How to draw up an internal inspection report

It is not necessary to draw up a separate conclusion of the commission. But often in practice, the results of the audit are formalized in a separate expert opinion. This will not be a violation. Indicate in it:

  • date and place of registration;
  • number, subject of the contract and date of its signing;
  • information about the contractor or supplier;
  • date of delivery, completion of work or provision of services;
  • list of delivery documents and their details;
  • information about whether the product (work, service) complies with the terms of the contract;
  • expert signatures.

It is enough to indicate in the act or delivery note that the assessment has been carried out, what its result is, and sign the experts. If a product does not comply with the conditions specified in the contract, then it is necessary to indicate exactly how it manifests itself (Letter of the Ministry of Finance of Russia dated October 26, 2017 No. 24-03-08/70501).

Examples of the wording of expert opinions in the acceptance document:

“An examination of the delivered goods has been carried out. The goods comply with the terms of the contract.

The examination was carried out by: Ivanov I.I. - Head of Administrative Operations, Petrova P.P. - economist".

If the product does not meet the contract requirements, use the following language:

“The examination was carried out, the service does not comply with the terms of the contract. In violation of clause 6.2 of the Technical Assignment on January 22, 2019, the cleaning of the corridors of the first floor was not carried out in full: garbage was taken out of baskets, wet cleaning was not carried out.

Facts of violations were recorded by the video surveillance system.

10. Main purpose

The type and purpose of the building does not matter - the form takes on residential buildings, office centers, industrial premises and other real estate. In a legal sense, signing the act means that the receiving party has no claims against the developer.

Thus, the document performs 4 functions:

  1. Confirms the fact of acceptance of the object.
  2. Serves as the main evidence that the receiving party has no complaints about the quality of the developer’s work.
  3. Serves as the basis for further inclusion of the finished object in fixed assets.
  4. Reflects information about the cost of the object, which was initially provided for in the project (in the estimate), as well as the actual cost (accepted fixed assets).

Form KS-14 is drawn up in several original copies, which have the same legal force. The number of copies depends on the number of interested parties:

  1. Customer of the work.
  2. Investor.
  3. Contractor (developer).
  4. Representative of the commission for acceptance of the object.

Thus, the act not only reflects the very fact of acceptance of the object, but also serves as a legal basis for the final transfer of funds from the customer (and other interested parties) in favor of the contractor (construction company) for all construction work performed.

The need to sign the act is specified in the Civil Code (Article 753). It is the signing of the document that gives rise to the fact that the customer is obligated to make all payments in favor of the developer.

When is an expert assessment needed?

It is needed when the time comes to accept the work done.
Fulfillment of the conditions specified in the contract under Federal Law No. 44 implies an expert examination of the work performed, goods supplied or services provided. The customer will have to do this. He is also responsible for all costs associated with paying third-party experts. The results are recorded in the act. What will happen if you do not carry out the examination or treat it formally: for example, you do not draw up a sample order for examination under 44-FZ? This may result in you receiving goods of inadequate quality or in the wrong quantity. If this does not scare you, know that such careless acceptance will be fined up to 50,000 rubles.

How to draw up an external inspection report

If you exercise the right to involve third-party expert organizations, after completing their work, you will receive a sample of the external examination report under 44-FZ. Check: there must be a signature of an expert or an authorized member of an expert organization (Part 7 of Article 41 of Law No. 44-FZ).

If inspectors find violations that still do not prevent acceptance, in conclusion they can include proposals for their elimination. Optionally, deadlines for their elimination can be noted. The company's acceptance committee must take into account the conclusions and proposals of the experts, which are included in the conclusion (Parts 5, 7, Article 94 of Law No. 44-FZ).

Types of verification

44-FZ establishes 2 types of checks:

  1. External (with the involvement of experts).
  2. Internal (on your own).

On July 31, 2019, 71-FZ came into force. He declared Part 4 of Art. 94 44-FZ on external examination of the supplied goods or work, which is carried out with the participation of third-party experts in the relevant fields of activity. At the same time, Part 4.1 of Art. 94 44-FZ that the government has the right to determine cases of mandatory assessment of goods, works, and services that are sold by experts and expert organizations. So far no such resolution has been adopted.

