Obtaining a residence permit for citizens of Kazakhstan in 2021

Why does a citizen of Kazakhstan need a residence permit in the Russian Federation?

A residence permit gives a foreigner a lot of advantages. You can permanently reside in Russia, work or open your own business, receive a pension and all free education and healthcare services. No visa or work permit required.

Procedure for obtaining a residence permit

The procedure for obtaining a residence permit is extremely simple if a citizen of Kazakhstan is included in a preferential category (native speakers of the Russian language, former citizens of the USSR, children of Russian citizens, etc.). They do not even need to apply for a temporary residence permit (TRP).

The rest will need to live in Russia for at least a year and apply for a temporary residence permit (based on quota or grounds). If you apply for a residence permit earlier, the documents will not be accepted.

Further:

  1. Collect a package of documents (application, passport, work certificates, etc.).
  2. Submit it to the migration authority at your place of residence or stay.
  3. Pick up the finished residence permit within 2-4 months.

There is nothing complicated about the procedure. The main thing is to correctly collect a package of documents and confirm your income (active or passive).

Where to contact?

A residence permit is issued at the Department for Migration Issues of the Main Directorate of the Ministry of Internal Affairs of Russia. The easiest way is to contact the nearest branch where you live. Residence permits are not issued at the MFC (“My Documents”).

Persons participating in the program for the resettlement of compatriots also receive a certificate from the Ministry of Internal Affairs of the Russian Federation. An initial application is possible at the Russian Consulate in Kazakhstan. After receiving the certificate, you can apply for a temporary residence permit or temporary residence permit.

Forced migrants register with local administrations and then submit documents to the Ministry of Internal Affairs.

What is a residence permit in the Russian Federation and why is it needed?

A residence permit is a document that certifies the right of a foreign citizen to legally reside in the country for a long period of time. Its owner can easily travel abroad and then return to Russia, without worrying about whether the period of stay has expired.

What rights does it give?

A citizen of Kazakhstan who has received a residence permit has the right:

  • Move freely throughout Russia.
  • Do not register with the Ministry of Internal Affairs of the Russian Federation. Although the agreements concluded between the Russian Federation and the Republic of Kazakhstan give Kazakhstanis the right to live in Russia and work under an employment contract, if their stay is longer than a month, they must register with the migration authorities.
  • Live in Russia for longer than 90 days. An ordinary citizen of Kazakhstan needs reasons for staying on the territory of the Russian Federation (employment, studying at a Russian university, treatment, etc.), while the holder of a residence permit is free to stay in our country as much as he likes during its validity period.
  • Use the compulsory medical insurance policy and other social programs (in particular, enroll children in kindergartens and schools).
  • Vote in local elections.
  • Engage in business activities.
  • Serve in the Russian army under a contract or as a civilian specialist.
  • Get a loan from a Russian bank. However, this will depend on the financial policy of a particular banking institution.

Important. In fact, a residence permit differs only slightly from Russian citizenship, and a citizen of the Republic of Kazakhstan who receives this document actually becomes a resident of Russia.

What responsibilities does it impose?

However, every right always comes with additional responsibilities. Having received a residence permit, a citizen of Kazakhstan is obliged to:

  • Obtain registration at your place of residence or location. A similar rule applies to Russians, and a Kazakh citizen who has a residence permit is treated the same as them in this regard.
  • Notify the Ministry of Internal Affairs of the Russian Federation about your residence in Russia once a year.
  • Do not travel outside our country for more than six months. Otherwise, the residence permit may be cancelled.
  • Promptly renew the residence permit upon expiration.
  • Stay in Russia for at least 180 days during the year. If the total period of stay is less, the question of depriving a citizen of the Republic of Kazakhstan of a residence permit may arise.
  • Have an average income no lower than the subsistence level and, if necessary, officially confirm it.

In addition, the main responsibility of any foreigner in Russia (including a citizen of Kazakhstan) is to comply with Russian laws. If there are administrative, civil and other violations, the bodies of the Ministry of Internal Affairs of the Russian Federation may initiate a procedure for depriving a Kazakhstani of a residence permit.

What should a citizen of Kazakhstan do after receiving the document?

After obtaining a residence permit, registration is required, if it does not already exist: permanent or temporary. To do this, contact the MFC (“My Documents”) or the Main Directorate for Migration of the Ministry of Internal Affairs of the Russian Federation directly. You need to have your passport, application and documents confirming your right to move in.

If the apartment is rented, you will need the consent of the owner and all co-owners of the property. With permanent registration in the purchased apartment, the owner is the person registering himself.

Further, the Ministry of Internal Affairs requires that all residence permit holders annually notify about their income and address by sending a notification. document can be found here.

The notification is required so that the regulator can monitor your income (changed/not changed), and also make sure that you have a place of work and a residential address.

Is a simplified procedure available to citizens of Kazakhstan?

Citizens of Kazakhstan have access to the State Program for the Resettlement of Compatriots, which provides for a simplified procedure for obtaining a residence permit and citizenship, and it is also possible to apply for a residence permit without a temporary residence permit in some cases.

To whom is the simplified residence permit procedure available:

  • those who have been married to a citizen of the Russian Federation for at least three years;
  • especially valuable specialists;
  • Russian speakers;
  • former citizens of the USSR;
  • has been working in the Russian Federation for more than 6 months;
  • has a diploma from a Russian university with honors.

In normal cases, you can apply for a residence permit only 8 months after receiving a temporary residence permit. In a simplified version - without this limitation. The temporary residence permit is issued immediately after arrival or at any other time. Usually, an easier residence permit also means a simplified procedure for citizenship in the future.

In 2021, benefits for obtaining a Russian passport were introduced for citizens of different countries, including Kazakhstan. From July this year, if you have a residence permit, you no longer need to have a five-year period of residence in the Russian Federation to obtain Russian citizenship.

Cancellation of residence permit and its restoration

The residence permit has the right to be revoked if serious crimes are committed, charges of terrorism, or frequent violation of public order in Russia. The reason for cancellation will also be a sharp drop in the foreigner’s income and inability to provide for his/her accommodation.

A canceled residence permit can only be restored by submitting a petition explaining the reasons for the cancellation and explanations. You will have to contact the same authorities on migration issues of the Russian Ministry of Internal Affairs.

A residence permit for citizens of Kazakhstan is issued according to the usual and simplified procedure. It all depends on whether the applicant belongs to the preferential category or not. You will have to seriously prepare for the procedure and collect a package of documents in advance, including from the medical clinic and many others.
