How to draw up a document correctly

The response to a request for certain data is composed as follows:

How to respond to letters

Complaints can be either justified or completely unfounded, written in an emotional outburst.

However, the head of the enterprise should respond to any appeal. A competent response to dissatisfaction will help not only extinguish the flaring fire of conflict, but also retain a client for your business.

The most common situation is when a client of an organization complains to the manager about the boorish behavior of an employee.

Of course, before taking action, you need to understand the current situation. You should ask for an explanation from the employee to get acquainted with the opinions of both sides.

If the audit confirms the validity of the applicant’s claims, the manager will have to make a decision on punishing the employee.

At the final stage, you need to compose an answer in the text of which:

  • inform about disciplinary measures taken by the enterprise administration against the employee, if any.

Dissatisfied parents of students have the right to complain to the school principal. If the parents are not satisfied with the director’s reaction, the next stage of the appeal may be:

  • Department of Education;
  • prosecutor's office or law enforcement agencies;
  • court.

A written response to the complaint must be sent to the address indicated therein within a month. The text of the document must contain:

  • notification of parents about the consideration of claims;
  • information to which authority the appeal was forwarded, if the conflict does not lie within the responsibility of the director;
  • indication of legal basis;
  • notification of measures taken to resolve the conflict.

Complainants should remember that appealing to government authorities must be based on solid grounds and evidence, otherwise there is a risk of being held liable for libel.

In kindergarten

Complaints about the work of a kindergarten can be addressed to the head of the institution. If there is no response to the appeal, the complaint may be sent to the Department of Education, if we are talking about a municipal institution.

If parents are dissatisfied with the work of a private kindergarten, the complaint should be sent to Rospotrebnadzor.

In both cases, within the period established by law, a detailed written response must be received to the complaint, containing:

  • notification of parents that the complaint has been accepted for consideration;
  • notification of confirmation or non-confirmation during verification of the facts specified in the appeal;

What types of response letters exist and what are their features?

In practice, there are several types of responses to requests for information.

They are divided into two groups:

  • A positive response with the provision of the requested data - the applicant is informed about the decision made and is provided with the information that he requested;
  • Negative answer - the applicant is presented with a reasoned refusal with a detailed indication of the reasons for the decision.

The difference between these two categories of answers is their content. For example, with a positive decision, not only a complete answer to the question asked is given, but also all the information on the essence of the requested information is included as much as possible. As a result, having received such a response, the applicant should be completely satisfied with it without unnecessary additional questions.

The main feature, as well as the difference between these types of response letter to a request for information, lies in its content. So, when composing a positive letter, it is necessary to give the most complete and comprehensive answer to the question posed.

Ultimately, the applicant organization should have no questions regarding the substance of the information provided.   • If a complaint has been received that was previously considered, it also needs to be answered, but in a concise form.

How to format a response letter correctly

The response form could be:

  • In handwritten form. It is relevant when the letter requesting certain information is also handwritten;

  • the conclusion must be concise and, if necessary, contain references to the law;
  • in some cases, it is recommended to include phrases about an apology and a desire to see the client again;
  • in the text of the answer, it is better to refrain from using verbs and adverbs with the particle not (can’t, don’t have the right, shouldn’t, shouldn’t, etc.), i.e. you should write from an optimistic point of view, for example, “You have the right/can/ has the right...”, “This is your right according to the law, we agree with this,” etc., since this technique significantly affects people from a psychological point of view;
  • the text must be in the same business style;
  • if it comes to returning money, at the end indicate when, where and in what amount the citizen will be able to receive it;
  • at the end of the answer, indicate the position and full name of the person authorized to sign it, put a stamp (if available).

Example of a complaint

It is necessary to send a response to the complaint in a way that guarantees its receipt by the citizen (by courier, by mail with acknowledgment of receipt, by hand, by e-mail with notification).

What types are possible?

Conventionally, a response letter to a request can be divided into 2 main types:

The main difference between these types of letters is their content.

