An important question: how to apply for benefits for caring for an elderly person over 80 years of age through State Services and is this allowed at all? To apply for a benefit for caring for an 80-year-old pensioner, you must contact the Pension Fund at the place of registration of the elderly person - where he receives his pension. How to arrange patronage for an elderly pensioner

  • unemployed and not receiving unemployment compensation, i.e. citizens who are not registered with employment centers;
  • students - the scholarship in this case is not accepted as income, since insurance premiums are not paid from it;
  • minors - in order to apply for benefits, they must provide the Pension Fund with parental consent and permission from the guardianship authorities.

Not everyone is entitled to such compensation. It is paid to non-working, but able-bodied persons from the point of view of pension legislation who do not receive unemployment benefits from the employment service. But family relationships and cohabitation are not important in this case; neighbors or acquaintances can look after an 80-year-old citizen.

In accordance with the law, citizens who constantly care for elderly people in need of constant assistance, as well as people who have reached 80 years of age, are entitled to receive compensation for care. The amount of compensation payment is 1200 rubles monthly. It is paid to the pensioner along with the pension assigned to him. The elderly person himself pays with the funds received to the person caring for him.

In addition, the periods of care will be counted towards the citizen caring for a pensioner in the insurance period. Pension coefficients are also calculated for periods of care (1.8 for each full year of such care). This will allow you to create pension rights to receive an insurance pension in the future.

    Assignment and payment of benefits

    The amount of benefits for those caring for a pensioner over 80 years of age was approved by Presidential Decree No. 1455 of December 26, 2006 and amounts to 1,200 rubles monthly . If the ward lives in an area with an established regional coefficient, the amount of this payment increases in accordance with the coefficient. For example, in the Nenets Autonomous Okrug the amount increases by a factor of 1.5, that is, 1,800 rubles.

    Who can care for an old person over 80 years of age?

    Of course, you can care for an incapacitated citizen or a disabled person of any age by completing the necessary documents to receive the appropriate payments. However, reaching the age of 80 in itself is the limit after which the need for care and the presence of legal capacity of an elderly citizen no longer need to be proven. He simply becomes in need of care in accordance with the law, regardless of his physical health and well-being.

    Who can care for an elderly person? Of course, first of all, these could be loved ones living with him. To receive care payments and enroll in retirement experience, a person who is going to care for an elderly person must meet the following requirements: be able to work, not work and not be on the labor exchange.

    Such patronage should not be confused with rent. An annuity involves a signed agreement to care or transfer funds over a long period of time in exchange for bequeathing an apartment. Patronage involves organizing meals, hygiene and household services for the old person without questions about inheriting property. People with different health conditions require different levels of help: someone at 90 years old can vigorously garden, while someone at this age already needs help in fighting bedsores.

    Usually the terms of reference are negotiated between the person caring for the elderly person. However, a person caring for an old man today can only count on a payment from the state in the amount of 1,200 rubles. Moreover, this amount is not indexed. The money is transferred to the ward’s account along with the pension, and the pensioner can spend it on the person caring for him. But the amount of 1200 is so meager today that it is unlikely that anyone will take on caregiving responsibilities for such a fee. Therefore, only people who live with a pensioner or are heirs take on such a burden.

    They are the ones who pay bills, buy groceries, clean the premises, buy medications, provide minimal medical care - give massages, give medications, measure blood pressure, etc.

    Termination of payments

    An elderly person over 80 years of age needs not only material support from the state, which he receives in the form of various allowances and benefits. He also needs help from third parties in solving everyday problems. In 2021, the Pension Fund continues to pay money to citizens caring for pensioners in the amount established by the legislation of the Russian Federation.

    How to make a payment

    For example, in Petrozavodsk an assistant is entitled to 1,380 rubles, and in the Altai Republic the amount increases to 1,680 rubles. Residents of the Far North and territories equivalent to this region receive the largest additional payment. The basic part established by the legislation of the Russian Federation is 1,200 rubles.

    In essence, this compensation is the earnings of a person who voluntarily left work (officially unemployed, not receiving unemployment benefits and not a pensioner or disabled person) due to the need for round-the-clock care for an elderly relative or disabled person. At the same time, one should take into account the fact that social workers are not able to provide round-the-clock social services at home to elderly citizens; only family members can bear such a “burden”. By increasing the amount of monthly compensation for care to 10 thousand rubles, unemployed relatives and guardians will finally be able to breathe easier.

    From January 1, 2021, the payment of monthly compensation to people providing permanent care for the elderly or disabled will become more significant. It will increase to 10 thousand rubles. At the next session of the State Duma of the Russian Federation, deputies will consider a bill on this.

    The explanatory note to the project states that the bill was developed to increase the social protection of older citizens who need constant care. Today, according to the decree of the President of the Russian Federation of December 26, 2006, unemployed able-bodied Russians caring for group I disabled people, as well as elderly people unable to care for themselves, are paid a monthly compensation of 1,200 rubles.

    The Pension Fund has 10 days during which they will consider your application, but payments will begin from the month you submitted it. If you submitted documents on November 30, you are entitled to full compensation of 1,200 rubles for November.

    You can take as many elderly people under your wing as you like; each will receive 1,200 rubles a month, but the length of service will be the same as for one. For example, if in 2021 a person cared for his grandparents for a whole year, then he will receive 28,800 R (14,400 R for each), length of service and 1.8 pension points.

