Legal basis

The amount, procedure for registration and conditions for receiving financial assistance for the maintenance of a child or a pregnant wife whose husband is in the army or serving under a contract are regulated at the legal level by the following laws and articles:

  1. Law adopted at the federal level (05/19/1995) No. 81 “On state benefits for citizens with children.” Articles 12.3, 12.7 of Federal Law No. 81 establish a specific amount of payments.

Military child benefits in 2021: what is due by law

In the case of caring for two or more children before they reach the age of one and a half years, the amount of the benefit calculated in the indicated amounts is summed up. In this case, the total amount of the benefit, calculated on the basis of the average amount of monetary allowance, cannot exceed 100 percent of the amount of the specified monetary allowance and cannot be less than the aggregated minimum amount of the allowance.

Maternity benefits for wives of contract military personnel

Spouses of military personnel are entitled to various benefits and allowances established by law. For example, this could be assistance with employment, benefits for housing, and medical care. We will consider some of them in detail below.

Why are the benefits for wives of contract and conscript military personnel different?

  • transfer of a serviceman to another area,
  • dismissal of a military man from the Armed Forces,

  • a military wife moving to another region.

An unborn child of a serviceman is already entitled to the first benefit. It refers, of course, not to the fetus, since it is not a subject of legal relations, but to its future mother. For pregnant wives of military personnel serving under conscription, a special payment is provided, provided for in Art. 12.3 Federal Law-81 “On state benefits...”. It is paid to wives of conscripts whose pregnancy is at least 180 days. It is one-time in nature. In 2021 (from 02/01/2020 to 01/31/2021) the payment amount is 28,511.4 rubles.

In this situation, medical care is not just the treatment of the disease, it also involves various operations. However, there is one limitation - treatment must be done exclusively on Russian territory. If a military man or a member of his family is sent to another state, medical care is provided under normal conditions.

Subsidies for military personnel at the birth of a child

Maternity benefit in 2021 is the monetary compensation that women receive for the period of the corresponding leave, based on salary accruals for the previous 2 (two) years.

One-time and monthly allowance for the child of a conscript soldier

A child of a serviceman undergoing military service in the army, in addition to general benefits, is entitled to: a lump sum allowance at birth and a monthly child care allowance until the child reaches 3 years of age (during the entire period of service).

The procedure for receiving benefits, one-time and monthly, is the same. Both benefits are paid by the social protection authority (OSZN). In addition to Social Security, documents can be submitted to the MFC, sent by Russian Post or through the State Services portal (may not be available in some regions).

The most common reason for refusal is incorrect completion of the application or incomplete provision of all documents. The reason for the refusal is indicated in the notification.

The main document for receiving benefits is a certificate of completion of military service. The certificate is issued to the conscript 10 days after arrival at the military unit; to obtain it, you need to make a request to the leadership of the unit.

The right to receive a one-time benefit is the wife (officially married) of a military serviceman undergoing military service upon conscription, with a pregnancy period of 180 days or more. You can receive benefits within 6 months after the birth of the child.

Example: If a conscript was drafted into the army on February 1, and the child was born on May 1 (of the same year), then the child has the right to receive a lump sum benefit, as well as a monthly benefit until the day his father ends his service.

This benefit is not provided to the pregnant wife of a contract soldier or cadet of a military educational organization (Article 12.3 of Law No. 81-FZ).
