Urgent approval of redevelopment in 2021

Definition of the concept

Redevelopment (reconstruction) of an apartment means a procedure in which:

  • load-bearing walls are affected (an opening is formed);
  • doorways are widened;
  • the floor structure is being replaced;
  • new partitions are being installed.

That is, redevelopment is a procedure, the results of which affect the technical layout of the room. This case also includes moving a gas stove to a new location.

Important: redevelopment of residential premises requires approval from the relevant authorities. Otherwise, penalties will be imposed on the apartment owner.

Redevelopment does not include painting walls, replacing windows (provided the size of the opening remains the same), wallpapering and other similar procedures. Also, apartment owners have the right to independently, without coordination with the relevant government agencies, improve external walls, install satellite dishes or install air conditioners.

How to coordinate the redevelopment of residential premises in the Moscow region

Many owners of residential premises in the Moscow region are not satisfied with their original layout - apartment owners are ready to spend a lot of money on changing the appearance of their square meters. However, reconstruction or redevelopment of premises is prohibited without the consent of specialists, since some types of such work can lead to emergency situations. Read about what changes in the configuration of premises need to be agreed upon when carrying out redevelopment and what documents need to be collected for its approval in the material of the mosreg.ru portal.

What is needed for urgent approval of redevelopment

Coordination of redevelopments takes place according to the rules of the Housing Code of the Russian Federation and regional regulations. The scope of work that the legislator considers as redevelopment includes changing the configuration of residential or non-residential premises - increasing or decreasing the area of individual rooms, moving or erecting partitions, installing or dismantling window and door openings, etc. According to the law, approval of redevelopment work for residential premises should not exceed 45 days, but this period does not include the preparation of design and technical documentation.

Here are the documents the owner will need to urgently approve redevelopment in Moscow:

First steps to renovate your apartment

To renovate your apartment you will need:

  1. Draw up a plan according to which the work will be carried out.
  2. Coordinate the plan with the housing inspection.
  3. Carry out the redevelopment by drawing up an act for hidden work and filling out other documents that will be required to complete the redevelopment of the apartment.

Important: when renovating an apartment, it is prohibited to place wet rooms (baths, kitchens) above dry ones (bedrooms) and violate the integrity of air ducts and other communications.

Upon completion of the redevelopment, you will need to draw up a report on the work performed, which is submitted to the housing inspectorate for approval.

Deadlines

The submitted application and list of documents are considered by the BTI authorities within 45 calendar days (in practice, on average about 30 days), after which they make their decision on the approval of the reconstruction of the residential premises: to allow or refuse to carry out the reconstruction of the premises.

If the decision is positive, the owner (tenant) is given a certain time to reconstruct the living space. Upon completion of the work, a redevelopment completion certificate is drawn up , on the basis of which changes will be made to the technical passport for the apartment.

Features of the reconstruction project

Redevelopment of apartments is carried out on the basis of a project, which has the right to be drawn up by an organization that is an active member of the SRO and has permission to carry out such work. This document must contain the following:

  • major decisions that affect the design, layout and architecture of premises;
  • layout of utility networks;
  • conclusion on the functioning of internal networks after making changes;
  • methods for ensuring the organization and execution of work;
  • solutions ensuring fire safety.

Important: on the websites of housing inspections (in particular, the Moscow Housing Inspectorate) there is a list of previously approved standard projects.

When developing a project, it is important to take into account the work that is prohibited.

Documentation required for work approval

In addition to the application for apartment reconstruction, you must provide the housing inspectorate with:

  • the applicant’s passport, which is registered in the apartment;
  • consent to redevelopment from the remaining residents;
  • title documents;
  • technical passport for housing (issued at BTI);
  • redevelopment project.

If the reconstruction project involves expanding the apartment at the expense of neighboring premises, the consent of persons living in the same building will be required.

Where to apply?

Documents for apartment reconstruction must be submitted to the housing inspectorate. In a number of regions, housing inspectorates accept applications submitted through official websites.

Important: in some regions, issues related to redevelopment are resolved by the architectural and planning department.

After receiving the necessary documentation, the housing inspectorate launches a procedure for assessing the possibility of carrying out such work. To do this, the reconstruction of the apartment is coordinated with the SES, fire service and other departments. Also, employees of relevant organizations are sent to the address where the redevelopment is being carried out to assess the possibility of carrying out such work on site.

Important: applications for apartment refurbishment are reviewed within 20 days. If necessary, this period can be extended.