    • a certificate from the tax authority stating that the citizen is not an individual entrepreneur or the owner of an enterprise/company;
    • work record of the caregiver;
    • written, notarized permission from the parents if an elderly person is being cared for by a teenager under 16 years of age.

    In addition, those who retire later than retirement age receive a fixed payment in an increased amount. If you delay retirement by 1 year, the fixed payment increases by 5.6%, if by 3 years - then by 19%, if by 6 years - the payment increases by 36%, and if you retire 10 years later, then the fixed payment more than doubles – by 111%.

    Necessary documents for registration

    What documents need to be provided to process the compensation payment. All documents are collected with copies. The person arranging care will be required to:

    • statement;
    • passport;
    • employment history;
    • a certificate from the entertainment service confirming the absence of payments;
    • SNILS;
    • certificate from the tax office.

    If it is planned that a minor will be caring for a disabled person, then he will need a birth certificate, a certificate from the educational institution about the time of graduation and written permission from the guardianship authorities or parents.

    At the same time, you need to collect a package of documents from the elderly citizen:

    • passport;
    • consent of the ward to the services of a certain person. The document must contain the passport information of both;
    • SNILS;
    • pensioner's ID.

    Application for compensation payments

    A sample application can be viewed on the PF website. The text of the application must contain the following information:

    • name of the local PF body;
    • information about the applicant – SNILS, passport details, contact details, registration and place of actual residence;
    • the applicant’s employment status—for example, not working;
    • care start date;
    • indication of the reasons for leaving - reaching 80 years of age;
    • request for compensation with reference to Presidential Decree No. 1455;
    • agreement with the need to notify the Pension Fund in the event of circumstances arising in which payments are terminated.

    The submitted package of documents is reviewed within 10 days. If the decision is not made in favor of the applicant, officials must notify the applicant about this within another 5 days. If the application is granted, then payments are assigned from the month when the documents were transferred, but not before the grounds arise.

    When does compensation stop?

    There are several reasons why compensation may be terminated. One of them is the death of a ward. However, this is not an exhaustive condition. You need to notify the Pension Fund to stop payments if:

    • a person who cares for an 80-year-old elderly person got a job himself;
    • began to receive unemployment benefits;
    • started receiving a pension;
    • went to serve in the army;
    • decided to give up his duties voluntarily;
    • a statement was received from an elderly citizen that he was being cared for unfairly.

    There are also cases when the ward:

    • deregistered, left Russia, for example, to live with his children in another country;
    • transferred to permanent residence in a government institution.

    In all these cases, you must immediately inform the Pension Fund about the termination of payments. Otherwise, in the future, excessively overpaid amounts will be recovered back in court.

    Will caring for an elderly person count as length of service?

    For the carer, in addition to a small compensation payment, the state has added one more plus. All the time spent caring for an elderly person over 80 years of age will be counted towards his total length of service for obtaining a pension. There is one limitation - the length of service is subject to credit if a person generally has a period of work of any duration. As for the pension coefficient, it is calculated on the basis of 1.8 points per year. This insurance period determines only the right to pension provision. The time of leaving is not included in the calculation of the pension amount.

    How to arrange care for a pensioner

    The pension fund considers the application within 10 days, but the payment is assigned from the month in which the applications were submitted, but not earlier than the day the right to compensation arises. That is, if an application was submitted to provide care for a pensioner over 80 years of age on April 29, compensation will be received for April in full (1,200 rubles). If on the same day, April 29, an application was submitted to provide care for a pensioner who turned 80 only on April 14 of the current year, the amount of payment will be recalculated. Then for April you will receive 680 rubles (in 17 days, since previously an elderly person was not entitled to care and compensation for him, because he was not yet 80 years old).

    Do I need to confirm the period of care?

    Documents are drawn up in the pension fund. You need to come to the local branch together with the pensioner (to the place where he receives his pension). The one who is going to provide care writes an application for monthly compensation. In turn, the pensioner writes a statement of consent to provide care for him.

    • negotiate with a pensioner, a citizen over 80 years of age;
    • contact the Pension Fund;
    • provide applications and a package of documents;
    • Schoolchildren and students under 15 years of age will need to obtain consent from parents and the guardianship authority; from 15 to 18 years of age - only parents.

    The main condition for the appointment: the recipient must be an unemployed citizen of the Russian Federation who does not receive unemployment benefits or other social and pension payments. How to make a payment? Take into the care of a citizen over 80 years of age and provide care for him as the main and only type of income-generating activity. Registration with the Employment Center, even without receiving benefits, is also not allowed.

    Who is entitled to receive

    The size of the payment is not indexed, but the regional coefficient is applied to it. Therefore, the benefit for caring for an elderly person over 80 years of age (amount in 2020-2021) is the same for all recipients, except for those living in the Far North and those equivalent to them.

    Another type of care for the elderly, those in need of third-party care, or incapacitated citizens is arranged through the guardianship and trusteeship authority (TCA) . Its essence is to transfer some of the rights of the person under guardianship to the person caring for him.

    Caregiving activities for elderly people often do not allow for work activities. And this deprives a person of the opportunity to receive income not only while fulfilling his obligations, but also in the future. In this regard, the decision was made:

    Guardianship

    The amount of compensation is fixed. In 2021 it was 1200 rubles. However, in some regions it increases by a multiple of the northern coefficient. The compensation is paid monthly along with the pension accruals of the elderly citizen. A separate account with the Pension Fund is not issued for her.
