Who can issue a power of attorney and for whom?

Any person residing in Russia and who has reached the age of majority can become a representative of the principal to receive mail. Organizations, as a rule, entrust the receipt of correspondence to their employees - secretaries, personnel officers or accounting department specialists. The power of attorney is usually drawn up by either the secretary of the organization or a lawyer, then the document is submitted to the manager for signature.

The legislation of the Russian Federation stipulates cases when powers of attorney must be certified by a notary, but a power of attorney to receive mail is not included in this list.

In what cases is a power of attorney needed?

Simple letters and items placed in a mailbox do not require any document confirming the authority to receive it. It turns out that any family member can take the letter, especially since postal workers do not have to control the fact of delivery. The situation changes dramatically if the issue concerns the issuance of the following items:

Type of departureRecipientDecor
CustomLetters and parcels of this category are assigned a unique track number. They can be given either to the intended recipient or to an authorized person. In this case, there is no need to contact a notary; the document can be certified by postal employees, at work or at an educational institution.
ValuableLetters, parcels, parcels sent with declared value also have a unique track code. They can be received personally by the addressee or his representative. It is already more difficult to draw up, since a power of attorney certified by the employer or director of the university will be considered invalid. The principal can receive valuable correspondence provided that the document is certified by postal employees or a notary.
TranslationsThis type of shipment is still popular. People receive money transfers, pensions, social subsidies and compensation at post offices. In this case, only a notarized certificate is valid; other types of authorization are not accepted.

Powers of attorney presented at Russian Post do not require notarization. However, there are exceptions, for example, if a citizen wants to receive a money transfer for another person.

Power of attorney to receive mail at Russian Post

Now many people receive parcels, parcels and letters (items) at Russian Post offices (the official name of the Federal State Unitary Enterprise “Russian Post”). According to postal rules, only the person to whose name it is addressed (addressee) or his representative has the right to pick up correspondence. The right to receive any registered shipment (that is, with a track number) can be entrusted to another person if you issue him a power of attorney to receive it at Russian Post.

Let's first understand why another person cannot receive correspondence without written proof of authority. Issuing a package to an unauthorized person is a gross violation of postal rules, and a communications worker who commits such a violation can be seriously punished and fined. Transferring a letter to a stranger will lead to the disclosure of the secret of correspondence, and handing over the parcel will lead to property damage. Therefore, post offices require the issuance of items to “non-addressees” only after verification of credentials. The rule on the need to verify a document with powers also applies to spouses and close relatives living with the recipient.

Rules for issuing items

The post office delivers different items and for each of them there are certain requirements for a power of attorney:

  • Simple items (letters, simple parcels, postcards) do not have a track number and are delivered to the recipient's mailbox. To receive such shipments, no document with authority is required.
  • Registered shipments (registered letters, registered parcels) have a unique track number. They are received personally by the addressee or his authorized representative. You can receive registered mail using a power of attorney certified by a postal employee or certified at the place of work, study or treatment, or certified by a notary.
  • Valuable items (valuable letters, valuable parcels and parcels with declared value) also have a track number. They are delivered personally to the recipient or his representative. Valuable correspondence can be collected using a power of attorney certified by the post office or certified by a notary.
  • Only a representative has the right to receive money transfers, benefits, subsidies, pensions, monthly payments and compensation

For ease of perception, information on the possibility of receiving various types of items using different forms of powers of attorney is summarized in the table:

Basic rules for drawing up a power of attorney

There is no specially developed and approved form. You can use a ready-made template or create your own. However, the form must contain the required information:

  • the name of the document – in our case it is “power of attorney”;
  • name of the locality or city where the form is compiled;
  • Date of preparation;
  • information about the principal (full name and details of the organization, position of the person certifying the power of attorney, this can be a director or a person replacing him);
  • grounds allowing the principal to endorse such documents (for example, Charter, order of appointment, etc.);
  • information about the authorized person (his full name, passport details);
  • about the purposes of issuing a permit, for example, to receive correspondence, and indicate the name of the specific enterprise where you will need to apply;
  • period of validity of the paper (it can be issued both for one-time orders, for a limited period or indefinitely).

In addition, you can specify other powers in a separate paragraph. At the end, the manager puts his personal signature and seal of the enterprise.

In any case, the person who issued the power of attorney to another citizen can revoke the document, then it will be considered invalid.

If the validity period of the power of attorney is not specified, then it is automatically considered valid for a year.

