Legislative regulation

Some drivers, and even heads of organizations, consider internships to be an optional procedure, carried out solely at the request of the parties. This is mistake.

The internship is regulated by documents of the Ministry of Transport , which outline its conditions and timing.

Thus, in the “Regulations on improving the professional skills of drivers”, dated January 20, 1986, approved by the Ministry of Motor Transport of the RSFSR, and still not canceled, it states the internship of different categories of drivers, indicates the timing of it, with an exact list of activities in each case .

The persons responsible for conducting the internship and for making decisions based on its results are indicated.

Order of the Ministry of Transport of the Russian Federation No. 59 dated September 11, 2016 approves the procedure for professional selection and training of drivers .

This document is based on the norms of labor legislation and other legislative acts and represents a list of necessary conditions under which a driver can be allowed to drive a vehicle in the specific operating conditions of an enterprise.

At the same time, the legislator does not strictly regulate the hourly standards for conducting internships with this order. How long the internship is conducted and under what conditions is up to the employer to decide , based on the specific working conditions in the organization.

There is also Resolution of the Ministry of Labor of Russia and the Ministry of Education of Russia dated January 13, 2003 No. 1/29, which sparingly mentions the internship, as well as the exam after its completion. The document applies only to drivers who transport dangerous or harmful cargo , and other categories are not affected.

Who is the intern?

In what cases is internship for bus or car drivers carried out:

  1. The driver gets behind the wheel of a vehicle of this type for the first time;
  2. Starts working on a new route;
  3. I have not worked as a driver for more than one year;
  4. Has no driving experience, just graduated from training;
  5. He intends to work in difficult mountain conditions, on roads with increased danger.

Driver categories

As previously noted, the duration of the internship is determined by the head of the organization. Many of them, however, are guided in their decisions by the “Regulations on the improvement of professional skills...”, which was discussed above, and rely on the internship time standards laid down in it.

These standards are tied to categories of drivers, depending on the type of vehicle:

  • For example, an internship for a passenger car lasts 1 day, and a truck lasts 2 days.
  • For beginners, the period can be extended to a month.
  • Particular attention is paid to bus drivers , since they are entrusted with human lives on the route. The internship is divided into pre-route and route parts. Beginners in driving are trained for the largest number of hours - more than two hundred.
  • Persons who have a minor break in work , as well as those transferred from one bus to another, are trained in the range of 30 to 50 hours of total time.
  • Drivers on mountain routes may be assigned an internship of up to three months.

4 tbsp. 24 of the Labor Code, an employment contract was considered concluded even if the employee was allowed to work without a concluded employment contract. However, as of 2020, these standards are no longer in effect, and an employee cannot be allowed to work without concluding an employment contract.

1.1. This Regulation establishes the procedure for conducting internships for car drivers and allowing them to work independently. 1.2. The purpose of the internship is to improve the professional knowledge, skills and abilities of drivers in real working conditions that ensure safe driving of vehicles.

Stages of internship

First, a candidate for a position undergoes a series of instructions: introductory instruction, on labor protection, on road safety in a specific working environment. Then he goes out on the route and does his internship behind the wheel.

Instructions are carried out by external or full-time employees of the organization who have the right to conduct them, confirmed by relevant qualification documents .

Mandatory induction training for a trainee includes:

  • Information about the organization in which he plans to work.
  • Vehicle driving safety requirements.
  • The regime of work and rest in the organization, its features.
  • Passing a pre-trip inspection of the vehicle and a medical examination of the driver.
  • Information about the vehicle's carrying capacity standards and the standards for transporting passengers in the cabin. Work with preferential, special categories of citizens when transporting passengers and disabled people.
  • Informing about emergency sections of the route, becoming familiar with statistical data on accidents, in order to avoid their recurrence.
  • Training in working with trip documentation, techniques for correctly filling out waybills and other documents.

The theoretical analysis of the route is carried out by a competent employee, usually a driver-mentor, who is entrusted with the responsibility of conducting the internship. Then, under the guidance of a mentor, a trip to the line is carried out.

