Register yourself

Any individual who has Russian citizenship has the right to submit documents for legal registration as an individual entrepreneur. The exception is for persons in the public service (for example, notaries, judges, employees of the prosecutor's office, tax inspectorate, etc.), as well as those who have already been engaged in some type of business activity and suffered a fiasco in the form of official bankruptcy. The last category of citizens can try to obtain a new certificate of an individual entrepreneur no earlier than a year after the bankruptcy procedure. Citizens of other countries, as well as stateless persons, the so-called stateless persons, can become individual entrepreneurs in Russia.

So, what documents are needed for state registration of an individual entrepreneur?

First of all, you need to decide on the economic activity code and choose a tax regime

To create a correct and complete package of documents, you first need to decide on the direction of your commercial activity. In a documentary version, the All-Russian Classifier of Types of Economic Activities (OKVED) will help to cope with this task. It was developed in the form of certain codes with their exact decoding. Once the direction of the business has been determined, it is necessary to decide which taxation system it is intended to operate under.

In our country, there are two types of taxation for individual entrepreneurs: general and simplified. The General System of Taxation (OSNO) includes all those entrepreneurs who did not document their desire to work under the Simplified Taxation System (STS) when registering an individual entrepreneur.

OSNO and simplified taxation system differ in that entrepreneurs working under OSNO must pay VAT (value added tax), property and profit tax, conduct accounting activities in full, including a journal of income and expenses and registration of business transactions. Those who have chosen the simplified tax system do not pay VAT, property and profit tax, but once every three months they must pay the single tax simplified tax system for everyone and once a year submit an income declaration to the tax office. In our country, the simplified tax system is more common because it gives a lower tax burden. However, it is OSNO that is considered classic and is a kind of confirmation of the seriousness of the businessman’s intentions, and also provides more chances for concluding long-term partnerships with major business representatives. If a future businessman did not submit a petition to switch to the simplified tax system when registering an individual entrepreneur, and automatically remained on OSNO, then it will be possible to switch to the “simplified system” no earlier than three months (quarter) after receiving a certificate of state registration of an individual entrepreneur.

Stages - filling out documents

What is needed to register an individual entrepreneur, what main stages will need to be completed?

Main stages of registration of an individual entrepreneur:

  • determination of the type of activity (according to OKVED);
  • choice of taxation system;
  • preparation and collection of necessary documents;
  • submission of a set of documents to the local authority of the Federal Tax Service;
  • obtaining a registration certificate and a tax payer certificate;
  • registration with the Pension Fund of the Russian Federation and the Compulsory Medical Insurance Fund;
  • opening a current account for an entrepreneur (optional).

Determination of the type of activity (according to OKVED)

The selection of activity codes should be carried out in accordance with the planned types of business. But it is best to choose not one code, but several - this will expand the list of services provided. The number of OKVED codes for one individual entrepreneur is not limited by law, but it should be remembered that some types of activities may be subject to the UTII tax (unified tax on imputed income), which will require the submission of additional reporting to the tax authorities.

The first code indicated in the application is automatically accepted as the main type of activity. If the codes are filled in incorrectly, the tax authority may refuse registration, because they do not have the right to make corrections to statements.

Choosing a tax system

The choice of taxation form depends on the chosen type of activity, types of counterparties (who you will work with - entrepreneurs or legal entities), and the volume of revenue. The optimal system at the moment is the simplified taxation system (STS), which is characterized by ease of reporting and minimal tax deductions. With this form, VAT and property taxes are not paid. The interest rates under the simplified system can be 6% of income or 15% of profit (income - expense). The choice of interest rate depends on the type of activity and income structure. That is, when providing services that are characterized by lower costs, a rate of 6% will be profitable; and when conducting retail or wholesale trade, where most of the costs are incurred on the purchase of goods, it is more effective to apply a rate of 15%.

Important!

The transition to a simplified system of individual entrepreneurs can be made only once a year (usually at the beginning of the year). The law provides for the right to switch to the simplified tax system within 30 calendar days after registration, but it is best to submit the corresponding application along with a package of documents for registration.

Submitting a set of documents to the Federal Tax Service

Documents can be submitted by the entrepreneur himself, sent by registered mail, or submitted on behalf of an authorized person (individual, entrepreneur or representative of a legal entity).