How to compose

A sample power of attorney by mail from an organization 2020 must contain the following mandatory details:

  • date and place of issue;
  • name of the legal entity, full name and the position of the manager who issued the document;
  • Full name, passport details of the authorized person;
  • description of powers - which mail items are entrusted to receive and (or) send to the representative;
  • signature of the manager who issued the document.

Please note that the validity period of the authorizing document is currently not limited by law. If such a period is not specified in it, the power of attorney remains valid for a year from the date of its execution. But if it does not indicate the date of issue, it is void.

Also, according to the Federal Law of 04/06/2015 No. 82-FZ “On amendments to certain legislative acts of the Russian Federation regarding the abolition of the mandatory seal of business companies”, such companies are currently not required to have a seal, therefore, if an organization does not have a seal, certification by it Accordingly, the manager’s signature is not required.

Features of issuing a power of attorney from a legal entity (organization)

The secretary or lawyer of the enterprise draws up the document in a simple form, usually on the organization's letterhead. Certification is not required, but the director of the enterprise must personally sign and seal the institution.

It can be issued to any citizen who has reached the age of majority, even if he is not an employee of the company. However, most often it is issued to a secretary, HR specialist or accountant. The document gives the right to receive all types of correspondence and parcels received by the organization. Here you can download a form template for transferring authority from an enterprise to an individual.

In case of absence of the main employee, you can issue several powers of attorney at once to receive correspondence, which indicates the validity period of the document and the powers of the persons.

Power of attorney

Like a power of attorney to receive wages, written authority to receive mail can certify:

  • notary
  • a person replacing a notary (Article 185.1 of the Civil Code of the Russian Federation)
  • organization where the person issuing the power of attorney studies or works,
  • administration of a hospital-type hospital.

But there is a nuance. A power of attorney to receive valuable correspondence is certified exclusively by a notary.

Postal workers may require that the original power of attorney to receive mail be given to them. If this instruction (like a power of attorney) is one-time, it is legal. But when the power of attorney to receive mail is “reusable,” it is better to keep it.

What to pay attention to

A power of attorney form to receive mail from an organization is usually filled out for one of the employees. This is usually done by a secretary or accountant. But this is optional. By law, such a representative can be any adult citizen. Therefore, it is also not necessary to indicate in the document the position of the person entrusted with receiving and sending correspondence.

When receiving mail addressed to a legal entity, you must present the representative's passport to the post office employee, as well as the original power of attorney, even if this is not the first time you have received correspondence, and a copy of the document confirming your authority is stored in the department.

How to receive mail without a power of attorney

There is an option to deliver the shipment directly to your home, but in this case several conditions must be taken into account:

  1. To receive it you need to call the post office.
  2. Such a letter (or parcel) should not exceed 2 kg in weight.
  3. Delivery cost is 100 rubles per 1 shipment.
  4. Delivery is carried out only on weekdays from 08:00 to 16:00.
  5. The item can only be delivered to the address that belongs to a given post office (you can check it by zip code).
  6. You can receive a shipment only if it is located at your post office (and not just arrived in your city).

Residents of Moscow can use the courier delivery service. In this case, the shipment can be received at any address, and the cost of the service is 199 rubles per 1 letter or parcel. You can receive it even on weekends (the time is the same for all days of the week - from 09:00 to 20:00).

There are no other legal options for receiving mail without a power of attorney.

How to write a document correctly

When filling out a sample power of attorney to receive mail, keep in mind: if you need to transfer the right to receive valuable correspondence or parcels, its notarization is required. This rule works regardless of the validity period of the power of attorney, regardless of whether an individual or legal entity transfers such a right. In other cases, it is not necessary to have the document certified by a notary.

Often the paper is drawn up in any form, especially on the part of the principal, who is an individual. But even in this case, in order to avoid misunderstandings, do not forget to indicate the date of preparation and validity period of the document. When the principal does not indicate the period of use of the document, it will by default have legal force for 3 years from the date of preparation.

It is easier to use a sample power of attorney to receive a letter by mail, especially if the order comes from a legal entity and the documents and parcels received are important.

These data must be present in the power of attorney:

  • number of the post office where the items will be received;
  • legal address of the organization or place of origin;
  • date of registration;
  • full personal information about the principal;
  • if the principal is an organization, indicate in the “principal data” field its name, legal address, registration number, TIN;
  • detailed personal data of the intermediary - trusted person;
  • signature of the authorized representative (sample);
  • signature of the principal.