If a positive decision is made on the application, the owner receives a work log, which reflects the following information:

  • repair deadlines;
  • quality requirements;
  • sequence of work;
  • conditions for reconstruction.

The decision to approve the redevelopment is valid for one year. During this period, the owners must complete the work.

How to obtain permission to redevelop an apartment?

To obtain permission for redevelopment, it is necessary to submit the following documents to the local government body (in Moscow, to the Housing Inspectorate electronically through the public services portal):

  • application (for Moscow - request in the interactive form of the Public Services Portal);
  • redevelopment project;
  • title documents;
  • BTI technical passport;
  • technical report (for Moscow);

Permission to redevelop an apartment in the Moscow region.

Obtaining permission to redevelop an apartment or non-residential premises for most types of redevelopment is a long and complex process of collecting the necessary documents, certificates, ordering design documentation and technical conclusions from specialized design organizations, analyzing legislative acts, searching and meeting with the author of the house project, a large number of trips. As we have already said, if you decide to deal with the issue of obtaining permission for redevelopment yourself, then first of all, seek advice from the Housing Inspectorate of your district, if your apartment is located in Moscow. If the apartment is located in the Moscow region, then you should contact the city or district administration for advice. The procedure for obtaining permission for redevelopment is discussed in more detail in the corresponding article. We hope you find it useful.

Owner's obligations arising during redevelopment

Work on the reconstruction of apartments is accepted subject to the following rules:

  • stages of work are reflected in the production log;
  • repair of production in accordance with established standards;
  • acts for hidden work are drawn up in the sequence indicated in the journal.

Important: the transfer of gas equipment and pipes can be carried out by organizations that have the appropriate license to carry out such activities.

Control over the repair is carried out by the housing inspectorate or the organization that prepared the design documentation.

Conditions for obtaining a certificate of completion of apartment reconstruction

Upon completion of the redevelopment, the owners must issue a certificate of completion of the work. This document is provided by the acceptance committee, based on an assessment of the condition of the apartment and the compliance of the work performed with those indicated in the magazine.

Important: this act must be obtained before the reconstruction permit expires.

Applications are accepted from apartment owners. Property owners will need to provide the same documents that are required when approving a redevelopment project in the housing inspectorate (passports, BTI registration certificates and others). It is also necessary to attach a production log, including inspection reports for hidden work, signed by the design organization.

Certificate of completed reconstruction

After receiving the request, the housing inspectorate sets a date and time when a commission will visit the site to conduct an inspection.

The procedure for obtaining permits for redevelopment

All permits and approvals for redevelopment cannot be obtained in one day. Even if you use a standard project to carry out work, the overall approval period will be affected by the preparation of other documents, the organization of a meeting of apartment building owners, the preparation of a technical plan, and other mandatory procedures. We will describe the list of actions for redevelopment on different types of objects below.

For a non-residential building

The simplest option for redevelopment is if the premises are located in a non-residential building. In this case, the owner is required to:

  • obtain consent from all rights holders of the facility where the layout will be changed;
  • order a project;
  • conclude an agreement with a contractor and carry out all work strictly according to the project;
  • sign the work completion certificate;
  • order a technical plan under an agreement with a cadastral engineer;
  • register with Rosreestr and receive an extract from the Unified State Register of Real Estate.

Redevelopment can affect several rooms in a non-residential building at once. Such work can be provided for in one project. Accordingly, for all premises whose parameters have been changed by redevelopment, it is necessary to prepare a technical plan and be registered with Rosreestr.

To assess the condition of load-bearing structures, a technical report is drawn up. It is needed for redevelopment in the premises of an apartment building.

For apartment

With residential premises everything is much more complicated. The safety of any construction work in apartment buildings is controlled by state and municipal services. The apartment owner is required to:

  • obtain the consent of all other apartment owners (for example, a spouse);
  • order a project, a technical report on the safety of work for load-bearing structures;
  • organize a meeting of apartment building owners and receive a protocol with a positive decision (regarding work related to changes in common property);
  • submit documents to the Ministry of Housing for approval;
  • carry out work on the project independently or with the involvement of a contractor;
  • receive an acceptance certificate from the Moscow Housing Institute (it confirms that the work was carried out strictly according to the project and meets safety standards);
  • order a technical plan, register with Rosreestr;
  • receive an extract from the Unified State Register of Real Estate, which will reflect the new parameters of the property.

How to legitimize what has already been done?

The fine for illegal redevelopment is 2-2.5 thousand rubles. Despite the fact that such repairs carried out without approval are a direct violation of current legislation, the owners still have the opportunity to officially formalize the reconstruction of the apartment.