There is no obligation to conduct an expert assessment, but the customer still has the right to attract experts for acceptance. This is stated in Part 3 of Art. 94 44-FZ. Expertise over major repairs, reconstruction, demolition and other work requires special knowledge and verification of hidden defects: we recommend involving experts.

You can conduct an audit within your organization, this will be an internal audit. For it, you can appoint one employee or form a commission from among your employees.

If you already have an acceptance committee, you can transfer the authority for expert verification to it (Letter of the Ministry of Finance of Russia dated October 27, 2017 No. 24-03-07/71512).

The commission may be appointed to review a procurement once or may be a permanent body that reviews all procurements.

According to the Ministry of Agriculture, the examination of food products will be carried out according to special rules. In Part 13 of Art. 34 44-FZ decided to include clause 3 stating that the contract must specify the conditions for laboratory tests of purchased food or food products in procurement for the provision of catering services. The supplier will have to pay for these services.

How to fill it out correctly

The standard layout of the acceptance certificate contains a number of mandatory items. The standard document structure looks like this:

  1. A cap.
  2. The reason for compiling the certificate and brief information on it.
  3. A plate with information about the work performed.
  4. The presence or absence of complaints from the customer.
  5. Information about the parties to the agreement.
  6. Signatures.

Now let's take a closer look at each section of the structure and list additional points.

In the upper right part of the paper it is written which agreement this sheet is attached to. You must indicate the application number and contract number along with the date of its creation. Below, in the middle, is the name of the certificate, its contents and number. The information listed refers to the header of the document.

Then you need to fill out a table on the work performed, where you need to indicate:

  • Name of works;
  • actual deadlines for completing the process;
  • price;
  • quality;
  • customer comments.

It is mandatory to indicate the fact of inspection of the work performed in the presence of the contractor. The result must comply with the conditions specified in the main agreement.

Identified faults and defects must be recorded. At the same time, the deadlines and procedure for their elimination are indicated.

Affixing the form with a company seal is not a mandatory requirement. Since 2020, printing on such documents has been abolished.

Filling out data in KS-14

The following are the conditions for signing the act, namely:

Column 1. The full name of the construction project on which the contractor worked, indicating its address (city, street, house/building), is entered here.

Column 2. This includes the name of the government agency that issued the construction permit.

Column 3. This line contains information about subcontractors, that is, companies that also took part in construction work. If there are none, then this line can be skipped.

Column 4. Here you must enter the full name of the company - the general designer who developed the design and estimate documentation for the construction of this completed facility, indicating its address. Also, if any, other organizations that participated in the development of this documentation. If there are no such organizations, it should be noted that all design and estimate documentation was created entirely by one company.

Column 5. Provides a link to the document on the basis of which the initial design data was issued.

Column 6. This line includes information about the company that approved the design and estimate organization (as a rule, this is the construction customer, but sometimes an investor or other interested structure), as well as the approval date and document number.

Column 7. The period of construction and installation work is entered in these cells, indicating clear dates for the start and end of construction (month and year only).

General information

The contract is prepared after the contractor completes his obligations. The contractor delivers the finished object, and the customer accepts it. The protocol confirms this procedure.

This document does not have independent legal force. It comes as an appendix to a number of other documents - mainly to the contract. It contains all the necessary information on the cooperation carried out. In addition, it is the contract that serves as the basis for monetary settlement with the contractor. For each individual case there is a special form of the acceptance certificate:

  • by quantity or quality of cargo;
  • acceptance of technical equipment;
  • acceptance of a construction site, etc.

The acceptance certificate sheet will be visual evidence in legal proceedings. You must approach filling out the paper with all attention and responsibility. In case of claims, this information will help you win the lawsuit. Control of paperwork is assigned to the relevant government agencies.

If the client is dissatisfied with the result, this must also be included in the acceptance certificate template. However, claims must be justified. For example, there may be a discrepancy with the original design. After specifically identifying the shortcomings, methods for eliminating them should be prescribed and deadlines for new work should be set.
