When flooded

There are common cases where damage is caused to various types of cargo during their transportation, loading and unloading (damage, cracks, breakages, etc.). Damage can be caused by floods indoors - to the interior, furniture, equipment and devices. It happens that damage occurs due to careless and improper handling by employees of organizations.

In controversial situations, it is difficult to resolve the issue without a legal document, so the actions of a citizen must be regulated. Drawing up this type of paper is required in several cases:

  • damage to company property by an employee;
  • breakage of items in the hotel room or on the hotel premises;
  • flooding of your apartment or neighbors.

Now we need to look at each individual case in more detail.

At the office

The purpose of writing an act of causing material damage to the organization’s property is to write off the property from the company’s balance sheet or carry out repairs at the expense of a specific employee.

The management of the organization, as a rule, initiates an internal investigation to find the culprits. If none are found, then the responsibility for compensation is assigned to the person financially responsible for this item.

To formulate an act, a commission is assembled from the head of the department, responsible persons and experts who confirm the fact of the breakdown. This procedure guarantees a fair assessment of the damage and calculation of the final amount. They all endorse the document, and it is distributed to each participant in the case in one copy, most often in the unified form TORG-15.

At the hotel

Sometimes careless movement can result in damage to property in the hotel complex where a citizen is staying. In this case, the property damage report form No. 9-G, specially approved for such cases, is used.

It, similar to the act of damage to the organization’s property, is drawn up in triplicate. A guest whose guilt is proven compensates for damages, the amount of which is determined by the hotel management.

Flooding

Purpose of the form

The damage document is drawn up in order to:

A precondition for drawing up an act is the receipt of a memo to the manager about the event of an accident, failure, equipment breakdown , etc. from a person authorized to do so. The culprit writes an explanatory note in which he indicates the reasons for what happened.

The manager issues an order to appoint a commission to conduct an inspection , drawing up a report on the damage caused and considering issues about:

  • identifying the culprit's involvement in the incident,

Based on it, the head, collegial body of the organization or the court makes a decision on liability for causing harm and imposes punishment on the perpetrator. During the inspection, members of the commission may make comments and additions.

If there are disagreements among the members of the commission, you can keep a protocol or issue an act of internal investigation.

The protocol is more appropriate, since it shows how the investigation was conducted, what facts were examined and what issues were put to a vote.

It may be that the culprit cannot be found or identified. Then the act must indicate this.

Which form should I use?

An act of material damage to the property of an organization is considered legal only if it is in writing , and is usually accompanied by documents indicating the fact of damage and the amount for which it was caused.

How to compose?

It is compiled by a secretary, lawyer, senior manager or human resources manager who has the authority to do so.

  • address for drawing up the act;
  • approval of the manager, date, full name, signature;

  • list and description of detected damages;
  • the measures initially taken;
  • estimated cost;
