January 31, 2020 Author: Maya Polozkova The legislation of the Russian Federation requires all enterprises, regardless of their organizational, legal forms and forms of ownership, to maintain military records.

This responsibility, as well as the goals and objectives of this area of activity are prescribed in the following regulations: in the Federal Laws of the Russian Federation: dated 05/31/1996 No. 61, dated 02/26/1997 No. 31, dated 03/28/1998 No. 53; “Regulations on military registration”, approved by Decree of the Government of the Russian Federation of November 27, 2006 No. 719.

Obligation of employers to provide lists of persons liable for military service and conscripts

By Order of the Minister of Defense of the Republic of Kazakhstan dated January 24, 2020 No. 28, the Rules for Military Registration of Persons liable for Military Service and Conscripts (hereinafter referred to as the Rules) were approved, which came into force on June 2, 2017.

According to Chapter 5 of the Rules, all legal entities must maintain military records of those liable for military service and conscripts.

This chapter contains a number of responsibilities of Kazakh companies in the field of maintaining military records:

1) maintenance of military records of persons liable for military service and conscripts by legal entities is carried out using personal cards in the form, in accordance with
Appendix 27 to these Rules.
For conscripts, an additional list of young men who are subject to preparation for military service in uniform is maintained, in accordance with
Appendix 28 to these Rules.
2 ) monthly submission, by the 25th day, to the Municipal Educational Institution of the district (city of regional significance) of a list of those liable for military service and conscripts hired (study) or dismissed from work (expelled from an educational organization) by legal entities in the form in accordance with
Appendix 29 to the Rules;
3) annually, by February 15 (as of January 1), sending to the Municipal Educational Institution of the district (city of regional significance) information on the number of working (student) military personnel and conscripts in the form, in accordance with
Appendix 30 to the Rules;
However, in this article we will focus on just one of them, the deadlines for which, one might say, are “touching on our heels.” In the turmoil associated with the beginning of the school year, in the pursuit of new textbooks and school uniforms, you can miss the deadline for submitting the List required by the Rules. In this case, we are talking about the annual submission, by September 1, of
lists of citizens of 15-16 years of age to the local military administration bodies of the district (city of regional significance).
Forgetfulness of the employee responsible for maintaining military records and untimely submission of the specified list can result in a “tidy” sum for the employer. The fact is that Kazakhstan provides for administrative liability for violation of the Rules for maintaining military records. Thus, in accordance with the provisions of Article 642 of the Code of Administrative Offenses of the Republic of Kazakhstan ,

«

failure to submit or untimely submission to the local military authority of lists of citizens subject to initial military registration or registration at conscription stations,

failure to submit or untimely submission to the local military administration body within the established period of time, lists of citizens subject to initial military registration or registration at conscription stations -

entails a fine on officials of organizations, educational institutions, as well as officials of organizations operating residential buildings, and homeowners - in the amount of ten, on the first heads of organizations, educational institutions - in the amount of fifteen, on small businesses - in the amount of twenty, on for medium-sized businesses - in the amount of thirty, for large businesses - in the amount of forty monthly calculation indices.”

Information about vehicles must be submitted to the military registration and enlistment office by December 20

Tatyana Moiseenko, tax consultant, director According to paragraph 15 of the resolution of the Cabinet of Ministers of December 28, 2000.

No. 1921, which approved the Regulations on military transport duties (hereinafter referred to as the Regulations), enterprises must inform the military registration and enlistment office about the availability of vehicles and equipment, their technical condition, as well as about citizens who work in enterprises, institutions and organizations on such vehicles and technology.

Information is submitted twice a year - until June 20 and until December 20.

The effect of these Regulations (and, consequently, the submission of Information) also applies to enterprises, institutions and organizations, regardless of their form of ownership. This Regulation does not apply (that is, Information is not submitted) to diplomatic missions and consular offices of foreign states, representative offices of foreign and international organizations, foreigners and stateless persons.

Who is subject to military registration

Employees of the following categories are subject to military registration in the organization (clause 12 of the Methodological Recommendations):

  • conscripts;
  • persons liable for military service;
  • discharged from military service and enlisted in the reserves of the RF Armed Forces;
  • who have completed their studies at military departments of federal universities under military training programs and military educational universities;
  • exempt from conscription for military service;
  • those who received a deferment from conscription;
  • who have reached 27 years of age.

To register a new employee with the military, a specialist:

  • checks the availability of his passport, military registration documents, marks and entries in them, the correspondence of the entries in these documents with passport data;
  • opens and fills out a personal card according to the records in military registration documents.

An employee who is registered with the military at his place of work must be informed about the duties of military registration and warned of liability for violating them.

Military registration of part-time workers

Clause 13 of the Methodological Recommendations specifies categories of employees who are not subject to military registration in the organization. This list does not include persons working part-time. It follows from this that it is necessary to keep military records for part-time workers, and not just for full-time employees (provided that they fall under clause 12 of the Methodological Recommendations).

Report No. 16 “Specialist Replacement Plan”

Form No. 16 Plan for the replacement of specialists called up for military service upon mobilization and in wartime” is not submitted by all organizations, but it is still one of the most popular reports.

It is built according to three parameters: company, division and type of work. By default, Form No. 16 pulls up information on main employees, but you can use the settings and create a report on part-time employees.

In the Kontur-Personnel program, Form No. 16 is built on the basis of details about replacement and replaced employees from personal cards. Information can be entered for each employee separately; we described how to do this in the article “Reporting to military registration and enlistment offices: attention to details” .

Important! It is necessary to “replace” an employee only if he is registered with a special military service.

You can enter information into personal cards using orders. You can find them through the Organization / Personnel menu. In the list of employees that appears, select those whom you need to “replace” and click on the “Orders” icon. The required form is called “On the appointment of a replacement employee for Form 16.” The system will ask you for the start date of the order, take into account everyone you have allocated, and offer to determine who will replace each of these workers.

If you want the same person to replace several employees at once, you can use the “Duplicate Entry” function (by right-clicking in the pop-up menu). The same can be done with the start and end dates of the order.

When approving an order, an error warning may appear, for example, if the employee does not have the mobilization order number indicated in his personal card or the “Military Registration” tab is not filled out at all.

After the order is approved, the program automatically posts all the data to the employees’ personal cards.
