Classification of causes of disability

Procedure for applying for benefits

The first step in applying for any category of benefits is to officially obtain the status of “disabled person.” The patient or his representative contacts the Bureau of Medical and Social Expertise for this purpose. After receiving the commission’s decision, you should contact the Pension Fund of the Russian Federation and the Department of Social Protection of the Population. Each department will be required to make a written application to receive the benefits due.

What benefits are available to parents of a disabled child?

A person under 18 years of age who has a significant disability that leads to social maladjustment may receive the status of a “disabled child.” Disturbances may relate to development, growth, movement, spatial orientation, learning, and behavior.

According to the medical and social report, the patient is prescribed:

• stay in a specialized children's institution;
• provision of necessary auxiliary means and equipment;
• training in a state special institution or at home;
• annual spa treatment.

The terms “disabled since childhood” and “disabled child” are different. The first characterizes the cause of disability, established along with the group. It is determined for citizens whose age exceeds 18 years, in a situation where disability arose as a result of injury or illness before the patient reached adulthood. The category “disabled child” includes persons under the age of eighteen who have received a disability.

Labor

When hiring parents whose children have disabilities, the employer must provide the following working conditions:

• Sick leave. Payment is possible for up to 120 days per year for each disabled child. A prerequisite is that parents are forced to stay with the minor in a medical institution or provide continuous care.
• Additional vacation days, weekends. Adoptive parents, guardians, parents have the right to 4 additional days off per month.
• Partial work week or shift. Such changes must only be agreed upon in writing. A specialist can claim a reduction in the number of working hours, a reduction in working days.
• Early retirement. According to Federal Law No. 400, exit is possible for women whose work experience exceeds 15 years and men more than 20 (regardless of their age).
• Shift work, on weekends. Possible only with the written consent of the employee.

Tax

A significant relief is the benefits for paying property taxes. In 2010 its size is:

• 12,000 rubles if the baby is adopted or is being raised by his own mother or father;
• 6,000 rubles if guardianship is established.

Deductions are provided to each family member or one working parent, but then the amount is doubled.

Transport

Currently, the federal benefit for free travel has been abolished. But some constituent entities of the Russian Federation left it in full in the form of regional assistance. In the capital, to obtain this right, a Muscovite social card is issued. Free travel within the country is provided to the child’s place of rehabilitation and back.

Relatives also receive a tax discount on car registration. The percentage is regulated by local law. Condition - the number of horsepower of the car cannot exceed 150 units. The rehabilitation and technical center provides free training in driving a vehicle in category “B”.

Housing

In a family where people are forced to care for a child with a disability, there are additional housing benefits:

• compensation of up to 50% of the fee for major repairs (the exact amount of the contribution for major repairs may vary depending on the region);
• return of 50% of the amount paid for housing and communal services;
• land plots are provided for real estate, suburban and auxiliary farming.

Families on the waiting list for a preferential house or apartment are provided with temporary housing. Priority is given to guardians of children with severe progressive illness (cerebral palsy, oncology, etc.).