To do this, you will need to contact the BTI and order services for making changes to the technical passport of the property.

Next, you need to contact the housing inspectorate to coordinate the repair work carried out. If this organization gives a positive decision, the owner needs to contact the BTI again to obtain a new cadastral passport. At the end, you must contact Rosreestr with this document and obtain an amended certificate of ownership.

Through the court

In order to legalize the reconstruction through the court, it will be necessary to prove that the work carried out does not violate current fire safety and sanitary epidemiological standards. This will require appropriate conclusions from the Ministry of Emergency Situations and the SES.

How to remodel in Moscow in 2021

Redevelopment can be done in almost any apartment if you choose the right solutions for changing the configuration of the premises. Initially, a technical specification for the design is drawn up. In it, the owner, with the support of specialists, will indicate what layout of the apartment he wants to see after completion of the work. At this stage, you can check the documents and initial data for the apartment and house, determine what can and cannot be changed.

Below we will talk about the most important stages of redevelopment and its approval. If you have any questions, you can ask our experts.

Project

Each owner who makes a redevelopment expects to improve living conditions, make more efficient use of living and auxiliary space, and create a unique design. Such plans cannot be implemented arbitrarily, as this may contradict security requirements. Therefore, to change the layout you always need a project.

To complete a project for remodeling an apartment in Moscow, you need to choose an organization that is a member of an SRO. This ensures that specialists meet the requirements for qualifications, education and work experience. It is in the project that it will be stated:

  • what work is planned to be carried out in the apartment;
  • what safety requirements must be observed when carrying out work, when changing the layout and characteristics of the apartment;
  • what the configuration of the premises in the apartment will look like after completion of the work;
  • what materials should be used in the redevelopment process.

The project is done taking into account the actual layout and condition of the apartment, the location of the walls and other structural elements. In some cases, standard designs can be used, but this rarely suits the customer.

Technical conclusion

Design solutions must ensure safety for the structures of the house and apartment. This is especially true for load-bearing structures, since their damage or excessive load can lead to destruction and loss of strength. Only experts can confirm that the redevelopment corresponds to the actual condition, wear and bearing capacity of structures. For this purpose, the State Budgetary Institution “Expert Center” conducts surveys and calculations, issues a technical report on the condition of load-bearing structures.

Also, before submitting the project for approval, you need to obtain a copy of the technical passport from the BTI. It also contains information about the characteristics and layout of the apartment. When the redevelopment is completed, changes are made to the technical passport of the BTI. If the BTI information for your home is uploaded to the database of the Ministry of Housing and Property and the Department of State Property, changes to the registration certificate will be made automatically.

The project will show what changes the redevelopment will bring to the apartment.

Coordination

Coordination of redevelopment means obtaining permission for construction work to change the characteristics of the apartment. The main stage of approvals takes place at the Moscow Housing Institute. You need to imagine:

  • project;
  • technical conclusion;
  • BTI technical passport, copy of the floor plan;
  • title documents for the apartment (if this information is not available in the Unified State Register of Real Estate);
  • application for approval.

The period for reviewing documents is up to 45 days. In practice, approval is issued earlier than this deadline.

In some cases, you need to obtain permission from the general meeting of apartment building residents. This is required if construction work will affect common property. For example, holding a meeting and approving the issue is necessary when installing or dismantling door and window openings on the external walls of a building. The minutes of the meeting with a positive decision must be submitted to the Ministry of Housing along with other documents.

Ask a Question

Question to the expert

Submitted documents to the BTI for approval of the redevelopment. I was refused because BTI does not deal with this. Is the refusal legal?

Yes, the BTI bodies are not involved in approving redevelopment, since this is the authority of the Moscow Housing Inspectorate. The BTI only needs to make changes to the technical passport.

Is it true that in order to approve the redevelopment you need to contact Rosreestr?

Not certainly in that way. The approval of the redevelopment goes through the Moscow Housing Inspectorate. But after completion of the work, changes need to be made to the Unified State Register, and this is done by Rosreestr.

Is it possible to coordinate redevelopment in Moscow online? How to submit documents remotely?

To do this, you need to act through the mos.ru website. You can log into your personal account on the site using your digital signature or your government services account (USIA).

If we made a redevelopment without approval. Do you have to dismantle everything in the apartment? Or is there a chance to agree upon it after the work is completed?

Legalization of already completed redevelopment is allowed. To do this, you also need to contact the Moscow Housing Inspectorate. If a negative decision is made, you can appeal it in court.
