Employment centers provide free job search services to citizens in need. The law imposes requirements on applicants regarding age and the list of documents provided, without which it is impossible to register. All of the above features also apply to persons who have already reached retirement age. As you know, the very fact of reaching such an age does not mean that the citizen must now stop working and retire. If desired, the pensioner can always continue his work.

Can a pensioner join the labor exchange after being laid off?

Previously, this level was 55 years for women, 60 for men. But since January 2020, the new reform began to gradually increase it. For people working in hazardous conditions, doing military service under a contract, or a number of persons specified in Article No. 1032-1, the retirement age has also increased.

What documents will a pensioner need to register with the Employment Center?

Dismissed due to staff reduction

When staffing is reduced or an enterprise is closed, employees are fired regardless of their consent (Article 81 of the Labor Code of the Russian Federation), therefore the law provides them with additional guarantees. In Art. 178 of the Labor Code of the Russian Federation regulates the procedure for paying severance pay to employees, including those of retirement age.

Pensioners have the right to severance pay if they are laid off.

When pensioners are laid off, they are provided with the payments and compensations required by law:

  • salary for the period worked;
  • compensation for unspent vacations;
  • bonuses and additional payments;
  • severance pay, the amount of which is equal to the average monthly salary.

The average salary is retained by the pensioner for 2 weeks and is paid by the employer. To receive payments for 3 months, you need to register with the employment center within 14 days after the layoff.

There are common cases when an employer does not want to provide listed benefits to former employees. They cite as the reason that the pensioner is not unemployed - after all, according to the Law “On Employment of the Population in the Russian Federation” they cannot be recognized as unemployed. This refusal can be appealed: the employment service is obliged to issue laid-off pensioners a certificate for the employer, regardless of the payment of benefits to them. This is explained in the letter of Rostrud dated October 27, 2005 No. 1754-61.

The courts take this clarification into account when making decisions in favor of laid-off pensioners (see, for example, the appeal ruling of the Investigative Committee for civil cases of the Sverdlovsk Regional Court dated 02/06/2014 in case No. 33-1557/2014).

Former military

An unemployed person is a person who does not have any income. The labor exchange will allow a military pensioner to find a job, but he will not be entitled to unemployment payments. Also, laid-off military personnel are put on the labor exchange to provide them with new employment opportunities, whether it be mastering a new profession, or obtaining additional education or qualifications.

In the event of a layoff, military pensioners can register with the labor exchange, but they are not provided with unemployment benefits, since they receive a pension from the state.

Military personnel who served under contract, as well as law enforcement officers, can retire earlier based on their length of service. The procedure for assigning a military pension is determined by Law No. 4468-I of February 12, 1993.

A long-service pension is granted in the following cases:

  1. 20 years or more of service in military service or law enforcement agencies;
  2. a military officer (security officer) is 45 years old, he was dismissed due to reaching the age limit for service, health conditions or due to staff reduction and has a total work experience of 25 years, of which at least 12 years and 6 months were military service and service in law enforcement organs

Job search deadlines
