Are private firms required by law to provide anti-terrorism training?
In accordance with clause 3.1 of Art. 5 of the Law “On Combating Terrorism” dated March 6, 2006 No. 35-FZ, Russian individual entrepreneurs and legal entities are required to comply with the requirements for anti-terrorist protection of objects used in commercial activities. In accordance with paragraph “and” of Art. 14 of the Law “On the Protection of the Population from Emergency Situations” dated December 21, 1994 No. 68-FZ, heads of organizations are obliged to carry out work aimed at preventing such situations (hereinafter referred to as emergencies) on the territory of their organizations. Since a terrorist act can be a factor in the occurrence of an emergency, this provision of the law can be legitimately interpreted as establishing an obligation for private firms to prevent a terrorist threat.
But there is one caveat. On the one hand, private firms need to work on anti-terrorism security, on the other, the concept of “instruction” in the context of anti-terrorism security is not enshrined in the legislation of the Russian Federation. Thus, the organization, until the algorithm for solving the corresponding problem is approved at the level of the legislation of the Russian Federation, approves the scheme for conducting anti-terrorist briefing at the level of local regulations.