Thus, if the letter contains a positive answer, its text will contain the most complete and comprehensive answer to the question posed in the request (with references to legal acts, if necessary).

Ultimately, the contacting counterparty should not have any questions left if the answer was indeed given in substance and in full.

A negative answer is shorter, but it must also contain a reasoned formulation, including not only the reasons for the refusal, but also a list of reasons. Also, the negative letter must contain conditions under which the organization that made the request will still be able to obtain the necessary information.

How to write?

It is better to start your request with a brief explanation of the reasons for your request. Simply demanding information without giving reasons (and even in the form of an ultimatum, as some do) is bad form. Write literally one introductory phrase, for example:

  • “based on our preliminary agreements”;
  • “in order to prevent possible controversial issues”;
  • “in accordance with the concluded agreement”;
  • "to conclude a contract."

If necessary, you can refer to legislative acts. For example, if the law requires that before concluding an agreement you familiarize yourself with any papers, you can write in the letter: “In accordance with Article of the Federal Law of July 24, 2012 No. 397-FZ...”. You can get to the point without preliminary explanation only in cases where the reason for the request is obvious (for example, if you are writing a commercial proposal request letter according to the sample). But if the reason for your request is non-standard, you should describe the situation and state your motives in detail so that the recipient does not have any questions.

How to correctly compose and sample it

Before drawing up a response, the applicant should be informed in any convenient way about the receipt of the request via the contacts specified in it (the request) - telephone, email or otherwise.

Next, you should proceed directly to the preparation of the document.

  • or on the organization’s letterhead provided for responding to requests;
  • or in free form.

The letterhead, as a rule, already contains in the “header” the name of the organization providing the answer, its legal address, telephone number of the head and fields for entering the outgoing document number and the date of its preparation.

With free form, all fields will have to be generated independently, namely:

  1. "A cap".

At the top left you must write the full name of the company providing the response, indicating the organizational and legal form, location address, contact phone number, date and number of the outgoing document, as well as its name - “Response to the letter of request (letter number) dated (date of registration of the request )".

In the upper right corner is the position and full name of the official to whom the response is sent, and the name of the organization to which it is sent.

  1. Appeal to an official.

In the center is written an appeal to the person to whom the response is sent. For example, “Dear Marina Sergeevna.”

  1. “Body” of the letter.

Next, you need to write the answer to the request itself - positive or negative (for details on writing the wording, see below).

If the response to the request requires providing the applicant with copies of any documents, a list of them should be indicated.

A positive response must contain:

  • details of the request itself (date and registration number);
  • a few words about the request (the main point);
  • the answer itself.

Negative

If the answer is negative, the text of the statement should contain:

  • as with a positive answer - details and a brief essence of the request made;
  • the reason on which the request is rejected;
  • justification of the reason (with reference to federal or local regulations).

To date, there is no unified form of this document, so it can be compiled in free form. The company can also develop its own form of such a document, which will relate to internal local documentation.

If it is not possible to satisfy the request or request, communicate the refusal as correctly as possible. In this case, as in the option with a positive answer, the refusal must be written in the same style as the request. A negative answer must contain objective reasons for the refusal.

About providing documents

A request for documents must contain:

  • a list of requested documentation indicating the number of required copies;
  • information about payment for providing copies (if payment is required);
  • the applicant’s address where the documentation will be sent;
  • a reference to a normative act containing the right (or obligation) of the person to whom the request is sent to issue any documents.

The wording of the response is standard - if the applicant has the right to receive papers, the organization will send a positive response, otherwise - a negative response.

To the bank

The bank is obliged to provide certain information at the request of government agencies, bailiffs, the Investigative Committee of the Russian Federation, the Federal Tax Service, courts, etc.

The answers to queries are the same - positive or negative. If the answer is negative, the bank will provide links to laws regulating the refusal to provide information about any client (see below).

Types of citizens' appeals

Applications are most often received in written form.