When submitting in person, it is recommended that, in addition to completed paper documents, you take with you an electronic copy of these applications.

Why open an individual entrepreneur

When an entrepreneur starts his own business, he chooses the organizational form of his enterprise. The majority of legal entities (LLC) in the Russian Federation were founded by one person. When deciding to register your own business, compare whether it is more profitable for you to open an LLC or an individual entrepreneur. An individual entrepreneur is the most popular form of running your own business in our country. It was preferred by more than 3 million people. And there are serious reasons for this:

  • registering as an entrepreneur is not very expensive;
  • The registration process takes time, but it is not as long as an LLC;
  • Individual entrepreneurs do not keep accounting records and have simplified reporting;
  • the taxes paid by individual entrepreneurs are relatively small;
  • Registration as an individual entrepreneur is especially beneficial for citizens who provide services without hiring workers;
  • Some individual entrepreneurs have access to re-registration for a new self-employed status, which will reduce taxes transferred to the budget and get rid of reporting altogether;
  • Individual entrepreneurs are relatively easy to close. The deregistration procedure is much simpler than for an LLC.

IMPORTANT!

The law does not prohibit individual entrepreneurs from fulfilling government orders worth up to 20 million rubles.

The status of an individual entrepreneur also has disadvantages:

  • the entrepreneur is liable for his obligations with all his property;
  • there are types of activities that an individual entrepreneur does not have the right to engage in, especially licensed ones;
  • Pension provision for individual entrepreneurs is at the level of the social pension.

To open an individual entrepreneur, you need personal documents and a firm decision to successfully run a business. Registration is carried out by the Federal Tax Service of the Russian Federation. To open an individual entrepreneur, use the online service FILEGO https://filego.ru/kak-otkryt-IP-instruktsiya.

Individual entrepreneurs are prohibited from participating in defense procurement. This rule is regulated by Article 3 275-FZ of December 29, 2012.

What is needed for self-registration of individual entrepreneurship in 2020

The applicant submits the collected package of papers personally to the tax office or sends them by mail.

Current legislation provides for the submission of papers for registration of individual entrepreneurs by power of attorney. These powers can only be entrusted to a legally capable person. But the applicant must remember the additional costs, since he will also have to pay for the services of a notary. What documents are required to register an individual entrepreneur by power of attorney? The list of papers is standard, but they are certified by a notary. The authorized representative contacts the tax office and presents his power of attorney to represent the interests of the applicant and his civil passport.

From the businessman himself you will need:

  1. application for registration with the signature of the applicant certified by a notary;
  2. a copy of the passport, certified by a notary;
  3. receipt for payment of state duty;
  4. power of attorney;
  5. statement on the transition to “simplified language”.

A citizen of Russia and a foreigner legally residing in the territory of the Russian Federation can act as a proxy. The businessman independently decides whether to submit documents personally or entrust this procedure to a third party.

Refund of state duty

There are several reasons why a refund may be made for paying the state fee for registering an individual entrepreneur.

The law provides 3 options:

  • The citizen transferred the funds, but changed his mind or due to circumstances is unable to register as an individual entrepreneur. Sometimes, for certain reasons, there is no need to register an individual entrepreneur. There may also be a need to register another form, for example an LLC, and accordingly you will need to pay a state fee for registering an LLC.
  • Payment was made in an amount that exceeds the amount established by law.
  • The transferred funds were transferred to another account. The reason is most often an error when filling out the payment receipt.

The last option is quite controversial and in this case it will be very difficult to return the funds. The reason is the mistake of the citizen himself, and not of government agencies. You probably shouldn't expect a refund.

Attention! If registration is refused, the individual entrepreneur’s state duty is not refunded. When resubmitting documents, funds will need to be transferred to the Federal Tax Service account again.

First of all, it is worth noting that it is best to submit an application for a refund of paid funds in person to the district tax office. The option of sending by mail is possible, but resolving the issue in this case will take longer. A package of documents confirming your identity, as well as a payment receipt and a completed application for the return of material assets, is submitted to the tax service. The review period is 10 days and if the decision is positive, the funds will be returned within a month.