Driving skills are practiced in a variety of practical situations that a driver may encounter. Factors taken into account include:

  • Times of Day.
  • Weather.
  • The complexity (intensity) of the flow on the highway at different times of the day, days of the week.
  • When transporting passengers, the intensity of passenger traffic, the ability of the applicant to work in certain situations, and psychological stability in working with a large number of people are taken into account.

An important point is the practical working out of problematic issues along the route:

  • Emergency situations and their elimination.
  • Call special rescue services.
  • Elimination of minor vehicle breakdowns.
  • Working with passengers in emergency and emergency situations.

Appointment of the commission

The commission is created on the basis of an order from the head of the organization, whose members test the acquired knowledge. Its members include: the official responsible for cargo transportation (if there is one), the head of the motor depot (column), the labor protection engineer (inspector) or the head of the safe driving department. The commission group completes the inspection based on the results of a control trip along a randomly selected route and a subsequent interview.

All results are entered into a card, and a full conclusion is made, allowing access to independent work on a specific brand of transport and on a specified route. Based on the data on the card, the company issues an order allowing driving, which the trainee familiarizes himself with upon signature. If the commission does not agree with the conclusion of the driver-mentor and the test results show an insufficient level of knowledge and safe driving, it has the right to extend the internship period with subsequent retake.

Important! The card with the results of the internship is stored in the HR department. The driver has the right to familiarize himself with her data at any time and receive a corresponding notification or a copy of the document.

Master mentor

A mentor for a newcomer is chosen by the organization’s management from drivers who have been performing their duties flawlessly for a long time.

The main requirements for it are:

  1. Accident-free driving for 12 months on the internship route. Accidents that were not the fault of the mentor are not taken into account.
  2. The mentor's length of service is the most important indicator. For drivers of trucks and cars, its duration is 3 years or more. The mandatory length of service for a mentor when it comes to a bus driver is even higher. In this case, the employee will need at least 5 years before he can be entrusted with mentoring a newcomer.

When conducting an internship for the right to drive a minibus or bus, in its pre-route part, as a rule, the driver-mentor does not act alone.

Special employees of transport services , who are entrusted with supervisory functions, are involved to work together effectively .

Exam

For drivers involved in the transportation of dangerous goods, according to the new provision of the mentioned document No. 1/29, the company has the right to conduct a final exam.

The management of the organization monitors the internship process. Usually this responsibility is assigned to the chief engineer, or another employee of similar status and qualifications. The final decision on the results is made by the manager and bears full responsibility for it.

Registration of results

The main internship document (internship sheet) does not have an approved unified form . In each organization it is developed individually, and, as a rule, is included in internal regulatory documents and approved by the manager.

In addition to general information about the employee and details required for any document, the internship sheet also includes special information:

  • Information about the vehicle on which the internship was conducted (model, type, make).
  • Traffic routes, timings, features of the event.
  • Information about the master-mentor and persons supervising the internship.
  • A competent opinion from a certified specialist appointed by the supervisor, whose duty is to supervise the internship and coordinate the work of all its participants.

The internship certificate is kept in the organization for five years.

Who is responsible for road safety in the organization?

Parking of organization vehicles

  • Equipment and premises for maintenance and repair work or have a valid agreement with organizations providing parking, maintenance or repair services for vehicles.
  • Conditions for conducting pre-trip inspection of vehicles.
  • The appointment must be made with specific responsibilities for each of them included in the job description. because if you are appointed by order, but the duties are not specified in the instructions, then such an employee will not be responsible for the sector assigned to him. If your company has branches in its structure, then each branch should have three responsible persons. And the specialists of the head branch must monitor the work of the others. These are not necessarily three different employees; all duties can be performed by one person (it all depends on the size of the organization and the amount of rolling stock available). And in addition to the duties of monitoring traffic safety, he can also perform others (mechanic, dispatcher, etc.). This specialist must have a higher education diploma in the areas of “Land Transport” or work experience in a similar position entered in the work book.
