Why do you need a certificate from the Pension Fund of the Russian Federation?

The purpose of providing a certificate is to confirm work experience in a particular place. Previously, work experience was divided into general and continuous. Now there is no such division, and the total years of work have retained the name - insurance experience. Its calculation is carried out according to the rules of Article 10 of Federal Law No. 173 (by adding the length of service from all places of work from which the necessary contributions were transferred to the Pension Fund).

As mentioned above, a certificate from the Pension Fund of the Russian Federation is required, first of all, when a citizen does not have the opportunity to confirm his work experience using a work book, for example, it is either lost or filled out incorrectly.

Also, a certificate confirming work experience is required when a citizen has worked all his life without a work book, but contributions to the Pension Fund were still transferred from his salary.

This happens in cases:

  • Work until 2013 under civil contracts (contract, agency agreement).
  • Work for an employer – an individual (IP).

What do you need to receive?

This information will be useful to all future retirees: The certificate is issued only after an application made by an employee of a specific company or organization who wanted to retire.

Form SPV-2 must be submitted within 10 days from the employee’s written request. It must be said that the written form must be supported by the signature of the boss or manager.

In order to obtain the necessary certificate, you must collect the following package of documents:

  • A certificate from the tax service, which will report the income of a person who is not engaged in any business.
  • A certificate stating that the required contributions to the pension fund have been paid.
  • A document from the Pension Fund for individual entrepreneurs about their income.
  • Confirmation of payment that the single tax on a certain type of activity has been paid in full.
  • Pay slips, books that were issued by structures under the trade union.
  • An application drawn up in the SPV-2 form.
  • Papers from the boss that confirm the payment of civil contracts.

In order to understand how the process of submitting documents occurs, you need to take into account the features of this operation, as well as analyze references to current legislation.

How long does it take to provide a certificate to the Pension Fund?

Any certificate confirming work experience in a specific organization is issued within three working days. The responsibility for issuing it lies with the employer (the human resources department of the organization where the applicant for the certificate once worked). It is issued free of charge upon the written application of a former employee (in accordance with Article 62 of the Labor Code of Russia).

The employer has the right to send a certificate and other documents confirming the length of service to the former employee by mail, subject to the latter’s consent. The employer can also send a certificate by mail directly to the Pension Fund if it turns out that the employee will not be able to receive it by mail within three working days.

If the request is made to the State Archive, then Russian legislation gives this institution thirty days to issue a certificate to the applicant.

Nuances that may arise upon receipt

There should not be any particular difficulties in the process of collecting information about your work experience. If you really are a former employee of a certain organization, if you have a passport of a citizen of the Russian Federation, and if you have written an official application, then you must be provided with the necessary data. But what to do if the company you previously worked for no longer exists? The solution to this issue will be very simple: you need to contact the appropriate archive of your city, which stores all the documentation of former organizations. Write an application, confirm your identity, and they will definitely help you with issuing a certificate of your experience. If the company has changed its name, then this fact must also be indicated in the certificate provided, otherwise problems may arise with identifying the institution in the fund. This means that the procedure for issuing and receiving a certificate will need to be repeated. There is nothing complicated or complicated about drawing up and receiving a paper confirming the experience of a former employee. The applicant makes an official request to the enterprise, where within three days they must provide him with a completed document that confirms the fact of his work experience. This certificate has no statute of limitations.

How to obtain a certificate of work experience

As mentioned above, a certificate confirming work experience can be obtained from the personnel department of the previous place of employment. To do this, you need to submit an application addressed to your former employer (or the head of the city or rural archive), which should indicate:

  • Name of the enterprise, individual entrepreneur or archive (in case of a request to the archive).
  • Last name, first name, patronymic of the applicant, date of birth, registration address and telephone number for contact.
  • Duration of employment in this organization (start and end date of work).
  • Please issue an archival certificate addressed to the applicant.
  • Information about where the certificate should go (Russian Pension Fund).
  • Date of document preparation and signature of the applicant.

If the organization has already submitted all information about the former employee to the State Archives, an application for a certificate to confirm the length of service must be submitted to the State Archives of the city or locality of the former place of work. You can submit such an application via the Internet (website of the Unified Portal of Public Services).

