; in this case, a full stop is required. This type of writing was used before, but now it is allowed and most often this type of document design is a matter of habit.