If an employer has lost information about an employee and has not archived it, then the length of service will have to be proven in court. In addition to a citizen who was once employed under an employment contract with an employer, the following have the right to write an application for a certificate:

  • A legal entity (organization, enterprise) in relation to its employee.
  • A citizen or legal entity (at their request) on the basis of a court decision in a case regarding the assignment of a pension or restoration of seniority.

After the expiration of the period established by law, the applicant must receive a certificate confirming his work experience in a specific organization or individual entrepreneur.

How to write a certificate

The document must be drawn up either on company letterhead or using a corner stamp so that the company details are recorded . The help structure should contain the following elements:

  • date and registration number;
  • Full name of the employee;
  • the exact name of the position (if it gives the right to early retirement, the name must be written in the same way as it sounds in the 10th Resolution of January 26, 1991);
  • information about length of service (number of years, months and days worked);
  • basis (work book details);
  • purpose of issuance (where it is sent or at whose request);
  • certification signatures (director, personnel officer or executor);
  • company seal.

If a certificate is needed to apply for a preferential pension , then you need to include an expanded description of your work activity indicating the details of the orders:

  • about translations;
  • on assignment of ranks;
  • about combining professions.

It is important to know that a certificate can be endorsed by:

  • director of the firm;
  • personnel officer, if he is authorized by order to issue and sign personnel documents;
  • archivist, if the personal file is in the archive.

How to calculate work experience?

Calculating the length of service for the Pension Fund certificate is quite simple:

  1. To do this, you need to summarize all periods of work at certain enterprises.
  2. Then, to the resulting figure, you should add those periods when the person did not work, if he has them.
  3. The resulting figure is the desired number.

Validity period of the certificate of work experience

Russian legislation does not establish a validity period for a certificate confirming work experience. In practice, it is used until the death of the citizen in whose name it was issued.

However, such a certificate can be declared invalid by a court decision. This may happen if:

  • The document contains marks or corrections.
  • The document does not contain required details

To avoid problems in the future, when leaving each job, a person has the right to ask in advance for several copies of certificates of length of service in a given organization, for different occasions. At the same time, the employer does not have the right to ask the employee where exactly these certificates will go and why he needs exactly such a number of them.

According to the rules of personnel records management, when registering a new employee, his personal file is formed, where a copy of the employment record must be included. The data on the length of service is taken from the copy.

A certificate of length of service is issued upon application by an employee (including a former employee) no later than 3 days from the date of receipt of the application : such a requirement is contained in Article 62 of the Labor Code.

Reminder The certificate does not have a validity period, since it contains information that will not change.

Insurance experience - what is it?

The basis of the insurance period is the periods when contributions to the funds are transferred for the employee. In addition, according to the law, other periods may be included in it.

The procedure for calculating them in the amount of insurance experience for the Pension Fund of the Russian Federation and the Social Insurance Fund differs.

The Pension Fund of the Russian Federation takes into account (according to the text of Articles 11, 12 of the Federal Law-400 dated 12/28/13):

  • transfer of contributions by the employer for the employee;
  • child care up to 1.5 years;
  • official status of unemployed;
  • caring for a disabled person (group 1 or minor), a person over 80 years old;
  • farming and individual entrepreneur status, subject to payment of contributions, etc.

The FSS takes into account (according to the text of Article 16, paragraph 1 of Federal Law-255 dated 12/29/06):

  • work under the Labor Code of the Russian Federation for an employer;
  • civil service or municipal service;
  • other periods when the individual was insured with the Fund.

In addition, the insurance period will include periods of military or other service in accordance with Federal Law-4468-1 dated 12/02/93.

On a note! Labor and insurance experience should not be confused. Work experience is taken into account until the date of 01/01/02 for calculating pensions. It is not taken into account in calculating FSS payments today.

Documents confirming insurance experience in 2020

  • periods of work and (or) other activities and other periods after registration of a citizen as an insured person - based on information from individual (personalized) records.
  • periods of work and (or) other activities that were carried out outside the Russian Federation - a document of the territorial body of the Pension Fund of the Russian Federation on the payment of insurance contributions, unless otherwise provided by the legislation of the Russian Federation or international treaties of the Russian Federation.

The payment of insurance contributions for determining the insurance period is equivalent to the payment of contributions to state social insurance before January 1, 1991, the unified social tax (contribution) and the unified tax on imputed income for certain types of activities (hereinafter referred to as mandatory payments).
